NC Moto Scene Will Be No More...

Reading through the lovely North Carolina State House pending bills after a local track owner brought it to my attention. If this Bill passes, it will cause more vast new expense to owning & operating any Moto or ATV facility in the state of NC, not only just that facility, but also any race event, such as GNCC races, area LL qualifier, you name it. Probably even if a MXGP came back to Charlotte.

Not sure of what the cost of liability Insurance would be on a moto facility, but I imagine that a lot of companies would shy away from even wanting to offer a policy on a facility.

Would the AMA, Victory Sports, or the manufactures & dealers be interesting in contacting the parties supporting this pending legislation and try to educate them just a little. Not sure why this is happening, but someone has to be stuffing their pockets somehow from it, and it's not the facility owners. I know I've signed an online petition. www.OffRoadCouncil.com to at least show support and emailed and already called the state Senators backing this bill, as well as the guy that represents my district.

Well this sucks, my wife and I had recently started talking about getting out of shitty Connecticut, and the Carolinas (mainly North Carolina) were two states that we both agreed would be nice. And when I saw how many public(ish?) tracks were in the state I was ready to pack my shit now and go. Got a kid coming next month, and I was gonna pick up an MX bike and maybe actually ride more than just back yard/hidden sand track putting around and teach the boy when he's old enough. I know its no consolation, but Ct literally has one track "open to the public" (it' belongs to a club and if you're a member you can basically ride whenever) and that's only on open practice days. All the other tracks are either closed, or privately owned by a club with a waiting list to join. So there's no MX up here anymore either

because tort lawyers sue anything that moves, and we lack the political will to limit liability the way they do in other countries. Look at all of the silly warning signs everywhere in America; they're not to actually stop anyone, they are there to help prevent lawsuits...

MX is no different...it would seem self-evident that it's somewhat risky, but idiots get hurt and want to blame everyone else (I do make an exception when it comes to tracks mixing little kids and big bikes, which I think is asinine).

The minimum AMA liability insurance coverage/requirements are 1mil per occurrence, infinite aggregate so if an event is AMA sanctioned the requirements will be more than covered.

Also the AMA now provides sanctioning and access to insurance for Practice days, Track Days and Schools at very affordable rates that meet the same requirements.

Ha! I would be fine with that, as long its closer to the coast in Georgia, or mid to northern florida. But she was adamant that she did not want to live in fla unfortunately. I just am sick and tired of the weather and politics here, not that politics are good anywhere, but at least the weather is!

I have called Jeff Jackson the one responsible for the bill. His assistant stated that his son passed away at a local in NC track but wouldn't say which track. My response was you assume the factor you might get injured or death may even occur when riding at any track or trails and even sign a waver. I said why should the rest of NC suffer because his son passed away. It is a dangerous sport!! I also went to on to say that I work at a local dealership and there is no place to ride we won't sell parts, bikes, ATV's. His assitant's response was "we are opening this for discussion no plan to put it into in motion and it may be shelved". I told him to to shelve it because its just more than not having places to ride.

I feel like its fallout from the Club MX Situation, that family actually lived in NC.

I haven't heard anything about South Carolina, judging by the condition they keep their roads in I don't see them making too much of a big deal over MX tracks. To the guy looking to move SC would be your best bet...especially around the Greenville area.

If it does go through I'm going to purchase trash property around my dad and build a sand track for me and my friends to ride.

Thanks BRAPP, much appreciated. I've been trying to spread the work via social media and such. The info the assistant gave is parcially correct to a degree. It's actually associated to an earlier thread on Vital about a "CLUBMX" lawsuit. Being that was in SC, the state reps in SC didn't "work for" the person from NC so nothing happened. SO now we get this legislation drawn up in NC, in a district just a short 20 miles away from where CLUBMX is located.

Seems extremely foolish that someone would choose to operate a moto track without any type of insurance, I don’t see this as a bad thing at all, especially in today’s sue happy society. Have a rider loose control and a bike go into a crowd of people, they’ll find out quickly how much they wish they had purchased one. I don’t know of any other form of organized closed course Racing that dosen’t carry a General liability policy. And if they do, they are fools.

My business liability insurance (1,000,000/2,000,000) just like what is stated is less than $3000/year. FWIW, We design, build and install industrial automation to manufacturers. While I realize my business isn't the same as a motocross facility, it is, at least, a frame of reference.

I wrote my NC Senate rep, one of my question was what prompted this. They linked an article about the Club MX incident and litigation. I heard an estimate that this insurance would cost about $200 a month for a MX facility. Besides the likelyhood of closing some small tracks, I have a problem with the government trying to regulate a dangerous sport. What will be next.

Also the bill has definitions to what qualifies as a facility. The key word is "RACE", so therefore any Off-Road race event, even if that race is only held at that single location for just a single event, it now qualifies as a facility, due to the fact that a "RACE" is being operated. Please read the Bill if you live in NC as if this gets passed and signed into law, there will be no more or very very few "facilities" to even ride at.

Call K2 Insurance or K&K.

I operated one of the busiest race tracks in the United States and our GL rates were no where close to that $59K number. Although it has been 5 years since I had insurance quoted, I dont see it sky rocketing 200%. Also we had no claims or payouts towards our GL policy.

I wrote the leading sponsor of the bill and he is CLUELESS to our sport. His first, and same email he sent everyone apparently, stated that "Currently, we have children being injured and killed across the state at these facilities and even if the injury is due to the negligence of the track owner there are very limited ability to recover for that damage." I emailed back and asked for ONE incident of a child's death or injury due to the negligence of the a track owner in our state. He replied he had A constituent's child die. I asked if that was the Club MX incident and he said yes. I asked him why was he punishing NC for something that happened in SC and I got no response...

I don't want to link his email address here, but it is easy to find. Please send emails to this guy and let him know this is a family oriented sport and he will be hurting way more kids than helping!!

It's requiring $1,000,000 of liability insurance per incident and $2,000,000 to cover any additional bodily or property damage. This is not an exorbitant amount of insurance for any company. Let alone a motor sports complex. The premiums for that level of coverage isn't going to bankrupt any "business". In fact, that's the minimum coverage they should already have in place.

I'm at least one of those, and have quotes from insurance agentcies that show actual annual costing, oh an this isn't just any business, it's inherantly dangerous and potential of injury is much higher than most businesses. With the endless amount of possibilies of a claim being made, the rates are high. I have a personal umbrella policy of a million on my house/personal property and yeah, it's cheap, but the risk isn't as high as a facility that supports a place for dangerous activities to take place as that's what the whole facility is meant for. Also, the I'm not saying that facilities shouldn't have insurance but requiring it to the level the Bill is written for is insane. Also, some seem to not understand that the State decides what the definition of the word "facility" is. Any "Public" property that has a race or practicing of skills is considered a "facility". This is huge for Off Road events, that show up on a weekend once a year to hold a race, which would now be considered a FACILITY. Meaning the property owner would be required to have this policy. Most Off Road events are operated on farm land or large tracts of land owned by poeple that aren't trying to run a "Facility". This legislation Will be a game changer, all being brought and pushed by people that have no understanding of our industry, or that take personal responsibility to their own actions or lack there of. Every time you swing a leg over a bike, you are saying you're willing to take personal responsibility if you don't maintain your machine or make a mistake or have some other event take place on an inherently dangerous activity, that you think you deserve to sue the place giving you the opertunity, is more reacting like a 12 year old girl. Although I believe that most 12 year old girls would see this line of thinking stupid and be at least a step ahead in life.

Next time you might want to take the time to comprehend the Bill, before you make a terrible attempt to insult anyone, other than yourself.
