Those statutes do not protect the land owner from injuries caused by gross negligence, and the only way to determine if the landowner was simply negligent or grossly negligent is through the courts.

Virtually every lawsuit involving an injured rider and a track/facility owner involves allegations of gross negligence and/or willful conduct. It is how they get around the liability waivers. Same song and dance from him on basically every thread about running a track for the last year or so. Every track should be $10 to enter, perfectly groomed, and a national level facility/amenities. If it’s not that, the track owner is operating off pure greed and we’re a bunch of idiots for going along with it.

Not a fan of flat, man made tracks with no natural terrain being part of the Nats. Looks bad on tv too, imo. Just a barren piece of land with no green. At least Glen Helen has some elevation.

6/1/2026 2:10pm I don't know anyone who stopped riding mx as a result of track layouts. Regardless, my point was that owners should not face civil liability as a result of track layout. That lawsuit brought by the EKS guy was referenced and that was bs that led to the closure of that track if I'm not mistaken.
