If it's so clear, then why can't they simply issue a ruling? What is the purpose of the delay? Are they just fucking with him?

To issue a ruling they have to first have a hearing, unless Tickle waives the right to a hearing. To have a hearing both sides first have to prepare their case, which takes time. Do you realize the extent of their jurisdiction and the number of cases they have pending? They are not just sitting in an office in Switzerland playing chess.

I don’t think my company has the legal right to put me on suspension for an undertermined amount of time and regulate with a threat of where I can work within my craft out of their jurisdiction in the interim. Failed drug test or not, no one should have that much control over your livelihood.

Fair enough. However, the FAA controls all air traffic wheras the FIM does not control all motocross. He could have and should have went race in Canada and the FIM/WADA shouldn’t have been allowed to threaten his outcome if he did. I can see where this is headed and we are not there yet and their position on governance shouldn’t be treated as such.

Then perhaps they aren't capable of handling these matters in a way that any reasonable person would consider fair. I take it that one of the main complaints voiced by many on this forum is that WADA is entirely the wrong organization for this task.

Where does it state that he can’t race a motorcycle under another governing body and if he does his penalty could be worsened?

Thats really all I am after.

Haven’t seen or read where that is in writing and that it’s just something they pulled out of their ass. Let it be known that if those words are printed somewhere for athletes to read or be aware of then shame on them. Taking and getting caught with PEDS is truly career ending for most.

With all due respect (just differences of opinion) the issue I have with the situation is a cheater arguing what's "fair". Whether they're purposely dragging it out or not. He knew the rules and he broke them. Was it "fair" that he was cheating? Every one of these guys guys know a dirty test is a death sentence. Period. If they don't, it's on them. He was in independent contractor who made more money than 90% of anyone on this site will ever make in a year.

Really?

Loss of livelihood is almost equally as bad. This is America and we aren’t supposed to be run by European Union type bureaucrats. We have due process rights and an overly active civil courts system. You cannot simply accuse a man of a crime and take away his job virtually forever. They might be able to keep him from racing but the longer this goes the more it would be frowned apun by a civil court and especially a jury. It’s unamerican and might cost Feld millions.

Wait everyone is certain its a two year sentence. Sorry, but he was barely hanging on at the time. Two years out he’s more than likely done anyway given the state of our sport and amount of rides (paying) available. Tough decision but...

Sort of understand your analogy, but in this case is the suspension coming from the licensing authority, AMA or fim or is the suspension issued by WADA, and accepted by AMA and fim as part of their arangenent? I dont under a few things, why does ama need fim? Why cant WADA admin the drug testing and AMA rule on penalty, seems WADA has to much power.

WADA/USADA is the agent to the AMA/FIM
Part of the agreement in these situations is that WADA/USADA is the final arbiter.
This is to avoid preferential treatment or overriding their decisions, so yes, they make the final call as long as the bodies are associated
