Actually the bar is responsible to an extent for over serving the patron. It’s all a line of bullshit that just over flows to blaming the most fault getting the most compensation.
IN a perfect world your last sentence would be true.. but the bar actually is responsible in many cases, and especially in Utah.

The person/company that has money is the one who gets sued, not the person/company responsible for the injury to another. And the more you are worth, the more you get sued for. Drunk guy who hits woman and kills her has no money but Lorreta Lynns does.

The “who cares, (insurance/big company/wealthy person) has plenty of money” mindset of jurors is ultimately going to kill off every ounce of fun in this country.
And then the insurance companies raise their rates, so WE pay in the end. It’s a win/win for the insurance companies. Biggest scam going, forcing people to have insurance. Literally illegal to take full responsibility for oneself. Its function sets the precedent for exactly this kind of behavior which cycles in perpetuity, also a win/win for the insurance companies.

An accident takes a woman and all they see are dollar signs. Greedy fucks will burn the country down for cash. If I had any sort of venue, I would close it. If I had any sizeable chunk of riding land, I could not in good conscience allow anyone to ride there. too much greed.

Unfortunately, yes the bars are responsible if knowingly serving alcohol to someone intoxicated. Is it right? Probably not but it's the the society we live in. It's called the dram shop law.

It’s not that easy soon as you get a lawyer involved. Say that person only has x amount of money he’s insured for that they can go after. The lawyers and insurance companies make you sue everyone. If the insurance company is paying you anything they sue anyone or anything involved.
And where do you think the insurance companies get their $$? From the premiums we all pay - it doesn't come from magic money tree. I don't forget this at all - in fact it drives me nuts knowing each and every one of these lawsuits take $$ out of my pocket (indirectly of course).
Sorry, can you elaborate on this personal responsibility you speak of? I’m curious what you mean by that in the context of this particular situation.
By the explanation of reasoning for the lawsuit, every NFL game, every major stadium event, should also be sued for any incidents.
As the story goes....
There was a rich farmer where I live. Big farm, big house, big boat, hot young wife ,eccentric etc. He was at a social gathering talking to a young man in his early 20's, the young man plying him for advice on how he made it big.
As the young man hung on every word the very rich man said, the wealthy farmer leaned in, looked him in the eye and said..."You know you've made it in life when people start suing you"
To a certain extent, it makes sense for a bar to be responsible. Back many years ago when I was barely old enough to drink (19 where I live) I'd get so drunk that I couldn't speak well enough to order another drink and my friend would be like "he wants another Jack Daniels and coke" and they'd give it to me. That should never have happened. At that point, I was way too drunk to make a rational decision, and my friends, while not as drunk as me, were pretty fucked up too. So in that case the bartender should have cut me off. "If the customer is too drunk to order, then don't serve the customer" should be a pretty easy rule to follow, and it would make sense to expect it.
What doesn't make sense is to have an expectation of babysitting. It is up to the customers to figure out how to get home safely (designated driver, taxi, uber). There is a big difference between having the sense not to serve someone to the point of alcohol poisoning and monitoring each person to make sure they're behaving responsibly at all time (apart from, say, having bouncers to get rid of people who are harassing others, starting fights, etc). Everyone should already know that you shouldn't drink and operate a motor vehicle of any kind. Unless the event actively encourages drinking and riding (which is very different from encouraging drinking and partying), then not riding while drunk would have been an implicit expectation, I would think, and the individual is responsible for violating that expectation. My 2 cents, for what it's worth.
