Wondering..have any of you ever been out riding (not racing) and gotten injured, went to hospital/urgent care for said dirtbike related injury and then several weeks later received a questionnaire from your insurance company's legal/subrogation department?
Seems like they are gathering info to get out of paying if they can but I am unsure.. The questionaire asks if it was a sports injury, motor vehicle related, on school property, product liability related.ect.
Just curious how one might go about filling out the form honestly, but avoiding any potential pitfalls? I know you are not legal advice just never crossed this road before and am curious about others experiences with this. Thanks!

Sounds like the intake doctors may have misheard you when you said you crashed on your Mountain Bike. They are def trying to get out of paying. some policies don’t pay if it’s an organized race - practice is ok. Some don’t pay if your on a purpose built track. Some don’t pay if you’re on a MC….period. I’ve never said I was on my motorcycle except if I got carted in on a gurney. As far as all the urgent care X-ray tech and ER nurses in my area know I am very clumsy on my skateboard and mtb. Read your EOB very carefully and you’ll find the exclusion. If you can’t find your EOB ask for it or figure out how to download it
More then likely trying to get out of paying and looking to see who’s property you was on and looking at going after them or their insurance to pick up the bill. Sadly stuff like this is why riding spots and tracks go away. Kinda wild we pay so much for insurance but they don’t want to do their part.

I always just claim a solo mountain bike crash unless I arrive at the hospital by ambulance from a track, then I got hurt practicing, but never racing.
i got hurt last summer and was taken to the hospital by ambulance. I broke a few ribs and spinous processes. There is nothing they can do for any of that, so I was released in about 3 hours. Even though they did absolutely nothing but pump me full of 3 types of pain killers that caused me to puke constantly on the drive home, they still billed my insurance company for well over $50k. I wasn’t going to give them any ammo that might allow them to deny the claim.
If your insurance is the same as mine, its an optional form. I throw it in the trash and move on. They may mail you another one which will get the same fate. It in no way affects your coverage.
They send it to me even when I do wreck my mountain bike...
Insurance availability/cost is a greater liability for the future of the sport than anything else.
Throw it in the trash. Nothing to be gained for you by filling it out, especially if they've already paid the bills.
When I shattered my shoulder last year I got a few letters in the mail asking about where the injury happened and details. I just never filled it out.
I would ignore it at first also even if they send a second one. Unless they start denying paying for it if you don't. I wouldn't bother with it. Btw if you ever tear your acl it was a soccer or skiing accident. The #1 cause for tears.
I have always said I was riding my bike but never state weather it's motorized or not. My parents always had me do this growing up also. Broke my leg from falling off my bike. Never seem to have any issues and Docs never pressed for more information.
I just recently had an er visit and surgery, I just said I was riding a trail rather than the track I was at because I didn’t want them to go after the track. No issues.
it’s amazing how dangerous a pick up truck bed can be, it’s slippery and a fall from that height can injure all kinds of body parts such as wrists arms ankles legs, even shoulders…. can give you a concussion if you hit your head when you fall. I also give a strict “i tripped to an out stretched hand” or “why does it matter” response to any doctor or ER emissions personnel.
I had the questionnaire after my last crash (practice track), I filled it out, and it has been absolute hell for the last 2 years. Insurance wouldn't budge until it was filled out, and they have sent it over and over saying they haven't received it. They've told the hospital they can't do anything until they receive it.
Very annoying because for some reason my insurance company to this day thinks it was a street bike accident
Insurance companies do this with any injury. We’ve gotten them when kids have gotten dinged in non moto injuries with a trip to the ER. They are “subrogated” to your right to sue anyone to recover funds they paid to the medicals to treat you from the responsible party. They want a target.
A more serious issue is whether your policy excludes coverage for certain activities. That is not a moto board assessment, get a pro to look at it if you are at all concerned.
Reading this is just bizzare to me how you have to read through the small print to be able to get what I consider normal health care if you would break some bones riding your bike and not go bankrupt. I'm mind boggled to be honest, the most I ever payed was 10$ for a week in the ER with a few broken bones and a broken neck.
Yes, I have had this happen. It was Blue Cross/ Blue Shield. They was trying to find a way to go after the land owner or race organization to pay. All the forms signed and track had liability insurance. Track was AMA sanctioned.
Just went through this experience. Your health insurance company is not trying to get out of covering your costs, however they are trying to determine if they can recoup their losses by subrogating against another insurer you might have.
I broke my ankle in July and filled out the form you speak of with "dirtbike crash." I also filed a claim with my motorcycle insurer because I was entitled to having my out of pocket expenses covered up to a certain amount for an injury. My health insurer sent me a notice that they would subrogate against my motorcycle insurer to potentially reclaim some of their losses. I received the notice and forwarded it to my motorcycle insurer and from there, it's between those two.
I'll admit that I don't know all of the nuances of subrogation, but in my case, filling out the form had no negative impact. Check your health insurance plan for peace of mind to ensure that there are no injury clauses for a specific type of injury - but those are usually reserved for very "cheap" plans that you might have to buy if you were out of work and not on a company policy.

What ends up happening is your medical insurer will go after the track owner. This is how recently there has been a ton of tracks that have closed because they lost their insurance. There is only several companies out there that insure tracks in general including motocross and all car racing. Without insurance these facilities cannot open. You may not ever intend on filing a suit against a track owner, but you and your name could get drug through the mud simply because you were the injured party.
They are looking for someone to sue on your behalf to recoup their “losses” if you are on “public” land doing a “normal” activity, there is no one with pockets deep enough to go after.
When I got a larger life insurance policy I was told this was professionally racing.
I got one when I broke my leg slipping on my own deck step last year. They just want to find someone else to pay. I never filled it out. They payed the hospital eventually.

Listen carefully: the insurance company is not your friend.
They can and will do anything they can to deny your claim. Don't lie, but do not give them any more info than is truly necessary: you fell. (True.) While outdoors. (True.) And received scrapes, bruising, broken bones, and/or other injuries. (True.)
The truth is, they have already calculated your likelihood of getting injured and they charge you insurance premiums for that. You've paid your part, now make them pay theirs.
This just sums up how fucked your medical system is over there.

They include the “high risk behavior” categories as a freebie for them, but those forms are typically so they can pass claims off to employers as workers comp claims. A significant portion of guys our age that end up in the ER are there for work related injuries.
Pretty shocking really for someone that's never had to worry about stuff like that. Even though the UK health service is being gutted you could still break multiple bones, get a free helicopter ride to the hospital and get operated on with no worries of paying for it or not telling anyone what I've done. I've even shown the doctors and nurses videos of why I'm there before now.
I'm currently driving my van with the bike in the back through Europe and I'm even covered for free for emergency care here too. The only place I need insurance is through West Africa!
It gets put down as a motorcycle. They want to check and make sure it wasn't on the road and someone else is at fault. You crashed by yourself and it was your fault, they can't deny you if you put the fault on yourself.
My buddy always says he fell off a ladder.
