If mirtl wanted to go after them then the burden of proof would be on him to show that what they said wasn't true, they knew that it wasn't true when they said it, that they said it anyway with malicious intent, and that damages resulted because of this. This is not an easy burden to meet and why these cases are almost nonexistent. 

Same goes for employers. Unless there's specific regulations in a given field, there's nothing illegal about an employer letting the whole world know why they fired someone. Most choose not to do this out of self interest alone and to just avoid the headache and put things behind them, but much like above, if they're saying true things they can blast it out to the world and it's totally fine. 

All of this to say..... based on what happened today, you either have to believe that wassermann and the Lawrence family are both represented by very stupid people, or that they both have extreme confidence in what they know to be true and have no concern about liability that might come with letting the world know it. 

You are very wrong sir. Defamation is real and employers absolutely cannot share that information.

I want arrest warrants where my finger is on the table or I ,m calling my s. It doesn’t take much investigation to understand the key concepts of defamation in the US and some interesting history of defamation cases:

- burden of proof is on the plaintiff (in this case that would be Mirtl) to demonstrate that the statement was false and that actual defamation occurred.

- truth is an absolute defence against defamation.

- the defendants (in this case the Lawrences or Wasserman) would have to be found at least negligent or reckless with regard to the truth of the claims.

- demonstration that the claims were at least “substantially” true is sufficient defence i.e. you don’t have to demonstrate that what was said/written was 100% true and accurate.

Historically it seems that it’s extremely difficult to make defamation cases stick.

Who’s the public figure ? The judge isn’t going to know what Mx is.  NFL, nba or a golfer maybe.

Why would they need to save face with the Lawrences? Like truck said earlier, in the gigantic scope of who Wasserman represents, the Lawrences equate to an accounting error in terms of what they bring to the firm. THat's not to say they have no value to Wasserman's action sports arm, but they're not high enough up the big dollar food chain for the company to bend over backwards to appease them.

How many people would be bitching if some rumor came out that Mirtl got released, and there was nothing from WMG or the Lawrence camp?

Both "press releases" were clearly run by the lawyers first, and were intentionally worded to give an idea of what happened but not real details. Pretty well done, actually, in my humble opinion.

But that's a moo point, anyway. Like a cows opinion, doesn't matter.
