What I don’t understand is, how come when these cases do go to court, the owner of the track saying “Your honor, they signed this document acknowledging the risk and agreeing to the terms, then chose to ride the track.” 

How does that not just make it “case closed.”

In the case of LACR you have former professionals on the plaintiff side saying this feature was more dangerous then it needed to be and several people complained and the operator didn’t change it.

The problem is, it has been determined that a parent can not sign the rights of a minor away and a minor can not sign it's rights away, so you can have them sign anything you want, but it means nothing. That went to court a few years ago and been determined and that's why insurance companies are ending up paying. That is also why all tracks are stopping pit riding.

Also we have to reduce the sound of the bikes, in Europe this is the main cause of tracks closing down

I'll add another perspective (not to disagree):  I've been involved in my local MX club for 25+years and have worked with the on site medical team for much of the time.  Jumps are NOT the cause of most accidents.  Increases in crashes, and in particular, the bad ones, are directly related to poor grooming that results in deep, log ruts.  Fast guys love the ruts but most low to mid skill riders, not so much.  High speed cross ruts have proven over time to increase reportable crashes.

This is not an absolute, just the experience at out track.

The problem is, it has been determined that a parent can not sign the rights of a minor away and a minor can not sign it's rights away, so you can have them sign anything you want, but it means nothing. That's why in the future it will be no one under the age of 18 will be able to ride. Believe me its coming.

Too many people have a horrible mentality. It's up to us as humans to not suck and accept that things happen. Even if the outcome is crappy. 

I shattered both my heals due to a faulty throttle cable set up (a known issue, just not known to me). Throttle stuck wide up coming up to a 90-100ft jump. I had plenty of people tell me I should start a lawsuit on the bike manufacture and also the hospital (different story there).  I did neither of those things. (this is not a pat on the back). I knew that opening up those lawsuits did motorcycles no good.  Would I have made easy 6 or 7 figures? Probably.  IF I had sued the manufacture, it could do permanent damage to their business. Does that manufacture turn around and sue the track or the throttle cable or carb manufacture? 

I do not understand why people go for the easy money with lawsuits. It's a really crappy quality in people. It hurts our sport/industry in every way.  A law needs to be changed to not make it so prosperous for those suing.  There isn't much harm done if they lose the lawsuits; so why not do it (if you're the POS who would do them in the first place).  I know some countries have some laws in place where if the person suing loses the case they must pay everyone's legal bills.

PS: Waivers are clearly pointless.

Might be a good idea for tracks to require that coverage to try and help reduce claims against them.

Another thing to bring up, which is somewhat out of our control, is the fraud and games played between medical providers and insurance companies. Doctors and hospitals overcharge for their services because insurance companies underpay or negotiate lower payouts. The DR's play a game of arbitrary inflation to try and recoup the actual costs and insurance co's try to pay as little as possible. My broken leg cost almost 100k; after the emergency room visit, surgery, OR tools, anesthesia, and aftercare. They tried to stick me with the whole bill before and after surgery as my medical insurance wanted to kick me out of the operating room after they found out how it happened. I don't feel bad for insurance companies at all. I've been a victim of them on many fronts.

Yeah, I remember there was a case where a lady was getting portrayed as a horrible person for suing her nephew for an injury sustained when he gave her a hug. What really happened was her insurance required her insurance to sue his insurance. The media still made her sound like an evil witch, even when they clarified the story. I felt bad for her - the evil witch story was what the media wanted to sell, assholes that they are.

Tracks close everywhere for many different reasons. Mostly urban suburbs sprawl, which is a product of the determining that the free market should determine urban planning… rather than ahh, urban planners.  Just like Americas insurance companies deciding whether people get healthcare paid for or go bankrupt… rather than say ahhh medical professionals.  


It’s like taking your KX125 to Dave Prater to determine what needs to be done to make it faster instead of Mitch Payton. It’s dumb.  So fucking dumb.  And being actively ignorant to idiocy is the straightest road to idiocracy…

My kid is currently growing up on this track and made so many friends and memories. How can tracks survive if all it takes is for someone to break the rules, sue, win, and track has to close affecting all the families and riders. This keeps happening. 

ICE vs Electric doesn't matter, there is no saving tracks if personal responsibility does not come into play and tracks are protected. AMA HAS TO DO SOMETHING or WAIVERS HAVE TO MEAN SOMETHING or LAWS NEED TO BE ALTERED to protect tracks who open up to serve riders. 

The sport is in jeopardy—if tracks close, bike manufacturers lose sales, aftermarket companies can't sell parts, gear companies suffer, sponsors pull back from supercross, pros lose contracts, and the cycle continues.

What do we do? How do we solve this. I don't care about how comfy Deegan looks, how long the Stark battery last, or which helmet to buy, no offense to those who do. What I care about is having a sport for my kid to continue to enjoy, so how do we as consumers and an industry step up and get something done? 

AMA won't do shit for you or tracks. They are there for open pipes and no helmet laws.

Likely yes, as the track operator leases the land and doesn't own it.  That is the best way, if you own land and want to have a moto track, need to form a non profit club and lease your land to a club that has no assets.

Out here, Elsinore is a lease from the city I believe. Glen Helen is a lease but the property is owned by San Bernardino County. It really doesn't matter, whoever has the lease has to get their own insurance.

This is why I can't understand why washougal suddenly the past few years. Has taken on this ripping it deep grooming tactic. It creates big deep long ruts. With all the bs they just went through. You would think that would be a priority to limit such conditions not encourage it.

It's not a big leap, if there's somewhere else that has a better system of insurance for medical or liability we should be looking to implement and improve that system rather than try to invent something from a blank slate.

The people that put in all the hard work to run a track deserve to make a decent living doing it.  If it was profitable to do so, more people would do it and we would have more tracks.  The only way I see this happening is if they charge more at the gate.  I bet most of my local tracks that have shut down would still be open if they could charge like the road race courses do.   Sorry if this is too much common sense for some of you.

I think the land that tracks sit on is way too valuable to the owner to use it for a motocross track. If you raise the fees to ride I just think you will have less people out there. It's already expensive enough already but I get where you are coming from. I see lift tickets at Mammoth Mountain at $239/day on a Saturday during Christmas vacation. Golf can be crazy expensive too. Something else, I believe we lost Milestone MX because the land owner could get more money for it to be a giant big rig parking lot than a MX track. I'm sure the insurance is way cheaper. Something has got to give, I ain't taking up golf or skiing at my age.

Those advocating for a "universal healthcare system", do you guys honestly believe our government is capable of putting together a viable plan for this? Have y'all seen the national debt total lately? Where does the money for this "plan" come from? Do you think doctors will agree to take a pay cut to make this plan viable? Do you think that the education system is also just as fucked and also partially responsible for the total clusterfuck we call our healthcare system? Have you guys priced a top level college education for a neurosurgeon? I'm not saying we shouldn't be looking to improve this shit show, but unfortunately the genie is long out of the bottle and I honestly don't think there's an effective way to put it back in. The main reason we're in the situation we are in is society in today's world has no personal responsibility and they've been told thousands of times by these unscrupulous ambulance chasers that someone else is at fault and they can get rich quick with zero effort.

I think Wisconsin has a potential solution with the Recreational Immunity law.  

As I understand it a lot of the boat launches in Wisconsin are on resort property.  So the resort owners were getting sued every time something dumb happened at the boat launch.  Eventually the resorts and others came together to push for the law they have now which pretty much makes property owners immune to lawsuits when people are on their land for recrational activities.  

This same law applies to motocross tracks in the state as well. The local tracks still have riders sign waivers which helps protect them but really its the Recreational Immunity law that is keeping them protected. It also greatly reduces the insurance they need to carry and in turn the cost from insurance. 

At least thats how I understand it from some chats I have had with some track owners in the state of WI. 

Yeah more or less the resort is a bar. The Wisconsin bar association or tavern league is Very powerful . Example it’s legal for a parent or legal guardian to serve there children alcohol in a bar or restaurant in Wi. And they never shutdown for c19.  It’s like how old is Bobby now ? Oh he’s 9 , well give em a shot of Brandy. Then everyone laughs at the kid getting ripped.  A kid asking his mom , hey get me a old fashion your drinking . Is always cute.  I had countless adults say you got ta try this bloody marry . It will put hair on your chest.  I try & say get me 1 , it’s fun in 2nd grade to get ripped.  The drinking leads to counties having awesome riding parks & tracks. Like Wi. Rapids 20 bucks  to ride the best spot in the country.  Our local track is 200 for unlimited riding for the yr. A private owner that host non ama races & his own off rd series. Races included at ski hills.  Unbelievable cold & windy now with snow flying in western Wi.  New Glarious beer is only sold in the state of Wi. People go crazy ovr this stuff.  They call kwik trip & say could u plz not put it in a cooler . When it warms in there car then chilled again it changes the flavor.

I guess I don't understand your question....I'm not for or against any ideas. I just think universal healthcare is a good hearted thought, but making it a viable system that works for all citizens is far fetched.

This!  If the person suing has something to lose, it will greatly cut out the nuisance lawsuits where persons are just hoping for a big payout.

Anyone that thinks the U.S. Govt. is capable of running a universal healthcare operation has not been following how the VA treats our veterans and/or hasn't tried to navigate the Medicare/Medicaid world.  It is exactly the kind of shit show you would expect from Washington.

I shattered both my heals due to a faulty throttle cable set up (a known issue, just not known to me). Throttle stuck wide up coming up to a 90-100ft jump. I had plenty of people tell me I should start a lawsuit on the bike manufacture and also the hospital (different story there).  I did neither of those things. (this is not a pat on the back). I knew that opening up those lawsuits did motorcycles no good.  Would I have made easy 6 or 7 figures? Probably.  IF I had sued the manufacture, it could do permanent damage to their business. Does that manufacture turn around and sue the track or the throttle cable or carb manufacture? 

I do not understand why people go for the easy money with lawsuits. It's a really crappy quality in people. It hurts our sport/industry in every way.  A law needs to be changed to not make it so prosperous for those suing.  There isn't much harm done if they lose the lawsuits; so why not do it (if you're the POS who would do them in the first place).  I know some countries have some laws in place where if the person suing loses the case they must pay everyone's legal bills.

PS: Waivers are clearly pointless. 
  

I had my throttle stick wo on my 91 cr250 in4th or  5th at launch . Flying up a ski flying ramp on a ski hill. I bailed 40+ ft in the air going up the hill, so I didn’t get hurt. I was trespassing & really didn’t want the land owner hv to get me help. Lol.  Get hurt on a few construction workers land or truckers track . And say your suing from the hospital. You will get a visit from them in the hospital. And be told don’t ever leave here. And you will hv enemies for the rest of your life.  It’s something people just don’t do in the state.

There has to be a little more to this story, I mean this was not even on the track portion of the facility, I heard it was a ditch near the pit area that he was not supposed to be riding anyway.  The track's insurance should have protected them from that, just like any other business in America.  What I dont understand is why the track is being told to close?  If someone slips on isle 3 a Walmart and sues the company, the store is not told to close.  This tack has been around a long time, and I am sure its not their first lawsuit, so what is different about this one?  

IDK if they did, but If Terry's insurance co canceled, not much he can do.
