Where the “new Penton” thing goes wrong is that the crowd who remembers Penton is pretty hardcore and sees through the BS marketing of knockoffs, and to anyone else the Penton name is meaningless. It’ll be interesting to see if it works well enough to get through the first batch of knockoff bikes and make a second batch. At $8500 I’m betting no. 

That hits the nail squarely on the head.

Anyone who remembers is disgusted, and everyone else is like "what a random name for this Chinese shitheap"...

Not gonna beat a dead horse but I feel for the pioneering old boy having to see this crap at 98 years old.

Penton family could have a legitimate case if they chose to make a legal issue of it. Courts have favored ownership of branding to original owner of zombie trademarks in cases where the brand has "residual goodwill" (which is clearly what Terry Everett is basing his business model on). In 1990, in a similar case, courts found in favor of Ferrari vs Carl Roberts, who was selling Ferrari-like car kits under the unregistered "Spyder" trademark.
