There is damage to your head, your tools are smashed and possibly in the long run, you will be more mentally challenged than you already are. You missed work and paid for your own medical care.

I haven't seen it mentioned on here (sorry if I missed it) but in order for a rider to collect the $5k (or whatever amount) they must sign away their right to sue Feld (and I would presume any other entity associated with the race). Jason Weigandt replied to a twitter post I made confirming this and stated some riders are refusing to sign away this right.

Their lawyers would burn through $5k in fees by the time they opened the first notice letter that someone was suing them. This was a simple cost/benefit calculation. Pay $5k now to whoever wants it to protect themselves from tons of lawyer fees and bad PR down the road.

Suing FELD would be a huge waste of time, they are a 2 billion dollar organization with a truck load of powerful lawyers that will tie this up in litigation for years. This would probably be considered a work place accident so the settlement would have limits anyways.

If the riders were smart, they would get together and try to negotiate 25k plus Dr bills without lawyers.

My take, I don't think Feld will pay anything ; it must be covered by an insurance policy of some sort, like "civil responsibility". Mistakes can happen and it should fall under this. The only thing they should pay in the end is an increase of their insurance policy.

That is why I think the riders could/should be asking more. They can try to value the bike as it came, and the bike as it left. Some bikes are probably worth 50k so I would not be surprised if they lost 25k ... without counting the skin or further health bills and issues that could potentially come from this.

I don't blame Feld or the track workers, mistakes happen and props to them for admitting it.

Ya know, you can call me an AHole or whatever, I’m a BigBoy & can handle that.
I’ve been in Pro Racing for most of my Life.
This like many other things over my many yrs kills me.
At the end of the day, SD & its Schedule for the day set the tone for a Cluster Fuck of a Day.
Any 5yr old with a cell phone saw the approaching weather.
Sound Testing was a Huge waste of Every1’s time due to the 300% coming weather.
After that the Track Walk & Practice should have been moved up.
Why the Amateur Screw Up??
Not their 1st Rodeo!!!
Again, these mistakes happen ALL TO OFTEN.
For me, it’s the people involved.
None of this should’ve happened.
Now they’re just passing the Buck the same way they always do.
It’s a Sad State of Affairs, 1 I don’t miss since Retiring from the Sport I call the Circus.
To to many people in positions they shouldn’t be in.

The size and prestige of a firm matters little when the facts of the case are heavily weighted to one side. If the company knows they are likely liable and either a) fees are statutorily recoverable by the plaintiff, or b) the plaintiff could never pay fees if the plaintiff lost because they’re broke (like a privateer), a big company knows they’re never going to recover the hundreds of thousands of dollars they throw at fees through years of litigation. That’s why lunch break violation lawsuits or ADA violation lawsuits settle for $25,000 to $50,000 when the violations may only add up to hundreds of dollars— big companies are smart enough to know when they’re throwing money into a fire.

Plaintiff attorneys also know this.

McDonald’s is bigger than Feld, spill a cup of coffee, make 11 million! Stop with the “Feld will tie up in court for years!” They won’t! And are you all ingnorant? You know lawyers will not take any money up front if they believe in your case.

The takeaway here should be; take care of you and yours, because no company or individual truly has your better interests or well being in mind. They just don't no matter how it's packaged. Seek counsel. Seek professional opinions (definitely non-vital).

As soon as you give a powerful entity the keys to your entire castle, your locks are going to get changed when you turn your back, whether you like it or not.

I don't like it either and I have never sued a person or corporation, but I've certainly sought counsel after being on BOTH sides of such a coin, if that what is meant by being "lawyered up" on here, and agreed to settlements.

A guy who has owned a company for a few decades whose major ingredient in one of its products is lime. I've seen plenty of lime burns, and what I see from the pictures isn't anything I haven't seen.

Yes, lime burn sucks, but unless you're literally bathing in it, you'll be fine after a couple weeks of discomfort.


And say they all do get together for a class action suit, they would be tied up for YEARS in litigation and they would still probably at the very most get 60k, and the lawyer would get 40% of that.

I agree. I truly don't care what any of the parties do, that's up to them. I know what I would expect and how I would handle such a situation and that's what is important to me.
People discussing valid opinions that differ is still OK, isn't it? But I guess the SX ruler maintaining sovereignty and people bringing an aging and broken value system (emotion) into what is now a business transaction makes the most sense to the najority here.
Seems a little quick for any settlement to be reached only four days after the fact. Big brooms sweep fast.

I’m not so sure it would be a class action. It’s not like everyone has identical burns or identical damage to their bikes and equipment.

It doesn’t look good for a company to be tied up it court cases, especially when they are wrong.
Nobody got 11 mill from hot coffee, she got a little less than 600k and it took 4 years to settle it all because McDs tried to tie it up longer.

Out of that 600k, the lawyer got 40% leaving her with around 350k.

The fact that you knowingly allowed employees to continually be burned by chemicals while working at your company "as part of your implied job description" is exactly why I am expressing my opinion on here.
