Lost Global Entry? A New Federal Lawsuit Points to ICE Facial Recognition

January 31,

Global Entry and TSA PreCheck are designed to flag risk at domestic airports and U.S. borders – not during political protests miles from the nearest checkpoint. But new court filings and reporting by The New York Times suggest trusted traveler status may now be intersecting with federal surveillance in unexpected ways.

U.S. Immigration and Customs Enforcement (ICE) is using facial recognition technology to identify people during immigration enforcement operations and protests. And in at least one documented case, that encounter was followed just days later by the revocation of Global Entry and TSA PreCheck privileges – even though no arrest or criminal charge occurred.

The case, now part of a federal lawsuit, raises serious questions about how trusted traveler programs are being administered, and how easily the benefits that many frequent travelers rely on can disappear far from any airport or border crossing.

The most detailed account comes from Nicole Cleland, a longtime Global Entry member whose sworn declaration – first highlighted by View from the Wing – is now part of a federal lawsuit against the Department of Homeland Security.

The encounter took place amid heightened immigration enforcement activity in the Minneapolis area, where ICE agents were conducting operations that drew public attention and protests.

According to the court filing, Cleland was engaged in legal observation of ICE activity in her hometown of Richfield, Minnesota, when a Border Patrol agent stopped, approached her vehicle, and addressed her by name – despite the two never having met before.

Cleland says the agent told her he had used facial recognition to identify her and warned that she was “impeding” federal operations. He told her she could be arrested if it happened again, though Cleland was not detained, arrested, or charged with any offense.

Three days later, she received an email from the Department of Homeland Security (DHS) informing her that her Global Entry and TSA PreCheck privileges had been revoked. The notice did not provide a specific explanation, stating only that DHS cannot always disclose why a traveler’s status has changed.

Cleland had been a Global Entry member since 2014 without incident. In her declaration, she says the timing led her to believe the revocation was in retaliation for her observing ICE activity, and that the encounter caused her to stop participating in legal observation out of fear of further consequences.

ICE’s Expanding Use of Facial Recognition

Reporting by The New York Times detailed ICE’s use of facial recognition technology during immigration enforcement operations and protests, including activity in the Minneapolis area.

The technology at the center of the case is known as Mobile Fortify, a smartphone app used by ICE and Customs and Border Protection that allows agents to scan faces and collect “contactless” fingerprints, and then instantly retrieve biographical information from federal databases.

The Times confirmed that ICE agents have been using Mobile Fortify during immigration enforcement operations and protests, and verified photos and videos showing agents scanning people’s faces with smartphones and telling individuals they were being recorded using facial recognition technology, without consent.

According to current and former Department of Homeland Security officials cited by the Times, facial recognition is only one part of a broader surveillance toolkit that also includes license plate readers, social media monitoring, cellphone location data, drones, and data-analysis systems.

ICE has declined to provide details on how or when these tools are deployed, describing Mobile Fortify only as a lawful law enforcement tool used nationwide.

Why This Matters for Global Entry and TSA PreCheck

For frequent travelers, the issue isn’t just facial recognition alone; it’s how surveillance data can feed directly into Global Entry’s discretionary rules.

According to Customs and Border Protection’s official Global Entry FAQ, membership in the program is voluntary and subject to continuous vetting. CBP can revoke Global Entry or TSA PreCheck at any time if a traveler is deemed no longer eligible. A criminal conviction is not required, but being under investigation by any law enforcement agency can be grounds for termination from the program.

I'm (at least slightly) less concerned about a private business using that sort of info and data within the confines of their establishment.  I'm much more concerned about walking down the street and watching a protest then finding out that my ability to travel freely has been curtailed by Govco because they don't like what they presume to be my political beliefs.  I don't think that should apply to anyone without due process.  Not people protesting ICE, not the protesters at the Capitol on Jan 6th, not the 'Unite the Right' folks in Charlottesville a few years back, etc.

Be nice to them, they may be picking the crops you eat in a couple years, unless you commit some trivial crime that puts you right alongside them.

You should also be nice to them because they are actually fighting for other humans rights. Most here will just bow down and accept our fate.

This fkn shit right here ^^^^^ is exactly why we can't go to Monster trucks for a 3rd year since 2023. Because of all the moron liberal "protests" every single year. And this year is much worse. Now they go around harassing and attacking innocent bystanders to bully and intimidate them to be on "their side" against ICE. These people need insane asylums NOW. They are literally doing all the fascist and Nazi things that they claim the republicans and ICE are doing...you can't make this stuff up.

It all goes into a database. To me, it’s all the same regardless of the location.

I’m at work so, I don’t have time to get busted by ICE at a protest. Do I think it’s right? Yes and, no. But, as I mentioned it’s a very slippery slope

This cuts both ways. She was willing to be arrested for the cause. That was the point. She didn't break all the windows on the bus and then claim it was just peaceful protesting and have her supporters blow whistles and jump on the police to try to prevent her arrest after she did it. Her approach was focused, rational, left very little room for criticism, and came with a willingness to make personal sacrifice for her beliefs. She was more concerned about results than virtue signaling.

No, it doesn't 'cut both ways' in response to nrosso's screed.  She willfully violated the law, and in doing so was doing her part to fight for human rights.  The law is not always just, and breaking it does automatically negate the possibility of fighting for human rights.

Breaking a specific law that you believe is unjust as an act of protesting that law is not in the same category as breaking any law you feel like breaking in the name of some perceived human rights violation that is completely detached from the laws being broken. It's pretty clear which category he's talking about and I know you're smart enough to see the distinction if you want to.

What if  the Biden admin had done this to anybody that went to the Trump stop the steel protests?

I would say the same thing I am saying about this. That its a screwed up way of infringing on a person's right to protest.

Its legal to film police , I have yet to have anybody point out some law that restricts people from filming ICE. If somebody is just filming from a distance while inside a parked vehicle, I do not see how this is obstructing ICE from doing whatever they are doing. Other than they may have to think twice about if they are doing it the way they  are supposed to be. Since there would be video of them.  They are masked and most do not wear a uniform, so identifying them from video would likely be difficult by even ICE themselves nevermind the general public.

Trump has accused Democrats of many things, what next? Label them all as domestic terrorist and the DNC as a terra organization ?  Sounds pretty crazy and way out there right? So did many of the things that are happening right now  before they became an everyday thing! Do I think that would really happen? NO. But I  also did not think that a lot of what has happened would happen.

Consolidating both responses.

In regard to Walmart. That’s just what loss prevention has as of 4 years ago. Imagine DHS or, any other agency and, what they have access to today.

Regarding the protests, don’t be an agitator. You can protest without being a criminal. Don’t give ICE a reason to approach you. If things go sideways and, property starts getting damaged or, law enforcement is getting assaulted then leave. By sticking around that person is guilty by association. They’re not going to waste their time wanting to hear a persons side of the story. They’ll use stingray, get everyone’s info through their cell phones and, if you are caught under that umbrella, well that person is fucked.

I think people should have a right to protest. I do think this is a very slippery slope. However, people also have a responsibility, to ensure they’re not caught up in it knowing the extent of surveillance being used. They also have a responsibility to not be an agitator. Huge difference between peaceful protest and, fucking the city up or, harassing average citizens.

I do see Antifa being named a domestic terrorist group in the near future.

Yes very impressive. I was just surprised at how closely they worked with the Federal and local law enforcement.

I've always been into taking photos and video and some of the places I buy stuff have a lot of security style stuff like hidden cameras and its wild the stuff available to the general public. My brother was in the Air force and in the division that tested stuff. He was telling me that they are always 3 generations ahead of anything they allow the public to know about. SO I can imagine how wild some stuff is that they have. They just don't use it on small stuff so people don't know about it.

I took the exit for the NSA headquarters one time by mistake while on my way to Budds Creek with my 5th wheel that was between wraps and was a giant white box at the time.

I was following signs for a Sunoco that lead me right into the parking lot. This was back before smartphones, in the flip phone era. I  had messages and photos removed from my phone and was followed by an SUV and Helicopter until I was a half-hour or so away.  I took a photo of the plane they had beside a tank in the parking area and the helicopter that was following me and tried sending them to my mother to show my Dad.

I got a message that said " This feature is not available at this geographic location and the text and photos were gone after I read the message.

I know how much info social media shares with business that have pages so I can only imagine what they collect overall and what the government has the ability to do without anybody knowing.

Its kinda funny how some branches of Government are stuck in  the 60s tech wise and others are beyond the Jetsons and Startrek.

No you’re right, this is messed up. I don’t care which side you’re on. It used to be understood that freedom comes with a cost but those costs are small in comparison to losing freedoms. Same applies with gun ownership.

I question both sides. Right. Left. I find many things I disagree with. Though I tend to post comments and, memes making fun of liberals, I only do so because it’s fun and, sooooooo damn easy to trigger people like you

You’re just too dumb to realize, deflecting, well… you voted for Trump is just another example of what you’re saying only MAGA does.

Keep contradicting yourself. This is fun pointing out.

Somali healthcare fraud has been uncovered in Maine. Totaling 46 million dollars. Many claim it’s just the tip of the iceberg.

I doubt its just happening in Blue states.  The medical system in the US is so fucked up.

Some of those  at home providers that I know I saw a news story " Exposing"  are funded by Medicaid or Medicare I always forget which one is which.  But some of those places handle most of the process via email and phone calls . And then a person goes out to the home  to check up from the company. But not all of the people go to the main office . Most of the nurses my mom has had come from their house and other than going to drop off samples at a lab, or pick up supplies they are just going from home to the client.

Some places only help fill out forms to get a caregiver paid and that's all they do is set them up and then a payroll company handles the rest. SO a place that offers this service might only have people at the office a couple times a month or not at all. Sometimes medical supplies are shipped directly to a patient instead of a nurse coming with the supplies they need.

Those caregiver programs and at home care is a federal thing so its likely much bigger that a few Blue states. If those are where a lot of the scamming is taking place.

The big thing that sucks is that whatever they do to stop fraud will likely just make it harder for the people who really need it to get even less help than they do now. And somebody will still figure out how to scam it. Like donating Trump a few bucks and getting a pardon after it goes sideways and they get shutdown. Then do it all over again.

Bingo. Our healthcare system is fucked, and it's good that we identify and call out fraud. But they aren't going to address it and rework the system to make it better for us, it's an off ramp to eliminate these parts of the system. Cherry pick the fraud that is close to us citizens. More people suffering, more people dying.

Meanwhile, Healthcare CEOs like United Healthcare dude banked like $26M (a year) in 2024 before he was laid to rest. That went to one dude vs divided up amongst a bunch of Somali criminals. Our healthcare industry is littered with fraud that stays here domestically (or into offshore accounts).

Distract, and make sure you control where peoples hate and frustration is targeted. Especially when you're trying to get rid of a bunch of immigrants, it fuels the rage beautifully.

EDIT - My grandma is staying in a pretty nice facility and they have a lot of care resources in house, it costs $15k a month, that is insane. The people working with her barely scrape by, and some work more than one job. They are still super nice people and do a good job caring for the residents.

My mom worked at a high end place that had a mix of condo and room style places for people to stay. And varied from full on memory unit level care to retired community style living with limited nursing available.

She retired about 15 years ago. And the high end condo style setup with nurseing home level care was 40k per month. But it was a nice place and the condo style units were like a legit standalon condo . Single floor like mini houses.

She wasnt paid much more there than she was at other places and they had the same issues with short staff etc that every other place has. Blows my mind how much it costs and then they cant have more help. I dont remember what the cost was for the regular style nurseing home area.

Now years later im so glad i listened to her stories of how she cared for the people with memory problems as I care for her and she deals with alzheimers herself.

In november of 2024 she fell and broke a hip and arm. Shes a tough lady and after i got her up into a chair she didnt show any signs of pain.

She had surgery and went from doing very well with the meds they had her on to doing much worse mentally because of the surgery. The loss of blood and meds they used. They had warned her of the risks and she was clear enough to understand the risks.

I wanted to handle her pt myself with guidance at home. But they talked me into a rehab. There were some amazing people and a couple people there for just a paycheck and didnt care as much about the people.  She was there about 3 weeks or so and I spent a lot of time there. Side note turns out that a lot of nurses find a man that cares for his mother VERY attractive. I wasnt in a state of mind that I really wanted to capitalize on that. I got a lot of phone numbers and new friends. But it cost close to $20k that they billed her insureance . Luckily her insureance covered just about everything.

I’m sorry your mother deals with Alzheimer’s. It’s a cruel disease.

Thank You. Its sad to see her lose a little of herself everyday. I try and make her life as enjoyable as I can. It can be a lot of work sometimes. She lives with  me and I'm caring for her alone for all but 6 hours a day. There have been weeks that I only slept an hour or 2 each night . I have help from my sister who also worked as a CNA like my mom did . I'm happy to be able to have her at home with me. I would recommend anybody that is able to do it ,do it for their parents .  It can be VERY mentally taxing though and might be the hardest thing You ever do. But its also very enjoyable a lot of the time. I'm so glad to be around for the moments she has when she is clear and more of her old self.

She has vascular dementia and Alzheimer's. The vascular dementia is pretty much her brain slowly losing the blood supply and shutting down . She's on meds that slow it down . She has always eaten healthy and the Dr.s are always surprised when they do bloodwork and see how healthy her body is.

I didn't realize how mentally tough I was until my sister stayed over 2 nights while I was sick and she helped me with my mom and her dog and after that she was looking for states that assisted suicide were legal. Se hadn't seen my mom at night or before she had her meds and didn't know how much I was doing at night. I've gotten used to it now, but its still hard and sucks sometimes when I'm unable to figure out what's bothering my mom. I've been with her or close 24/7 for the past couple years. It can be a lot, but its also amazing sometimes too. Luckily for me we bought a property that has my shop on an abutting lot so I'm always close and can still keep my business going. even though I've had to scale  back  a little. We got it a year before she started having symptoms .and I'm so glad we did it before it started or it would have been much harder .

She was a talk show host on the radio and was trying to do some TV stuff . She was able to help a lot of people through her show ad helped push for the ADA laws . She was a part of many charity programs at all the stations she worked at. And as a result was a local celebrity . She has always had very strong opinions and that brought on death threats and strange packages showed up at our house. I was not allowed to get the mail as a kid after a suspicious package came. She was a very no gun person until a person showed up late at night when she was on the air and tapped on the window of the studio with a gun. And another time a person confronted her as she was walking to her car. After that she went from anti gun to getting a gun lic and did a training on her show to let other would be attackers know that she could protect herself.   But  she got tired of all the BS that comes with that and  she decided to go and become a CNA and be able to help people directly via that job. Shes also done psychic readings and run fairs . I wasn't a believer but I experienced some of it myself and I think she passed some of that ability to me. But thats another story.

And still to this day she's always wanting to help people. She is always asking about all of my siblings and wants to make sure they are ok. She has forgot a lot, and it was very hard to see at first, well its still not fun. But I've learned to focus more on the parts of her that are still there and the positive times we have. And  as much work as it is, I'm still glad to have every moment I have with her.  I ask her what she wants to do and most of the time she will say she wants to help people. We came up with the idea on filming alot of what happens and I'm going to make videos for Youtube to try and help other people that are going through the same thing. I haven't posted anything yet because I feel strange putting it out there. But I have the footage and she wants me to use it to help people. I don't know when I'll start posting that stuff yet. I may wait until I know the full story so I can narrate and be more helpful with the hindsight I will have.

Sorry for the long post, I just feel like I had to let people know about how great of a person she is so people don't just think of her as how she is now. Its such a shitty disease and I hope they figure out a fix for it. There is so much money in caring for people with it, so I doubt a cure will come out with the way the medical world is in the US at least.

Great post @The real Sasquatch.

Its pretty clear even as strangers on a motocross forum that your mom did a damn good job raising your punk ass. Good people raise good people.

EDIT - You seem like a thoughtful, caring, and intelligent man. You try and see things from the perspective of others. And you ride dirt bikes. The world needs more people like you.

My mom was fortunate to build an addition on our childhood home that was handicapped accessible so my grandma with MS could live with us when we were growing up. She got to watch her grandkids playing in the yard towards the end of her life, and I would always go steal bagels and cookies from her. I think my mom and her had a rough relationship most of their lives, but even as a young buck I recognized how healing that whole thing was for both of them. And I saw plenty of the uncomfortable stuff too. It's a strange thing having to parent your parents as father time catches up to them.

My mom had us helping in soup kitchens to feed homeless folks when I was 13 to help us appreciate how lucky we are. I was handing out fruit at the door, and someone got stabbed over a plate of baked ziti one time.

I have a sibling that has been a state senator for a while, now running for US Senate. Because of this, both them and my mom have also received countless death threats, bomb threats, police at their houses many times. Lots of doxxing. There was a fella scribing their face on bullets and mailing them out to people at one point.  I know me posting here probably stresses the security team out haha. Oh well.

Kill em with kindness. I tell myself it's ok to be a sarcastic shit every once in a while though.

She sounds like an incredible human being that has helped out tremendously throughout her life. She was, obviously, a great influence on your sister and you. I’m sorry she had to deal with idiots threatening her and your family. Most people hear about people like that, but likely never experience it. You’re a good dude.

She sounds like an incredible human being that has helped out tremendously throughout her life. She was, obviously, a great influence on your sister and you...

She sounds like an incredible human being that has helped out tremendously throughout her life. She was, obviously, a great influence on your sister and you. I’m sorry she had to deal with idiots threatening her and your family. Most people hear about people like that, but likely never experience it. You’re a good dude.

As a kid it was just normal ,as strange as that sounds.  I grew up as a very shy kid . But many people knew me and my family from my mother's shows and articles.  It was strange looking back on it. But it helped me really understand what the downsides of fame are like so if I ever become famous I have a better idea of what to expect. I can't imagine how nuts it must be to be super famous like  a real celebrity and  how crazy it might be. There are some really strange people out there!!  But also a lot of really good people too, and she's still friends with the first station manager that hired her and he has come to visit her. She is friends with a former Ms and Mrs Massachusetts . As a teenager I looked forward to when she visited!   Thats her from back when she won MS before she got married.

Tucker Carlson interned at one of the stations and its funny to say that he was an intern for my mom in a way. She used to talk about how he was an entitled rich kid.

A friend of hers was good friends with Axel Rose from Guns and Roses and they used to go party at the guys farm after they played Gillette Stadium.  I only know that  they filled the horse water troughs with beer and ice and things got wild. She never told me any details about it.  Her friend was starting to talk about it and she hushed him and that was all I heard. But as a kid it was wild to think that Guns and Roses was up the street partying at a farm that we kept our horse at. She made me swear not to tell any of my friends . I knew the guys kid and he didn't want his wife to find out through the kid. They had expensive show horses and she would have been pissed.

I didn't know how serious some of the stuff was until I got older and she told me the stories of why we stopped getting mail at our house and some of the crazier threats and things mailed to her.

There was a guy in prison that said he was buddies with a lot of the mob guys from back then, that used to call into her show and mail letters to the PO box and radio station..  He said he was in jail for shooting a guys kneecaps. and beating the crap out of him.  He told my mother that he had walked into an ally and saw a 14 year old girl getting raped and that was why he shot the guy. Who knows if the story is correct or not, but he was in a maximum security prison in Walpole MA for the rest of his life.

He ended up stealing  credit card info  from guards a few times and somehow was able to order 100's maybe 1000's of CD's that came to my mom. along with some bottled water from  some glacer that cost a crazy amount. The FBI investigated my mom and she was suspected of credit card fraud of over 10K . They thought she was working with him. there was a bunch of stuff they took that she never let me see . The CD's were not connected to that case and they told her to keep them.  She had gone and visited the guy and was not really friends with him, but found him and his story interesting for the show  until the FBI showed up at our house. They had her  go visit him  and listened to them talk to get cleared. I think they waited a couple months or so before letting her know they closed the case and she was cleared.

After that she never spoke to him again.  They never took the CD's back and my mom refused to do anything with them. So we have boxes of brand new CD's with every type of music up to the late 90's. classic, rock, etc.  She did something with the water , she worried it could be poisoned or something.  He was already in for multiple life sentences and never getting out so he really didn't care. But after that they transferred him to another prison . I think someplace in NJ. but not sure.

I wish I had picked her brain more for more stories while she was able to remember them. But I've used up too much space talking about her. Thanks for the kind words.

That's what I thought when I saw the spot without the light. I looked and online at ford SUVs and didn't see any that looked like that without the light. But I don't know Fords that well so it wasn't a total red flag for me. But it looked very finished for behind a light. I've worked on a bunch of vehicles and they are normally more unfinished with wires and plugs hanging down after You remove the lens. But I'm no expert like that guy claims to be.

The vanishing badge could be just a result of somebody using AI to enhance the video quality.  AI works great on peoples faces to enhance, but I've used it on some old HI8 Motocross videos of mine and it turns sand into a solid clay like looking thing and makes all kinds of odd things.

Could also be an artifact in a few frames. Digital video can often have things like that that show up .  If its  consistent in multiple frames than  there might be something to it being AI created VS AI enhanced . I have a hard time trusting a single angle ,single video or photo of anything these days. Its easier than ever to fake stuff.  If its real there has to be other footage out there. other people filming or bossiness with cameras. Yet another reason that ICE should wear body cams so they could share an official bodycam video or a few as proof of it being legit.

Don't be gullible enough to follow ole' Mattii around. Watch the actual footage yourself and you can see it's real. That's what the AP did.

She and you have had a fascinating (scary at times) lives from the sound of it.
