I can't believe you would even wait for two years. That is insane. Call a damn lawyer already.
Lawyers would cost more than finding another motor. I looked into it.
So essentially you're ok with someone stealing a motor from you? And if the you win the judgement, you know that Varner could be liable for...

He didn't say that - shouldn't put words in people's mouths. Totally wrong perspective.

Even if you get a judgement, there is no guarantee you will get your money.

But at the end of the day, you’ve spent 2 years of your life complaining about something instead of figuring out a solution and moving forward. Go get your motor, sue the guy, or chalk it up as a loss and move on. But good lord, you’re a damn fool if you think there’s any other option after 2 years.

In most countries, his shop would have already been cleaned up and burnt since a long time.

Go with a couple buddy with dogs, guns (just in case) and cameras (to cover yourself), have a serious talk about what customer gesture he can give for the 2 years lost and don't leave without your engine. With stupid people you have to play stupid to get anything.

This is a prime case of LIFO.

Last In First Out. Its used in accounting, specifically within inventory. The U.S. allows LIFO for their accounting practices yet IFRS does not. Funny, Americans.

I can understand that many people are saying just get on a plane and show up, but what the hell. People have lives. I wouldn't waste my time flying to California to look like a lunatic showing up at his shop. Maybe when I was 23 but not now.

That’s sort of what I’m thinking too. It only seems to happen to the occasional victim. Seems to me he likely robs a part for another build and waits for another core to come in to repair the next, and then that person becomes the next victim.

I dont think.people are saying let it go. Do something about it or take the loss. Posting numerous times on vital is not working. You said what you did. Let it go or go out there, get your shit back if it means that much to you.

My biggest upset with Varner is he hasn’t tried to improve at all. He’s contacted me on a few occasions commenting how this thread is really affecting him and wants me to take it down. So not only is he aware of the attention this thread has received, it doesn’t seem like an effort is being made to resolve any issues. When I was fighting with him to get my engines back, I contacted a few ‘big’ names in the industry that I knew could get in contact with him and see if they could help me out. I started doing this because Varner wasn’t answering the phone at all at this time and thankfully, one of them actually phoned him for me. He phoned me back and told me that he had got in contact with Varner and said Varner apparently was working on my stuff (which wasn’t true in the end) but he also made a interesting comment to me and said “I wish the best for Varner and wish he would get his act together a bit because he gets on these ‘runaways’ if you know what I mean”. Another ‘big industry name’ (my apologies I don’t want to say names and disrupt any relationships I have with these people), also mentioned that Varner had a family member, I believe his son, pass away years ago and has never really been the same since. I mean we could go on forever about everyone’s personal issues but at the end of the day I was hoping this amount of backlash would have made Varner do some serious re-evaluation on how he’s running his company. He does do good work and his engines (when they’re not on the shelf in his shop) do run really well but the company itself is pathetic. Taking money up front and promising the world, not answering the phone/returning calls, missing deadlines for months/years it’s a very bad experience to go through.

“Bitching” wasn’t the right choice of words and I’m sorry my post didn’t come across as much like advice as I had intended it to. I wasn’t trying to give you a hard time as much as point out the futility in your plan of attack. You’re not getting that motor back unless you go confront the guy about it. Even still, others are right. There’s a real good chance your motor parts belong to 7 other customers by now.

I own a construction company. Getting fucked out of large sums of money is a pill I’ve learned to swallow. I feel for you my friend. For me personally, throwing away the hope for a positive resolution, accepting the shit outcome, and forgetting about it entirely is the far less burdensome option.

This thread will never get your motor back, your work done...or your money back. Sorry, but but if Terry hasn't contacted you and offered a 100% reimbursement...you will NOT get your money or motor back. It will NOT get anybody's motors back, or their money back. But...I know what might.

Instead of coming here, where nobody can help...why not take Mr. Varner and Company to court, and sue his thieving ass for your money and more? If nothing else, the threat of him actually being sued might actually get him to pay you back what he owes you rather than to go through that.

Or, you can keep on adding pages to this thread...and get nothing back.

Just my 2-cents...

So he should spend $5k+ on a lawsuit, along with months of time....for a $1500 engine? Lawsuits aren't free, I think you fail to realize that.

I’m not at all unaware of the expenses of litigation...but if even half of the people here who claim they’ve been ripped them off came together and split the cost between them it might be worth it. I’ve seen it done in similar cases.

Actual small claims court costs in California.

The fee for filing in small claims court depends on the amount of the claim: $30 if the claim is for $1,500 or less, $50 if the claim is for more than $1,500 but less than or equal to $5,000, or $75 if the claim is for more than $5,000.

Cost of following through, airfare, lodging? Who knows. In these covid times it would probably be a zoom court and I believe the first step is mandatory mediation anyway. Maybe it would work.

I considered Varner. I went a different route fortunately. I’m sure many are like myself and, do some research before pulling the trigger and moving forward with a project. I believe many will see this thread, the horror stories and,
use someone else. Keeping the thread relevant may also inform newcomers to Vital and the sport, of the person they’re dealing with. The OP should change the title of this thread to, Varner Motorsport review/issues. A couple keyword changes and this thread will pop up in the Google recommendations of his potential customers.

I hate to say it, man...but if you haven't gotten any reimbursement, haven't gotten any word from Varner...and haven't taken his ass to court over it...I would say that if he's aware of this thread or anyone has told him about it...

..go out for a bucket list race, World vet, 2 stroke race or a National, stay for a week, rent a car, you will have some down time in between racing, contact the sheriff dept. tell them to meet you at Varners. Bring documentation that he has your engine, shipping invoices, emails etc. I may be out there next year for World Vet race again, I would gladly take a ride to Varners with you...
