Also when it comes to a BK, for legal reasons, some lawyers tell you to STFU and do or say nothing to anyone, because you can't promise anything or make deals with anyone, that is handled by the trustee and/or system to avoid preferential treatment.

Consider it might not be that someone doesn't want or isn't trying to inform people/customers, it's that they're not allowed.

Bummer for Jesse and I am sure in the long run all will work out for the best, bummed for anyone stuck in the middle and I hope that gets worked out quickly.
If I was one of those stuck in the middle, I would be on the phone constantly with the trustee in regards to your personal property as well as getting listed as a creditor if you paid money and didn't get it due to the situation.
The trustee works for the BK court/judge, not the person filing BK, it's their job to try and satisfy all the creditors

man....I just read through this thread....and what a tough pill to swallow. Jessy Williams......is this the same Jessy Williams that used to race 125 and 250 INt back about 10 years ago down at Albany SX , washougal and so forth? If it is , I used to race against him. Good dude....I hope he gets things turned around.

From my experience with him this is definitely out of character. Times are tough on a lot of people and a lot of businesses right now and i only imagine them getting worst. With these events as you guys describe something definitely seems to be wrong. I hope the best for Jesse as I do everyone on the board and whether it is a business issue or a health issue or something other I hope he recovers with his mind, body, health and livelihood in order. He is not a shyster or a fly by night and I know he has gone out of his way to help people on the board with knowledgeable information and even discounted work. Jesse is someone I would and have recommended to many people, on this board and other.

As for the people with the issue, I am confident that you are a victim of circumstance rather than a victim of mischief. For some it sounds like it couldn't be a worst time to be without. That would have to beyond suck and I really feel for you. I hope you are able to have a resolve to your situation.

Just as anyone here I can only speculate on what the problem may be but lets assume my intuition led me to believe it was a foreclosure issue as those seem to be common theme these days. Lets also assume I was one of the people that have been left short and this was my speculation. This is what I'd do. Google the local newspaper in his area and search the foreclosure and bankruptcies and see if you can find any definite information. Call the local courthouse and see if there has been a filing. I mention the newspaper for a couple of reasons. When a property is foreclosed, the owner is not allowed on the property nor take any contents. This is usually followed by an add in the paper stating the property has been foreclosed and that all items inside such property is going to be auctioned on such and such date. It will also state that if you have a claim to anything inside the premises that you have such and such date to claim it. If that date passes, all you can do is stand in line and bid. So if that is the issue, you guys better be finding out. Find out if that is the situation, if it has been posted, what is the date for claiming items and last resort, date of auction if that it comes to that. If there was a bankruptcy, then my first action, along with the contacts given in the paper, would be to contact the attorney general for that state and have it on record the date of your request of attaining your property. Again, I am only speculating but trying to forward useful advice.

What kind of foreclosure? Real property? Inventory? Maybe storage units . . .

Debtors generally are entitled to recover their personal property not securing a loan when the foreclosure is on real property, and a creditor doesn't have a security interest in property of others handed over to the debtor for service.

Hope Jesse is doing well and gets it sorted out for his customers.
They kinda do in WV and the procedure they use pretty much resembles what I mentioned above. I'm not saying every circumstance but you must consider. Most businesses that own real property in which they are operating also run a line of credit that is linked to, or secured the same. Most line of credits would be for operating expenses which would include anything from materials or inventory to desks and chairs and often get mixed into finance with equipment. Its hard to tell from the 1000's of scenarios but most likely you have a business entity that operates out of real estate that is personally owned and personally secured by the owner or officer of the entity. Once you have finances tied in with one another, personal real estate, business line of credit, machinery all personally secured by an officer of the entity, there really is no such thing as personal property once the dominoes start falling and the process is put in motion. Doors are locked and the debtor is considered trespassing or stealing from there on out and the entity of the company, Corp, LLC ect. really doesn't matter for shit. As far as the consumer, the creditors don't go through the debtor's books and see whose is what. They make a public an announcement and put a time line on claiming it.

I guess he is trying to make it back up with me. Charging me $980.00 for service work and then keeping my engine that's worth another $1500.00 after lying to me and telling me it's done and shipped out. Looks like I will be flying over there to personally retrieve my stuff. The $400.00 round trip is still cheaper than the cost to replace my stolen motor.

This is one of those threads you read and hope there's a happy ending, but it just keeps getting worse. I hope everyone gets what's there's back and Jesse gets shit straightened out. I don't even want to think of how I would be acting if I was the one staring at a bike with now motor and not knowing where that motor is. Good luck to you guys!

The scary thing is, I was looking around for him on here to see what he would charge for a full engine & transmission mod on a 2011 KX250F engine. I am happy I never made it that far.

Well I got no response from the e-mail I sent yesterday or monday. Gonna contact my lawyer and have him look into it. I would give him another week or two but with some of the info that has been posted I don't wanna take any chances. It sucks.

I worked in a shop where the bank did storm in an seize everything and kick us all out, saying "you have 5 minutes to get your stuff, and if you do not take it now, you may never see it again"
The store was locked and the inventory sat there for weeks and weeks.
I lost a couple weeks pay and commission.

So, yes, a creditor can come in and lock the place down in order to protect their interests.

I saw it with my own eyes.

It depends on the specific laws of the state. Some can take up to 120 days to legally do so. Happens here where people rent/buy don't pay, rip all the toilets, and such out to sell and trash the place before the 120 days.

The linked pleaded doesn't read at all like a commercial lined secured by inventory and receivables, where you'd have the sheriff there and jump on folks to control the security before the debtor hides it all.

I agree that no one here knows the facts, which is why people shouldn't assume Jesse coulda/shouda done this or that.

It is what it is, and that is a shitty situation for everyone.

No bankruptcy yet, at least not as of yesterday. The trustee listed is the trustee for the lender that is carrying out the foreclosure, not a bankruptcy trustee.

For those trying to recover items from the property, try going directly through the bank instead of the bank's attorney. Just keep working the phones until you find the bank's special assets/workout department and the individual assigned to the particular foreclosure. The banks I deal with are very good about working with people to recover their personal property in these situations.

I wouldn't want to be in a situation of trying to "prove" that an engine was mine, I gotta say I've never made note of the engine serial number on any of my stuff that was sent out.

Here's, very roughly, what the "trustee" is in that filing. And brief intro into how our economy went to hell.

People were throwing money at people on crazy terms in order to originate loans that could be sold and packaged into securities. The instruments are complicated and set our various interests/tranches reflected by rights to payments depending on the quality and nature of the various loans compiled into the security. The security ~ bond/trust/CDO ~ what have you is represented by the trustee, an entity that can act on behalf of the security.

Putting that all together was where the big money was and why people didn't really care about the quality of the loans they were originating through twits like Rich Cain and Premix. At least until property values stopped increasing and people could no longer refi out of crappy loans when the initial terms passed.

The trustee in that setting is completely separate from a bankruptcy trustee, whether a US Trustee or a trustee appointed in a business bankruptcy.

When the loan defaults, it's the trustee that turns to the servicer (which may or may not be a division of the originating lender) and directs the foreclosure. In some cases there may be a buy-back as well .

If all that sounds confusing, it is, and that confusion as much as anything is what locked up the credit markets in 08.

Not in residential they dont. Again the loan is on the property NOT the contents. You must be served first so if the shop you worked for had notice...unless that was in the stone age when you were a teenager ...LOL

From what I heard, his shop was in the garage and basement.

I don't think you are correct about access once foreclosure starts. Every time I've seen a property foreclosed on, the people have to leave and the locks are changed. Usually, they do have time to get things together, but I don't know how long.

Your best bet is to contact the Williams' lawyer, if you can get that information, and see what the deal is.

X2 I pretty much experienced the exact same. I mentioned the newspaper because in my state they publicly post it that you have such and such date to present a claim. The lender's attorneys make the newspaper post. You guys have the attorney and the lender's information from a post on the last page. I'd suggest calling them. I've seen many people at auctions bidding on their own stuff and this is why.

I've said my peace and I've given my advice. Advice that might only pertain to my state but advice derived from my experience. I feel for my moto brothers on both sides. Out of respect for someone that has been good to me, I will not comment anymore. Good luck and best wishes to all in an unfortunate situation.

I don't think you are correct about access once foreclosure starts. Every time I've seen a property foreclosed on, the people have to leave and the locks are changed. Usually, they do have time to get things together, but I don't know how long.

Your best bet is to contact the Williams' lawyer, if you can get that information, and see what the deal is.
The lender has to file a foreclosure action, which the court record linked, and then there is a fairly significant time before there's a judgment that allows a foreclosure sale, and then even longer until the sale. It's a longer time now with all the controversy going on in foreclosure states given the volume of them and some issues with documentation. Debtors don't lose possession of the home immediately when the action is filed.

People are relaying a lot of different situations without making the proper distinctions, and I personally don't think it helps to elevate the confusion. The most helpful thing would be for someone to get hooked up with Jesse and start arranging to get parts back.

Got a hold of my lawyer and gave him all the info and he's gonna look into everything. Didn't want to but i ordered an 09 head with valves, cam and ported for 1100 bucks from whiteknucklemx . Told them my problem and when I need it buy and they said they'll try and get it out to me by the end of next week.
