In many places the BBB does not have any teeth. All they can do is label the offending business as scam artists w/o more. Scam businesses just let this slide off them. A better course would to, in addition to the BBB complaint, send a professionally sounding letter that avoids shrill or abusive language and tone to the consumer fraud/protection...

I see some of the same things in bicycle racing. Roll up to the starting line for the Masters races and the bikes are all state of the art. It is not a "technicality." One of the reasons they punish it harshly is because folks have taken a banned substance, gotten caught, and then gotten a bogus, pre-dated Rx and said "Gee whiz I was taking it all along...it was just a misunderstanding..." Lance Armstrong did this with the steroid cream he was using in the TdF years ago...

You might also consider getting a smaller sized frame for you glasses. I did that years ago and it made many more goggles brands and models work over my glasses. My fav was always the Scott OTG.
