This went wrong from the start. He is plainly trying to market to those who remember the Penton name & brand. And those who really do remember, i.e. those who he is trying to appeal to, can or should be able to plainly see what a smoke screen rip off this is. Caught in a self made catch-22.

Aside from that - it's UAF.

Terry does sell all kind of penton repro parts. This rebadged china bike seems off target though.

Equally bad form selling all that crap under the brand just because he is registration squatting. Note also that he is selling cheap-ass new "Hi-Point" branded gloves.

Penton family could have a legitimate case if they chose to make a legal issue of it. Courts have favored ownership of branding to original owner of zombie trademarks in cases where the brand has "residual goodwill" (which is clearly what Terry Everett is basing his business model on). In 1990, in a similar case, courts found in favor of Ferrari vs Carl Roberts, who was selling Ferrari-like car kits under the unregistered "Spyder" trademark.
