My thoughts exactly. At the very least the OP should change the thread title...

It has been quite some time since I have visited this site, much less posted anything; however, when I am directed here based upon comments from people in the real world about defamatory posts related to Mitchell, then I am forced to respond.

While some would say that any news is good news, that isn't the case when people are intentionally defaming one's reputation based upon wholly false facts. You have labeled Mitchell a cheater, intentionally and/or recklessly, for whatever unknown reason, without having any idea what the true facts may or may not be. An honest discussion of the circumstances is one thing, but this has crossed the line.

In doing so, you have not only exposed yourself to liability, but this forum, as well as several other forum participants who chose to blindly follow you.

I highly suggest that everyone involved immediately issue a retraction of their defamatory comments.

Respectfully,

Brian D. Harrison, Esq.

Hello Mr. Harrison,

While the OP re-posted the video here, he was going off of what the video had said. To me the blame would more so be on whoever posted the video(JMC?). for posting the video with those allegations. Until Justin Starling came on here and cleared things up it really looked like that is what happened, although it doesn't sound like something most guys out there would do. I'm sorry that Mitchell was accused of cheating, but again, whoever posted the video in the first place.

Good luck to Mitchell this weekend! Hope to see him in the main again.

Since you brought it up as a threat, I think posters / GuyB and those at the forum who don't know should see what the elements are to prove defamation in California:

LOL.

"In addition, [name of plaintiff] must prove by clear and convincing evidence that [name of defendant] knew the statement(s) [was/were] false or had serious doubts about the truth of the statement(s)"

A guy throwing around legal threats on a friendly forum should at least be carrying some sort of stick to back it up, not this weak-ass non-case.

I'm glad you got the point I was trying to make. I work in the legal field too, but I can't give legal advice until I'm out of law school so I figured I'd throw that out there so people could make their own decision.

If you took the time to read the thread, your Son was pretty much absolved of any culpability for any wrongdoing. He was doing fine . . . until Dad showed up. You just made life worse for him.

This went from a possible serious problem, to a wannabe police trying to report it, to a misunderstanding, and now legal threats! This is silly, I love this place!
