Anyhow while I do think he ultimately screwed up, I don’t want to see him retire in a way like this. Like many, I also think the time this decision is taking is a little ridiculous. I’m assuming it’s the fact of the FIM and WADA disagreeing that is taking so long.. but who knows.
And No, I don’t think anyone on WADA will see this, nor would it sway their decision.

Being his TUE has now been approved (and according to TWMX it is rare to have one approved after a failed test), I would say its pretty obvious to all involved it wasn't an attempt to cheat. There will always be a few members who will say or imply he was without knowing the details of the case, and most are very predictable.
But AMA Supercross, a subsidiary of the FIM, ruled over the Monster Energy Cup and thus his entry was denied by the suspension, despite a recent approval of his TUE by WADA. The approval of the TUE by WADA after the fact is a matter in itself, as it is somewhat rare for the board to approve a post-test application. However, instances like an acute medical condition make it possible to attain a late approval.

Doping - Decision of the Court of Arbitration for Sport
in the case of rider Anthony West
The FIM has taken note of the Award handed down on 22 November 2013 by the Court of Arbitration for
Sport (CAS) in the case of rider Anthony West, participant in the 2012 FIM Road Racing World
Championship Grand Prix in the Moto2 Class.
On 20 May 2012, Anthony West underwent an anti-doping test conducted by the FIM at the 2012 French
Grand Prix. The urine sample obtained from Mr West revealed the presence of a stimulant
(Methylhexaneamine) prohibited in competition under the FIM Anti-doping Code in force.
Following a decision of 29 October 2012 handed down by the FIM International Disciplinary Court (CDI) to
suspend Mr West for one month, the World Anti-Doping Agency (WADA) appealed to the CAS and called for
a 24 month period of ineligibility to be imposed on Mr West.
The case was referred to a three-man CAS Panel. A hearing was held on 21 August 2013 in Lausanne and
the parties were heard. The FIM was represented by the Head of its Legal Department, Mr Richard Perret.
The appeal by WADA against the CDI’s decision was only partially upheld. The Panel suspended Anthony
West for 18 months from which the one month’s suspension already served was deducted.
Taking into account the considerable delay in the conduct of the case before the Court of Arbitration for
Sport, the CAS Panel decided to set the start of the suspension retroactively at 20 May 2012.
Subject to the lodging of any appeal by one of the parties within 30 days with the Swiss Federal Tribunal
and as provided for in the CAS Award, all the sporting results obtained by Anthony West from 20 May 2012
up to the expiry of the period of ineligibility (i.e. 19 October 2013) will be invalidated. The FIM will
therefore modify the rankings of the 2012 and 2013 FIM Road Racing World Championships Grand Prix,
Moto2 Class, accordingly. The FIM will also modify the rankings of the 2012 FIM Endurance Road Racing
World Cup.

The timeline here shows a failed drug test on May 20 2012, and FIM penalty decision on October 29 2012. 5 months for a decision. So in comparison to that failed drug test the FIM are dragging their feet here (8 months now). James' original PR from the FIM says James has the right to request the testing of his B sample, TWMX says that happened so that could have added to the delay? In Anthony West's case it took WADA a further 10 months to appeal the FIM's decision and have the ban lengthened. Anthony West was allowed to compete again after his FIM ban was up, but then had his points taken away subsequently.
IF James' case went the same way as this one, we should see an FIM verdict any moment with a short ban/fine. That would see James racing all or most of the SX season. However if WADA appealed that for being too lenient, it could be October before that case was heard. Meaning he could in theory win both the SX and Outdoor championships, only to have both taken away in October by the Court of Arbitration for Sport.
I would imagine they'd be a bit more lenient here as there were no mentions of TUEs or ADD in the West case..
I'm shipping one to a guy in Sweden at my cost.. I just think how crazy it is that there are so many international fans that follow our sport so closely. I love it. We're pretty lucky to have the series and talent we have in the US... Even though we find things to still complain about!
