this "excuse" is used on the daily by our media, and it would be weak in this situation. It appears the jury trial is a week long. Send someone to the trial and REPORT ON WHAT WAS SAID. What evidence was shown. Then, when the verdict comes back, report on it. Talk about it. Release a video discussing it. Seek comment from FELD, AMA, A-Stars, the Moreau family, the lawyers, and other industry pros.
Nothing changes if nothing changes.
Hence the need to have someone sitting in on the proceedings.

That said, what a tremendous opportunity to expose any deficiencies (should they exist) in our safety in the sport. Not in a way that's tabloid level stuff, but in an effort for real actual progress in our sport.
Instead, if this thread wasn't bumped, none of us would even know it was happening...just as FELD would prefer.
I kinda feel like supercross disappearing would be the best thing that could happen to the sport. Personally I would love to see a 12 race domestic championship and another 15 race western hemisphere championship as a replacement to supercross.
Supercross is a boring circus act stunt show and tarnishes the true nature of motocross.
The supercross no bumps smooth track big jump culture is now all-to-pervasive in American motocross and it’s ruining it.

That’s typical with AMA waivers. They’re generally durable up to ordinary negligence, even when they’re not perfect.
For example, in this case, Brian signed the waiver at 17 years old and his coach (not legal guardian) signed as the adult. That’s a voidable contract because he was not legally competent to sign as a minor. But he availed himself of the benefit of the waiver after he turned 18, effectively ratifying the agreement to be valid at the time of the injury. Court held that the waiver was valid up to simple negligence, despite the agreement being illegal at the time of signing.

Still baffled this made it to a jury. Are there laws that limit the payout in this situation? Like whatever the max is is a number feld can live with?
Also curious if all the defendants are tied together or can some be found liable while others aren't?

The case is in federal court but applying Florida law, so it depends if Florida has a statutory damage cap. I’d guess not in cases of gross negligence. Also, Feld’s insurance may not cover gross negligence, so it could be on the hook for paying a judgment. Just speculating here.
Regarding the defendants, that can get very complicated. Think of middle school kids playing baseball in the street and breaking a window. Maybe 10 kids are playing but only 2 are responsible for breaking the window, and another 1 was in charge of setting up the bases. What are those kids going to do when you get all 10 in trouble for the broken window? The dynamic requires big money and lots of double spaced paperwork, but the basic mechanics are the same.
In this case, the AMA was a defendant but settled with Brian back in June of last year. So in exchange for an undisclosed amount of money, Brian agreed to drop any claims against the AMA but continue to go after the other defendants.

I love that the fact that the OWNER of Feld hired an ex CIA officer to make sure the media never releases a story on his family and you guys are still in here asking why the "media" isnt covering this. 😆

I’m not defending the Feld story at all but when there’s big money/inheritance/big business, family drama seems to be the way it goes. I’ve personally seen some ruthless tactics over 500acre family farms let alone a corporation like Feld.

Sorry, man, I've had a shit week. I got stranded in one airport for a night, ended up on another plane with an electrical fire, had an infected tooth that was so bad I sat in the corner of an airport in the fetal position almost crying for two hours, wasn't able to eat for over 36 hours because my mouth was so bad, landed, went straight to the dentist to have the tooth pulled, got home and cranked out the work I was behind on and now I'm heading to the San Diego stadium this morning. I haven't had a day off since Jan 1st. I've shot every single day. I don't have time to read and post to everything on the forum.
To another user's point about having someone there, we don't have that kind of manpower for me to send one person and pay for them to sit in a courtroom. Our crew is very small, and this thing has been dragging on for years (I actually got called to ask about testifying over two years ago). Similar to Steve, I had no clue it finally went to trial.

I get flamed for asking these questions (so bring it on)...but Vital doesn't feel this is newsworthy? A rider is paralyzed permanently and partial blame might be on A-Stars. The family sues all of the orgs involved in our sport and those leaders are currently testifying about these allegations...the fallout could have profound impacts on our sport's safety...and some of the larger names in our media don't even know the trial is happening?

Not knowing the trial is even going on is kind of the problem, not a great explanation of why there's been no coverage of it.

The applicable cap on punitive damages is probably the 3x because economic damages are potentially astronomical.
