They wouldn't. I'm sure this wasn't a snap decision by Kawi. They have good lawyers who undoubtably crossed the i's and dotted the t's before this move was made.

I'd think it's even more than performance based, given that there are a few indoor rounds left and he would in theory have time to be on the podium or grab a win if that's what's required.

Some contracts have a clause like "Either party can choose to leave this agreement at anytime". Not sure what DM18 is getting paid, but I'm guessing it is more than his current results warrant(not slamming the guy, just a general observation). It could be as simple as KMUS doesn't feel they are getting good ROI from DM and are moving on. May sound harsh to some, but pretty much how the rest of the world works.

Just speculating but I believe this is all about Davi's piss poor attItude. He's like a depressed snotty 15yo girl when he does an interview. So petty and sensitive. Mopy...etc. I also heard from someone inside the industry that Davi is very difficult to deal with. A former mechanic said he was lazy and used to take any excuse not to ride. Just like last summer when he was doing MTB races but was too hurt to ride but come to find out he just didnt like the bike. F Davi. Let someone who has passion get that factory ride

That is correct, in the legal world it is known as a "termination clause", and the language in a contract can be worded so that it happens basically at will.

No way it has to do with Eli. Kawasaki is a gigantic business. Just like any corporation or franchise they plan ahead. I'd bet every $ I own they have been planning for Tomac for at last a year now. You make it sound like Kawi all of a sudden was like gee wow that Tomac guy is pretty good. Crap too bad we signed Davi. It doesnt work like that that. Either Wilbur or Davi's deal was set to end in 2016 so they'd be able to sign ET3.

Having dealt with contract law for many years (without being a lawyer) it sounds like there could be a couple of scenarios:
1. The reason for termination relates to a clause that may require some interpretation
2. The reason for the termination may lack precedence or relate to some area of general law.
3. The settlement at the point of termination may require some interpretation

So Dave may has some avenue to challenge some part of the termination - at least he thinks so and is finding out.

The other thing is that it is actually far more professional and respectful for both parties not to publish "their side" and/or allegations while the parties are in dispute. Both have done this.

Maybe we will find out once the dispute is over. Until then toughen up kids.

Since he's kind of in the twilight years of a SX and MX career as you have it, we've probably seen the best of Davi, but not the last of Davi. At least I hope so, I'm sure giving a kidney for this sport (job really) and major major knee surgery, not to mention the broken femur, Davi's given alot, and won a SX Lites title. Since his days on mini Suzukis, till now, thanks DM.
