Rules are rules, however in this case it appears the flagger made just as big of if not more than an error with his method of waving the flag and position to alert the riders than Dungey did by not seeing it and/or not honoring the flag.
In my opinion there's no way Dungey ignores that flag if he saw it.
After the AMA had a look at it you would think that they could have seen the issues and maybe made a warning kind of deal out of it. Yamaha or whomever protested, must have stuck to their guns with the protest, and they are fighting for a championship.
More than likely though it will just make things worse for them in the end as the gain went to riders that are more probable for them to catch in the series points at the end of the year.
Things happen fast up close, mistakes will always happen, but there is obvious room for improvement in the flagger department.
Bring on more trackside warning lights to help prevent situations like this in the future and for the overall safety of the riders and track workers.
It would be interesting to have been there and know how it all went down and who was saying what though.
any team should be interested in giving dungey a somewhat hard time, he has the fitness and the skills, so take away some momentum.
(obviously it should all be within the rules)
