Figured the experts here would weigh in...
That bike has pretty clearly been ridden. There's scratches, lots of dirt underneath, chain wear, wear on controls, tires have wear, etc.
Dirt is normal. New bikes don't even come in that clean. Looks good to me. I'll post some pics of a new yz 250 in the crate that needed to be washed before assembly.
Even pricey racecar rads I've had in have had a couple of slightly tweaked / out of line fins from assembly, handling, packaging prior to dispatch from the manufacturer etc.
No comment on the rest, I'm no expert.
The bike definitely has been ridden , 100% . Look at the right side lower frame.

pet peeve of mine, once something has been purchased, it is no longer new. Whether it was taken out of the crate and ridden or not, I have no clue, but it is not new.
Side note, *IF* the dealer assembled it and let his kid rip it around the lot, and then re-crated it...
I bet he didn't expect it to be a big deal 16 years later, with grown men with OCD arguing over the lil dirtbike's cleanliness 😂

Dealer is fine, otherwise you cant buy it. If you bought it from a dealer, it is now secondhand "having had a previous owner; not new."

Seems like losing sight of the forest for the trees when some and maybe most people in this situation understand new to mean unused.
I might be, but think about it this way.
Dealer has 2 bikes on the showroom floor - have the exact same price
one has never been sold. the other has been sold, and returned back to the dealer 2 weeks later, never ridden. They look identical. Would you have a preference on which one you purchased and would it matter if the dealer listed both in the "new" inventory?
Bottom of the motor is dirty,frame has scratches and nicks, the rear chain guide is chewed, clutch lever shows use, bars have marks from being installed in clamps, and obviously the tires. Wasn't ridden much but was definitely ridden. Kinda scammy.
There is spooge all over at the collar that connects the silencer and expansion chamber.

The seller is definitely being coy but he never actually says it is a new bike. '06 bike that was purchased from a dealer in '09 and has been in the same crate since seller purchased it in '09. Dealer probably crated it and shipped it to seller.
Never mind the dirt,scratches,chain wear, tire wear! Honda Japan only uses Husky tie downs it's gotta be real lol
Good point. I looked the listing and it just says "in crate". Perhaps it was "new in crate" at the time of the OP posting. Certainly not taking the time to disguise the use with the dirt under the engine.
Here is a page from the set up instructions on that model. Definitely not the crate the bike came in.
Seller admitted on that page that the bike was most likely ridden at the dealer. Scammy language, but at least he's commenting on it.

Where is the cardboard that covers every crate with model and serial number that flooring checks?
Crate is too big to have an 85 in it. Crates are barely big enough so they can not bounce around. In all my years working at a dealership I have NEVER seen new bikes with tiedowns used to hold it down.

That looks like a full size Yamaha crate.
The steering stops also show wear.

There is a ton of wear on the rear rotor too.
Regardless, at lease we can all agree the fluid coming out of the exhaust joint can be referred to as "spooge".
