I also got ripped off recently, I wanted to purchase a Talaria MX5 after reading all available reports and tests. I searched for Talaria bikes and found the site www.talariaebikes.com. Very professional site with lots of info, I purchased the bike and they offered a $700 discount to pay with Crypto. I do not deal with Crypto so I have my accountant pay for it for me. Turns out the entire site is a scam and I was out my $4000... period.
Lot of bad guys out there I will ALWAYS pay with a Credit Card moving forward.
Why didn’t the dealership file an insurance claim on the stolen bike is a question that would be interesting to know the answer to.

Ouch. I'll tap out and defer to the experts but the "case" is closed. That detective is not going to chase down your allegations when he just closed a case he has been working on for months. Do you have your own "case" filed against the seller that will be assigned its own detective?
I have a hard time believing Shawn spent $9500 in a day and a half, but an easy time believing that's what he wants you to think.

I think, as we’ve probably all found out at some point, once you make a claim, your rates go through the roof! I actually know of a local dealership that had 12 bikes stolen and couldn’t make a claim because it would’ve destroyed their insurance rates. What a terrible system
Thanks man. I did actually feel a small sense of hope after speaking with the detective. Vehicular theft is all that he deals with and really seemed to want to catch the original thief, starting with Shawn. After countless hours on hold trying to reach any other police department, he really is about the only hope I have when it comes to law enforcement and of course, suing Shawn and his business for the return of my money is next on the list. I’ve never sued anyone before, but I feel pretty justified on this one.
That could be, or there deductible is crazy high. What a raw deal for you. Hopefully they get to the bottom of it and are able to get you some of your money back.

He may be able to persuade Shawn that it would be advisable to find $9500 as opposed to prison as I mentioned.

Seems like anybody selling shit with fraudulent titles would be a high priority for a detective to get shut down.

Detective was working on the case for months but the exotic and conspicuous bike was on facebook marketplace 75 miles away from where it was stolen.
Someone tell him to check his pockets so he can find his missing keys.

I may have missed it, or no one has asked. If you had run the vin number, all things aside with the business. Would the bike come back as stolen? I am not judging because I am with you, in business for 21 years, feel safe dealing with him.
Is there a way for a consumer to "run a vin number"? (I don't know.)
I lost two CRF-450's and had considerable damage to my building. Based on deductibles and previous claims I decided to not file a claim in hopes that my premium would not go up the next year. Insurance in the motorcycle business isn't so great right now.
I’m sure this POS “spent the money” already. He knowingly sold you a bike he stole personally or a bike he himself was scammed. Either way, he’s a POS.
Seems like a good attorney could put the squeeze on the dealership. Might be half what the bike cost in legal fees but I’d be out for blood, mechanical lien something.

I'm not an attorney. If I look like an attorney or sound like an attorney, I apologize. (maybe you've heard the commercial). But I have been around the block a little. Here is my take and maybe you can find an avenue somewhere within. There is a criminal side to this and a civil side to this. It is totally awesome you bought this from a business that is and has been operating for all these years. That brings Consumer affairs into the party. The police can only do so much. They can not ensure the suspected guilty party is brought to justice if there was malice. They can arrest them, they can file charges, they can even convince you to relinquish a bike you paid for from a business with a title. But they can not assure the guilty party is brought to justice and you are awarded justice for the incident. If all you want is your money back, the fastest way is for you to contact the state attorney generals office. They are there for consumer protection (you) and they will use their power to protect a consumer at all costs over a business owner. If there is wrong doing, they will initiate and investigation and they will prosecute the suspected party. But the first thing they will do is have you put in writing what happened. They will contact the business with your request to refund the money. If they do not, they will have their license revoked by the end of the month. That is your quickest option. Police, even if the guy is guilty can not do that.
If for some reason that does not get your money back, then you need to hire an attorney file a civil lawsuit.
What did you do wrong? Honest question. The answer is nothing. You are a consumer that bought an item from a state licensed operating business. You were sold an item that was fraudulently represented through paperwork of the state. I assure you the state attorney general will get you your money back if that is all you wish to receive. Don't be shy, give em a call. What happens after that on the criminal side is up to the courts.
I would double down and file a lawsuit against Shawn. I would make it clear that you will pay either way, me or a lawyer, You choose.
This makes no sense. If you have a title and a signed bill of sale along with proof of texts or emails, the police will go arrest this guy for not only vehicle theft from the dealer, but also sale of stolen goods. Felony offense at that value. 100000% more to this story we do not know.
Holy crap there is a lot of information in this thread, but one GLARING thing missing (unless I just missed it). The ORIGINAL "theft" or "fraud" is the controlling matter in everything after that.
Unless I missed the specific details of the bike leaving the original dealer, it's absolutely crucial to how this got handled.
Was it straight theft? I don't think it was reported as such. It sounds to me like the original incident was probably attempted to be reported as theft, but ultimately changed to a civil matter. In that case, the titling process can get murky.
Did the OP get screwed? It sounds like it. But to me it also sounds like someone was trying to get out of a sketchy situation where they ended up with a bike that was part of a civil disagreement.
All that being said, it's absolutely possible LE just did what they had to do based on the information they were sold by whoever was trying to clean their hands of it.
You have to put handlebars, footpegs and the front wheel on. I am sure most on here are more confident doing it themselves than letting the work experience kid do it at a dealer.
