When you throw in stupid shit like that, it makes people question the rest of what you say, even if it’s true.

Noting generally that prosecutors have discretion whether to file charges, don't usually do unless they feel they have a strong case (they hate losing), and the victim more often than not does not have a lot of influence in the decision unless it is a politically sympathetic party who will get a lot of press before the larger public (beyond our little community) and the prosecutor would look bad not pursuing the matter.
Also conviction in a criminal case requires proof beyond a reasonable doubt, which is a much higher standard than the burden of proof in a civil case (which is why OJ won his criminal case and lost his civil case).

Might sound like a dumb question. but couldn't he go back to Australia and avoid all this? I know he was out of the country during the last mxgp season with the Coenen brothers after the Lawrence had file the original complaint.
Fleeing the country whilst having federal charges against you, to another country that has an extradition treaty with the first country probably isn't the smartest move.
Innocent until proven guilty yes, but let's be real. Buddy fucked up, and needs to sack up and face the music.
As someone else mentioned, having a civil suit is one thing, very he said she said. But federal charges, they don't do that unless there's a substantial amount of evidence and a pretty damn good chance they will win.

Also note that this is a federal case, which have an insanely high conviction rate. Fed prosecutors seldom charge without a slam dunk case.
