Lawyers for insurance companies will be the death blow to any public moto tracks, and probably most private ones too.

The lawsuit is filed under the injured person's name, not the insurance company's name. If the injured party doesn't co-operate with the lawsuit, they will suspend payments to medical bills, etc. 

Shitty part is most of this falls under NDAs and unless someone wants to get sued...it's hard to release details of the case itself.

4. Injuries to Zach were pretty severe, it wasn't just a broken pelvis. His total broken bone count was around 30. Shattered both ankles, his wrists, broken toes, broken sacrum, broken pelvis, collapsed a lung, and a ruptured bladder. He had three blood transfusions, and actually flat-lined at the hopsital. He was fucked up, over three weeks in UCLA hospital.

5. Rich would've gone to the hospital with Zach with the severity of his injuries, he's also over 200 pounds trying to pose as his 120lb 13 year old son the same day? Again, this was in late February, there was only one are qualifier for LL that had happened that year before that date, that was at ACP. There was no area or regional qualifiers for LL scheduled at LACR in 2017

With the way point #3 works, I am amazed we are still able to do any high risk activities in this country. What these insurance companies get away with is pretty wild.

We have enough trouble from outside our sport to have someone on the inside fucking it up.  I'm shocked to hear this to be honest.  Of all people, I'd have never guessed it to be him.  He always seemed like a stand-up guy that loved the sport.  Anyone that rides and sues a track is a PC of sh*t.  Absolutely no excuse!!  You take a chance each time you ride and you know the risk.

I was a loyal EXS brand wearer but will never wear them again.  

This is sickening.  The moto world had to know about this and how he hasn't been blackballed is insane.

Exactly. Round up everyone in the pits and go up to the promoter and demand your money back if they won’t change a section “all” feel is unsafe

It's mind boggling how many of you just completely ignore that it's VERY VERY VERY likely that Rich had nothing to do with the lawsuit.

Top section. It was a long straightaway that had 1 or 2 jumps before it went downhill into the left 180 on the side of the hill, had a small jump into a right hand corner before heading back down the hill to the front straight with the 3 tables.

I had a pretty serious injury I got an ambulance ride for about two years ago.  I had to answer all the same questions about who was involved, where it occurred, etc.  I got landed on by another rider, but filled out the form stating that I was the only person involved in recreational riding at the track.  They paid the bills and I never heard anything about it again.  I can promise you that the form that was filled out didn't ask if the injury occurred in a "sketchy" section of the track. 

You'd think that with all "journalists" in the sport that someone could get to the bottom of this.  Even if an NDA prevents Rich from coming on here himself to discuss this, I'd bet he could feed enough information to one of these "journalists" to steer them in the right direction to uncover the truth.  I've always liked Rich and his products and I really want to know that this is just BS.

It's called subrogation, and every insurance company does it. For example: you get hurt at a business and break your leg. Your health insurance will pay out to fix your leg and then go after the business's insurance to cover the bills if they can prove that they were negligent/liable/whatever.

ML posted that he has reached out to the track and Rich. the track had nothing to say . Rich was talking to his Lawyer to see what he could say. 

 Wouldn't you rather wait a little bit to hear a direct quote from Rich, rather than some round about vaguely worded  undisclosed source being quoted or hinted at?  Give him more than a couple hours to make sure he's not going to say something that makes it even worse for him. ML has posted with what he knows to be true. And said that he is still working on getting more info.  In Cali its still only what 11 am?

I wrecked at a hare scramble last fall and broke my arm and dislocated my shoulder. No surgery, but had an ER visit to reset the shoulder and two months worth of PT. My wife is still getting letters/emails from our insurance wanting more details about my wreck. I'm guessing they are digging to see if we'll provide more information for them to attempt to sue the promoter and/or land owner. I'm not going to do any of that, but I could see the Taylor family having nothing to do with the lawsuit. Maybe they are 100% behind it IDK just giving another perspective. But, I can't see him shitting on a track and risking his business/name for a couple hundred grand.

I broke my foot in my own woods about 10 years ago and went to the hospital. I told them I did it in my backyard on my dirtbike.

I had a few phone calls and at least one letter wanting more information about where it occurred. The lady on the last phone call even went so far to tell me she didn't believe I was riding in my backyard to obtain that type of injury. I finally told her I paid premiums monthly to her company as well as my homeowners insurance in case these things happen and for her to do her job and pay the bill or I'd be shopping new providers.

If there was a settlement that included a confidentiality clause, disclosing information privately to a journalist is no different than broadcasting the same information on social media.

That being said there is nothing in the public record to indicate the case has been settled, it is currently set for trial in August. I wish Dan would answer my question (just kidding, he knows why I asked and I know why he won't answer).

The lawsuit is filed under the injured person's name, not the insurance company's name. If the injured party doesn't co-operate with the lawsuit, they will suspend payments to medical bills, etc. 

Shitty part is most of this falls under NDAs and unless someone wants to get sued...it's hard to release details of the case itself.

I'm sorry but something like a water truck or dozer going backwards on the track or similar negligence in my mind is the only thing that excuses suing a track. The Taylor's have been in the sport a long time, and they definitely know how to walk a track and walk away from a track if they think it's too dangerous. I have no clue how much of what Cooksey said is true, but I now know 100% Rich Taylor and son sued LACR after Zach crashed on a track they knew well.

You must be a joy to be around. I don’t like tracks getting sued either but if other moto guys say something is sketchy, it’s sketchy. If they were told and saw crashes and didn’t change that. That’s negligence. If it was my buddy I don’t think I would be telling him well bro you know what you signed up for.
