Broc has had his hearing. Last I heard he’s still awaiting a decision.

Bringing KTM into it? Why? Broc told me in the past that he knew that when the B sample result came back the same as the A, he would get clipped. I think that’s a pretty standard contract item.

When I worked at Specialized, the riders knew that if they got popped on a positive test that they’d get fired. They had a former mountain bike World Cup winner go out like that.

IMO.... Tickle need to retain an attorney and sue the FIM and the executives by name personally. If this get's him nowhere, then Tickle should sue the AMA and KTM directly to force them to stand by their riders.

PS. I would also suggest that James Stewart sue the FIM for prematurely ending his career. I would think that with James money and clout, he could make this happen and even get an attorney to take on the case on a contingent basis.

You are a little misinformed here. The only reason some criminal cases take so long is that the Defendant is waiving the speedy trial rights and requesting it take longer. Tickle didn’t ask to wait all this time, to the contrary, he’s been trying to speed up the process. Admittedly this isn’t a criminal case, but it is quasi-criminal in nature and regardless, the delay to hearing is unconscionable and fundamentally unfair. I agree the best approach is not to cheat. Nonetheless, shit happens and sometimes there is no intent to cheat. A quick resolution by hearing is the only fair way to deal with the problem. Generally speaking a shoot first and ask questions later approach to issues like this really doesn’t accomplish the ends of justice. Nor does it accomplish the goal of removing PED use.

Many here assume that to sue you have to have a good reason. Businesses settle all the time for no good reason because it makes business sense for economic and image reasons.

The cause IMO is "right to work" and it is a valid basis for a suit. There may or may not be an "At Will" agreement involved. That typically involves the employer, yet the race organization is the one blocking the ability to earn a living.

Innocent until proven guilty anyone?

Just like a pilot accused of drinking, or a doctor accused of negligence, they have a right to a day in court.

The AMA working through FIM adopted WADA to appear like a more legitimate racing organization. Good intentions. But I can't think of one positive thing the FIM or WADA has done to help the sport.
