So I have to prove I didn’t make a profit to not be taxed on it but selling something used after I purchased it new for a loss I can’t put the loss on my taxes. Awfully one sided

Who says you can't? If you buy something, then sell it later at a loss, you ought to be able to claim the loss. Unless you wrote off depreciation for the item previously. You'd have to talk to a tax professional though

You can't depreciate out your underwear or deduct the loss when you sell them on Facebook Marketplace.

I was just posting their explanation for people to read and try to understand it. Seems like it’s pretty simple to get around. Don’t deal with shady people and use friends and family. Maybe I’m too dumb to understand it, but that’s what I gathered out of it.

Not tax advice but what I am going to do is make a folder and put all my dirtbike receipts in there from now on. Ignore that 1099 form then if I ever get a letter from the IRS which is usually what happens for small discrepancies I'll reply to the letter showing that I did not profit on it by providing the receipt. Any accounts have a more proper way without making please tell us. If you buy and sell alot of used stuff then you could file as a sole proprieter and litetally deduct so many things that I bet it would outweigh any profits that you make unless you are the guy doing mx locker or dirtbike depot.

Nope, they’ll just keep promoting “free” electronic ways to receive money and discourage cash use by claiming a “coin shortage”. Does anyone think Zuckerberg won’t hand over every PM connected to marketplace for another deal to keep his Section 203 protections going? Ebay and PayPal are the same company so good luck with that.

When buying stuff from an online forum, I never pay with “Friends and Family”. Why would I risk getting screwed. So from my eyes this will lead to even more fraud because so many people will want to only use that option.

Pretty much what he said. I’ve done a ton of buying on here and FB Marketplace. Most folks on here I trust. FB Marketplace, I’m a little more leery of. I rarely sell anything, so I don’t know the mindset of others. On here, for the most part, I know the guys that are solid and I have no worries about and buy from them.

Unless you're running a business for profit, just because Paypal sends out a 1099 doesn't mean you have to claim it as income on your taxes. (If you use a CPA, be sure to inform them that the Paypal funds were NOT income.)

If the IRS sends you an inquiry about the discrepancy, type up a response that states you were only selling used goods for less than you originally paid for them. As long as the amounts are reasonable, this should put an end to the whole affair.

Yes believe it, the government wants its share. When I was selling on ebay the first year I went over 20k which at the time was the exact dollar amount at which you received one and as stated I did receive a 1099 that year and every year after. Last year of business I had a 1099 for almost 400k. Luckily I had alot of legit deductions to claim. Also got one every year from Amazon. As soon as they see these companies start doing big numbers the IRS steps in and makes sure they arent getting cut out.

One year I had deducted like 600 dollars in refunds from the 1099 amount on my declared income and was sent a letter saying that my reported income didn't match my declared amount on my taxes. I had accidentally deducted the refunds before rather than putting it on the tax return for them to see and they caught it. I explained my honest mistake but it has me wondering if everyone that doesn't declare this 1099 is gonna get a letter. Maybe they wont if under a certain dollar amount but it will be interesting to see.

I ran across this on a tax page I loosely follow on instagram. I have not yet researched this to see if it is accurate, but it could be an option. I know sending payment without buyer protection is not ideal, but might be an option for trusted sellers. It would be nice if Vital had some form of a seller rating. I normally give references when selling on other forums of facebook marketplace. I also ask around when purchasing goods from unknown sellers. This new law is really going to hurt those that part bikes or sell parts casually online to help fund their moto hobby.

Thats good to know I just verified this and he is correct it looks like they updated the law recently as the article I read had been updated at the bottom with this same info you posted. Problem with Zelle is once it is sent you cant get it back since its an ACH bank transfer so probably not a good idea unless you research the seller pretty good.

Its pretty easy to vet ppl here , just look at their history and what they post and what they have sold in the past from their posts. You can tell with 99.9% certainty that they are real members but a seller rating system would be cool. Though how would the Admins know a true transaction has occurred? Having one random member report that they bought off another can easily be done by a scammer.

On a side note I also saw on ebay it said it had to report sales over $600. I wonder if that also now has been modified to only business ebay accounts.

Technically if you have a garage sale, you are supposed to report the earnings on your taxes. It's been a tax law for years, just no one does it.

You guys aren't right . There are a lot if illegal immigrants moving to this country that needs health care and government assistance. Someone needs to cover the cost. The government did their part by cutting spending money on bullets shooting at the Taliban.

Seems pretty simple to avoid, only accept Venmo or if using PayPal use friends and family.

I’ve been doing this for years already. If I’m selling something i always required the seller to pay “family and friends”. I don’t like how doing a actual purchase would put me as a seller at risk, having to deal with some bs buyers claiming item wasn’t as described etc.

Got paid last night for some parts I’m shipping out today. Seller paid with normal Venmo, no issues.

I started parting out a KX450 late last year and sold about $2000 worth of it in 2021 on eBay. I still have several auction listings now for it and planned to keep adding parts as I have time. I used to sell items on eBay often, but haven’t done so much in the last couple years.

About a week into this year, someone purchased a small item, the transaction processed fine and the funds sent to my bank account. Then a couple days later, a set of forks sold for more than the $600 threshold. eBay said funds were received and to proceed with shipping. I purchased a label and was about to send it out. I checked the funds processing status and a noticed a banner was posted stating that my funds would not be processed until I provide my SSN so that they can send me a 1099. It said that they will request SSNs when annual sales approach $600. I will not give my SSN to eBay or any online system like that so I called the buyer to let them know. He suggested we use another form of payment. I refunded the sale with eBay and he sent funds through Zelle to my wife. I also gave him a discount, so everyone was happy. I have had 4 transactions complete this same way so far. I have not requested it from the buyers, I have just explained that I cannot process the transaction due to these changes and that I will refund them. I have been dragging my feet on removing the rest of the listings.

As far as PayPal goes, I haven’t received payment in a while, but have have thousands of sales in the past processed through them. PayPal sent notice for me to provide my SSN to keep my seller account a while back and I never did. I will not give them that info but can still receive money by accepting it and immediately transferring it to my bank. I cannot keep a PayPal balance. I know I can receive Friends and Family transactions but assume I cannot accept buyer protected transactions.

I am frustrated I cannot sell on eBay anymore, but it is not worth providing that intrusive level of personal information to them.

If you do not want to receive 1099s, simply do not give them enough information to provide them. It will limit your capabilities with their tools, but at least you will know the boundaries.

Now I have thousands worth of parts that I expected to be able to sell and have to find other ways to do so. I will likely focus on Facebook, OfferUp, VitalMX, and MX Locker. Hopefully enough sellers transition and bring a larger user base to those platforms. I also know that requiring PayPal Friends and Family, Zelle, or a Money Order is going to make it less desirable to buyers and delay my sales significantly.

Same with me now, f&f only, through my wife's venmo, or cash in person. I understand people's reluctance to pay that way, but just a little research weeds out the crooks and scammers. They are usually pretty obvious.

I’ve made many transactions on vital and all went wonderfully. Hell even better than expected and some sellers hooked me up with a couple free things that weren’t even part of the sale.
