They are horrible to look at. But I’m glad they are not being hidden behind litigation (yet). I’m a dumbass desert rat and even I know that medic 101 is put someone on a backboard if there is even a hint of a cunt hair of a chance that there may be an injury to the neck or back.

Those pictures are hard to look at knowing the extent of Brian’s injuries.

If he actually communicated any hint of a spinal injury, then those pictures absolutely prove negligence, in my opinion. It will be incredibly hard to argue otherwise. If that was my kid in that situation, I'd be absolutely livid, and I'd pursue legal action as well. To make sure that NEVER happens again. I don't know Bodnar or any of the other Alpinestars Med crew, and I'm sure they are there for the right reasons. Doesn't mean they are infallible, though. This looks really really bad...

Release or no release, I'm pretty sure medics have certain protocols to follow when they suspect a neck or back injury. I'm not a medic, but this doesn't look like proper care to me.

I think we can all agree on the sport being dangerous and it probably in the back of most riders minds at some point or other, but I don't think a connection should be made that just because it's dangerous and that waivers are signed, the possibility of negligence from any party should be accepted. There are standards set by any sporting body, it's why there jobs like flagging, or scrutineers going over riders bikes, to mitigate the risk. There would also be standards for medical personal on how to treat a suspected spinal injury and if this is the...

Can't sign away gross negligence, as is alleged in suit. Waiver won't factor, except back when determining grounds.

The lawsuit centers on Moreau's care from the Alpinestars mobile medical unit at the 2020 Tampa supercross. Basically, the lawsuit alleges that Feld is vicariously liable for the Alpinestars Mobile Medical unit's and various other employees' actions. Allegedly, Bodnar and a track worker lifted Moreau up by his armpits after he complained of tingling indicative of a spinal chord injury, put him upright in a mule without a cervical neck collar, pulled his helmet off in a way that wasn't in line with existing procedures, and a myriad of other similar allegations about poor procedures and lack of due care...

“collective negligence, gross negligence, and or reckless disregard for the life, health, safety and well being of plaintiff” This case seems pretty easy to prove they did not act accordingly to the above. Whether or not you think moto is dangerous is moot or if they 100% made him paraplegic isn’t quite the case. they only have to prove the above. Paramedics have to abide by protocols and standing orders that tell you what to do in a given situation. There’s a TON and you better know them all or there can be legal issues you’ll have to deal with...

I hope he wins it . Medics were seriously in the wrong with what they did . they are trained professionals and need to act as such. Maybe a good wake up call . As there was some other very weird calls by them the last couple of years ., Wilson crash this year , not red flaging that race was wrong .

My last post got deleted let's see how this one goes Edit: No it didn't but I just did myself as this one is less snarky So cause he's got a nice car means he doesn't deserve compensation? The pictures of him being dragged off the track and sat in a mule during PRACTICE looked pretty fucken bad

If he was treated right by the medics I d agree. But;the medics fucked up big time . And anyone saying otherwise is pure bull . People saying it wasn't the best , It could nt of been much worse if you tryed.

So Deathcross. If the way he was handled DID have an effect on his paralysis do you still think the lawsuit is shit?

Yes, racing mx or sx is dangerous. But if his injuries are due to action of others after his crash, well that's a different story. Afterall in this case it's a profession sport with what should be professional support workers.

90% of the time I would agree with you. And how they handled him probably didn't affect the injury already sustained. But...right when I saw that I thought lawsuit. That was unreal the way the drug him off and I agree with a lawsuit in this situation. I've never seen such neglect of an obvious spinal injury.

His Instagram is such a depressing place. Constantly posting pics/videos of himself riding from 2-3 years ago before his injury as if they are recent with occasional new pics of him talking about how depressed he is. I hope he’s getting the mental health help he needs.

Remember, this was the kid that the medical crew drug off of the track, before fully realizing the extent of his injuries. Even ML's instagram post mentioned how hard it was to see the sequence of photos, and that they could do better. Implied risk goes with many high speed, and graviry sports. As a former DH racer, and Skydiver I'm well aware of the risks. That's a given. Mishandling the medical care is not.

Especially since he was 1) alert and reportedly arguing against being moved and 2) not impeding the competition (it was practice). The fact that no red flag was initiated in the practice session at all is going to be difficult to defend from an event safety standpoint
