Here is the issue. It's not really about Adderall being a banned substance, it's about getting the exemption or not. How can you say "he's a cheater" when what he took is allowed as long as you have a "doctors note"??? It's about following procedure and it looks like the ball may have been dropped in the process. Neither James or Suz is trying to hide the fact that James was taking something to treat a condition.

Jeremy Mayfield was using methamphetamine, not Adderall. A.J. Allmendinger tested positive for Adderall a couple of years ago and was suspended from NASCAR for a while. He is now back racing in NASCAR's top series. He qualified 2nd and led 35 laps in last week's Sonoma race. Obviously NASCAR didn't think Adderall was a huge deal. Previously, no one who failed a NASCAR drug test ever raced in that series again. Not only do they test the drivers, but they test the crews as well.

JS results can be stripped from him all the way back to the testing, so if he does race this weekend it may not matter.

I agree it was such a dumb move by JS not to have the TUE. Hate for his career to end this way but it is what it is.

No he's not wrong. Look up the case of Anthony West I think in moto2. FIM banned him for 1 month. WADA took the case to CAS and got it extended to 18 months with all his points and prizes won since taken away.

We do not give any outsiders any authority outside of testing, they act as a foundation in the rules and the test results and give advice and opinions on what they think should be a suitable punishment, however our sanctioning bodies Feld/Fim, Promxsports and Dmg still determine who and when the individual in quetsion gets penalized and for how long.

You totally missed the point...not suprisingly. Point was, there are so many here that are out for blood and want Stewart to pay the price (whatever it is) to the very letter of the law. They don't want to hear anything else...their posts are almost ridiculously scripted. I realize that haters are gonna hate...but if the guilty party was RV, RD, Roczen, Reed or anybody else...would you still feel this way?

Can you provide a quote for that? I haven't read anywhere that James or any of his representatives asked for the sample to be tested. Maybe WADA is testing it and if so I believe that the accused has the right to be present when that is done, but that doesn't mean that the accused requested it.

Maybe I've totally missed the boat, but......

Has anyone "officially", "credibly", said what he was busted for? The reports I've seen say amphetamines. So, everyone has assumed that means adderall. Is there any proof that adderall was what he was busted for? So many people on here claim that JS is the reason MX exists today, or at least something closely related. So, if he were busted for crack cocaine, would you all still say, "oh, crack couldn't possibly improve his performance on a motorcycle. If anything he's got to be a worse rider from it so we should just give him a pass and let him go?"

What if it is adderall but the rider was Jimmy Albertson, or hey, how about Vince Freise or Mike Alessi? If it were those guys, would you just string them up?

The moto community clamored for drug testing as a whole. Way back to the RC days, people have been making accusations about drug use, PEDs, EPO, whatever. Now that the poster child for SX is on the hot seat, they want out.

Rules are rules. The rules say no multi-cylinder engines. That probably has no bearing on who wins, but we stick to them. I'm bumfuzzled at why people can't understand that there is a price to pay when breaking the rules.

I'm also bumfuzzled why the FIM didn't just revoke his AMA license. Maybe they will when the lawsuits are settled. That would put a stop to who's got the power and why do they get to say what. The FIM is the parent organization to the AMA. They can cause the AMA to pull his license. No one without a license gets to race a SX or MX National.

AJ's adderall use was a HUGE DEAL to Nascar and to AJ. He tested positive for amphetamines.
Just like everyone else in his situation, HE "claimed" it was adderall.
He lost his contract driving the #22 for Penske racing and was suspended for 3 months while he attended a mandatory "Road to Recovery" rehab program. He was lucky to return to racing when a lower tier team agreed to sign him as their driver.
Even though he's driving, he's worse off now than he was before failing the drug test.

When you are involved in a situation like this, releasing records that help your case, to the public, is a confrontational move. You are essentially trying to go over the head of WADA and the FIM. That is only going to piss them off, and make things worse.

The reason we are not hearing anything from James camp is it would only make things worse for them. If we do start hearing things, that is actually a bad sign, a sign of desperation. At this point, James certainly has people advising him (legal and PR specialists in situations like this) on the way to handle it. Releasing data to the public would be suicide.

Dozens of people's liveliehood depended on James. Millions of dollars in sponsor money was invested in James. That is all at risk now because of what James did. He let them down. If James was not trying to gain an advantage (cheating) then how can he not have been irresponsible and stupid for letting this happen? There is no in between. Either he cheated, or he was irresponsible and stupid for not understanding the procedural aspects of the rules and regulations of his sport. One or the other.

I do not believe he tried to gain an advantage. I do believe he is not the most sophisticated person, hence my conclusion. As facts become available, I might shift my view from him being irresponsible and stupid, to being a cheater. Is that better?

All that James has brought the sport, all that he had done, all the accomplishments mean nothing. Sorry, but that is the way it is. I did not make it that way. That is just the way it is. So grow up.

Your logic is analogous like arguing that a criminal should be let off the hook because he waited till he was 25 to commit a crime, but before that he was a model citizen. Again, grow up you simple child and get over your fan boy adulation of James. He is a man..yes..and he screwed up. The only thing that remains is to determine exactly how he screwed up, and how damaging the punishment will be.

After this is all said and done, I would bet that James mans up and acknowledges he was a fool, irresponsible, and stupid for not taking the time to understand the details and procedural aspects of modern drug control regulations in sport.

Mayfield tested for Methamphetamine, not amphetamine, as I recall. He also went belligerent and legal on NASCAR. This is why you play by the rules when in this position. Get nasty, and they will bury you.

This is also why James can not release data to the public, as some people suggest he should do. That would essentially be trying to go over WADA's / the FIM's head and appeal to public sentiment. If James was not trying to gain an advantage (cheating) then how can he not have been irresponsible and stupid for letting this happen? There is no in between. Either he cheated, or he was irresponsible and stupid for not understanding the procedural aspects of the rules and regulations of his sport. One or the other.

I do not believe he tried to gain an advantage. I do believe he is not the most sophisticated person, hence my conclusion. As facts become available, I might shift my view from him being irresponsible and stupid, to being a cheater. Is that better?

All that James has brought the sport, all that he had done, all the accomplishments mean nothing. Sorry, but that is the way it is. I did not make it that way. That is just the way it is. So grow up.

Your logic is analogous like arguing that a criminal should be let off the hook because he waited till he was 25 to commit a crime, but before that he was a model citizen. Again, grow up you simple child and get over your fan boy adulation of James. He is a man..yes..and he screwed up. The only thing that remains is to determine exactly how he screwed up, and how damaging the punishment will be.

After this is all said and done, I would bet that James mans up and acknowledges he was a fool, irresponsible, and stupid for not taking the time to understand the details and procedural aspects of modern drug control regulations in sport.
I think you are jumping the gun by saying:

That has not been determined yet. IF he has a death sentence (which I don't think will happen) it won't take away the innovation and style he brought to the sport.

I just don't see this as a Lance Armstrong situation. You do.
