I am surprised how many people are jumping to conclusion here unless I missed something and there's a proven recorded history of this.  To play devils...

I am surprised how many people are jumping to conclusion here unless I missed something and there's a proven recorded history of this.  To play devils advocate, I have seen and personally dealt with some very aggressive jealous women in my life who came at me with nails into my bloodying my neck, which would have been enough for the neighbors to call the cops in one situation.  And one of them turned it into "he hit me" when questioned, which was complete bullshit and she admitted to lying later when she was trying to get back with me.  One of these very aggressive woman was Miss Costa Rica at the time, a complete fireball Latina.   

So there is a chance it could be something different than what you all are accusing him of, which is why I asked if there were witnesses who saw him hit her.  If he did hit her, then I agree with what most of you are saying about it being completely unacceptable. But until you have 100% proof I would be careful jumping to conclusions.  There's also a chance of some wrestling going on inside while fighting over a laptop which could create marks on the body, so while there appears to be something there, it might not be as it seems until further evidence is exposed.  It could be Jason, or it could be his wife.

BTW, most completive athletes have short fuses during competition.  Did you see Roczen flare up last night? 

Yeah apparently they had the trial already and he was convicted of the crime. Holy shit, all it takes is getting arrested and people's minds are made up around here. Tough crowd

For the crime of domestic violence to occur, parties involved need to be intimate, or past history of. It can apply to BF/GF also. Living together at the time of occurrence is not a necessity.

Keep in mind I am citing Calif. law.

We all know how these things go. Lots of speculation beyond what is written in the report. Pretty soon things that never happened are accepted as fact simply because its been repeated enough times.

From what I gathered there is video of the "battery" on his wife, which is absolutely enough for arrest. Whether it goes further than that, well, we all know the court system and how it handles uncooperative victims after the fact. 

Bottom line is this is NOT good, for anyone. Jason. His wife. Their kid. The moto world. Only thing this will benefit is the click-hungry losers like Cooksey.

As for the "we've all done bad stuff" guys, GTFO. Plenty of people out here not living boring lives but also not ending up in the drunk tank or jail, period.

ETA: Looks like the actual battery isn't on video, but the marks on her match her story (and probably the independent witness or witnesses, so it was a "must arrest" situation. 

Yep, my bad. I briefly scanned it and thought that was the report rather than the pc statement. Carry on, lol.

It doesn’t matter if it’s a rookie or a veteran cop, Washington has a mandatory arrest policy for DVs. There are a few exceptions/loopholes, but for an event that has just occurred officers don’t really have any discretion.

I told my wife about this story and her first words were "is anyone surprised?". She's a long-time moto fan and has commented before on JAs on- and off-track behavior. She's never been a fan of his. I actually agree with her. I'm not saying he's guilty, but I'd not be surprised. 

FWIW she also can't STAND Deegan. Doesn't even like to acknowledge his obvious skill.

Sort of. As Nathanial stated, it’s more complicated than that.

In WA:

A DV relationship most commonly involves married or intimate non-married partners, but also includes things like former partners, roommates current or former, people with a child in common even from a one-nighter, etc. 

Upon responding to a report of a DV assault/disturbance/etc, AND establishing that there is probable cause to believe an assault occurred in the preceding 4 hours, AND a primary aggressor can be established, and arrest/booking is mandatory under state law. It is a no-bail offense, even when it is misdemeanor level. In other words, the arrestee cannot bail out until they go before the court. Typically, a DV order is issued prior to release. 

Although there is the 4-hour language in the law, the reality is that in practice, most suspects will get booked regardless of timeframe within reason. Also, DV crimes are the only ones that make an LEO personally liable for failure to arrest if that failure later leads to harm of the victim. The law protects an LEO from civil action for any good faith arrest under the DV laws. 

All that said, Nathanial is exactly right. Some  (especially lazy and/or new) LEOs forget that probable cause still needs to be established, DV or not. While DV laws tend to get wider latitude for pc out of an abundance of caution, at the end of the day, there are times that the parties will remain free because pc cannot be established.

Yeah, IF a DV occurred. That's my point. Just because one party says something happened doesn't make it an arrestable DV.

Document the statements and complete a full report, but if it's literally JUST one persons word with ZERO other evidence, there is no probable cause to arrest. That's in CA of all places, too.

Absolutely different agencies and States may have different guidelines regarding DV.

Keep in mind the standard to arrest is pretty grounded in frequency of these types of calls. Most officers know what to ask and look for in establishing a crime occurred. You need to do this to establish an arrest and the charge. Bruising or other obvious marks of injury elevates this to a felony. If both have similar, it can become mutual combat. Completely different.

Who knows what statements she is making to LE. But, those along with other elements met the standard for a misdemeanor arrest.

The fact he was arrested and booked suggests the seriousness of what occurred. Her dropping the charges or refusing to be a victim/witness is extremely common in possibly most cases. This shouldn’t suggest anything other than she had a change of heart. 

Unfortunately, this doesn’t change the original contact, nor the seriousness of it.

The popularity of this discussion would be no different if this behavior was associated with another rider. He just happened to be the first I know of.

It’s actually simple, don’t engage in it, period. If you do, and are a public figure, except conversations will take place. No one is to blame for this but one person.

I will say, if you don't think women can be gnarly you simply haven't been with enough of them to witness it.  Some of the hottest and/or most innocent looking, can be especially gnarly.   I think that's all he was trying to say, and that you shouldn't jump to conclusions and automatically blame JA when it could have been his wife.

I married a really hot chick once. It lasted about two years.

At some point that hotness wears off and you’re left with the actual person that you chose to be with. Sometimes that leads to significant and severe regrets and, when coupled with other life stressors, it’s not hard to imagine a man snapping.

It’s never OK to hit a woman. But I do understand where the carnal impulse comes from.

People really struggle with the whole concept of innocent until proven guilty.... it's a great standard, for the courts.....

There's no reason at all you have to apply it personally in any other situation. You'd be stupid to do so in a lot of situations, and this is one of them. 

If you want to give him the benefit of the doubt, go for it. I'm not going to and I'm going to sleep just fine tonight. Feel free to judge me just as harshly if you ever come across my mugshot and police report with same details. 

Have you ever had the cops called on you by your neighbors after you and the wife continued the fight out in the open to the point they felt it necessary? Have you ever been arrested for domestic violence and had your wife tell a cop you hit her? Even to those saying women are crazy, she drew blood, etc, did any of that happen to you? Or did you manage to get yourself free of the situation before you ended up in jail? 

This is a big city department in a gated community with million dollar homes. You better believe if they could have justified pulling out of there without having to make the arrest they would have. 

As for them still being together, read up on the cycle of abuse. Them still being together means nothing. She's financially dependent on him, her kid is financially dependent on him, he's got more resources to fight through custody and divorce than she does, and she knows all of this. The power dynamic in situations like this is so tilted in one direction it's nearly impossible for the woman to leave. Add in everyone saying "well innocent until proven guilty......." and it just makes it that much more daunting. 

You're basically telling her you've got the guy's back unless she pursues prosecution and gives up all material security for her and her kid and risks losing some degree of custody of the kid to the guy who just beat on her. Go live in a shelter until it gets sorted. Or she can choose to believe his lies about it never happening again even though she knows it will and just put on a pretty face until the next time. Innocent until proven guilty.

I will say, if you don't think women can be gnarly you simply haven't been with enough of them to witness it.  Some of the hottest and/or most innocent looking, can be especially gnarly.   I think that's all he was trying to say, and that you shouldn't jump to conclusions and automatically blame JA when it could have been his wife.

I understand what he and you are saying, I think that language is misogynistic that’s all. 

I think we should be better than that.

There's no reason at all you have to apply it personally in any other situation. You'd be stupid to do so in a lot of situations, and this is one of them. 

If you want to give him the benefit of the doubt, go for it. I'm not going to and I'm going to sleep just fine tonight. Feel free to judge me just as harshly if you ever come across my mugshot and police report with same details. 

Have you ever had the cops called on you by your neighbors after you and the wife continued the fight out in the open to the point they felt it necessary? Have you ever been arrested for domestic violence and had your wife tell a cop you hit her? Even to those saying women are crazy, she drew blood, etc, did any of that happen to you? Or did you manage to get yourself free of the situation before you ended up in jail? 

This is a big city department in a gated community with million dollar homes. You better believe if they could have justified pulling out of there without having to make the arrest they would have. 

As for them still being together, read up on the cycle of abuse. Them still being together means nothing. She's financially dependent on him, her kid is financially dependent on him, he's got more resources to fight through custody and divorce than she does, and she knows all of this. The power dynamic in situations like this is so tilted in one direction it's nearly impossible for the woman to leave. Add in everyone saying "well innocent until proven guilty......." and it just makes it that much more daunting.

Exactly. Same can be said for Mirtl. I appreciate the innocent until proven guilty discourse but when it comes to things like domestic violence, it’s pretty straight forward what is happening. Am I willing to be wrong? Absolutely. Do I think he needs to be jailed and exiled from the sport? I don’t know. Do I think he put his hands on her in a way that made her scared enough to call the cops? Yes.
