It doesn’t take much investigation to understand the key concepts of defamation in the US and some interesting history of defamation cases:
- burden of proof is on the plaintiff (in this case that would be Mirtl) to demonstrate that the statement was false and that actual defamation occurred.
- truth is an absolute defence against defamation.
- the defendants (in this case the Lawrences or Wasserman) would have to be found at least negligent or reckless with regard to the truth of the claims.
- demonstration that the claims were at least “substantially” true is sufficient defence i.e. you don’t have to demonstrate that what was said/written was 100% true and accurate.
Historically it seems that it’s extremely difficult to make defamation cases stick.

Honest question; do you think Wasserman just put out a statement about firing an agent for potential fraud without running it by their legal team first? From their website, Wasserman has negotiated $3B in NBA contracts over the past 5 years, they represent 4 of MLB's $100M+ players and close to a thousand musical artists from nobodies to Ed Sheeran; do you think they'd risk their firm's reputation by libeling an agent from a small sized sport like Supercross?
I don't think they would do that, but sometimes a rogue employee can do dumb shit. Either way, it's a bad look but maybe trying to save face with the Lawrences.

When someone is a public figure it’s even more challenging to prove defamation. Lawyers typically don’t takes those pro bono.

Why would they need to save face with the Lawrences? Like truck said earlier, in the gigantic scope of who Wasserman represents, the Lawrences equate to an accounting error in terms of what they bring to the firm. THat's not to say they have no value to Wasserman's action sports arm, but they're not high enough up the big dollar food chain for the company to bend over backwards to appease them.

Both "press releases" were clearly run by the lawyers first, and were intentionally worded to give an idea of what happened but not real details. Pretty well done, actually, in my humble opinion.
