How many riders total are we talking about who could have been affected? Was there 40 riders in both classes who tried to qualify? And another...
How many riders total are we talking about who could have been affected? Was there 40 riders in both classes who tried to qualify? And another 20 KTM juniors? Maybe potentially 100 riders? Were there any reports of track workers, mechanics, security guards, etc being affected? I'm not an Esquire but I don't believe the waivers would protect the promoter in this situation if it's deemed there was improper or reckless use of the chemical (unintentional of course).

I would say guess someone is going to pay big, and hopefully, it doesn't affect the series. Where are all the Vital Esquires who can confirm?

It’s not like they can measure they water failing from the sky, or the PH levels of the dirt, and come up with the perfect ratio of lime to elements to help dry the track. No one can. Not in the time setting they had. It’s a bad situation. Wounds will heal, lesson learned, be glad no one got hurt worse.

I would think intent doesn’t matter if you have negligence and it sure seems like there is a lot of that here.

Lime is used because its a commodity, readily available and it's super cheap. There are plenty of alternate products that accomplish the same end result, and in some cases even more effectively. It's a lack of knowledge and $$ issue. This isn't the only sport performed on dirt in open stadiums where weather can be a factor. Lime should never be used again in this application. Even some of the safe alternatives are damn near commodities now. That's how antiquated lime is as a solution for this problem.

Pissed? Hell yes I would be. I don’t think any parent wouldn’t. But what are you going to do? Hire a lawyer? File a suit against Feld? Tell junior no more motocross? Get him into little league that way when he loses his hearing from getting hit in the head from a baseball we can sue the baseball bat company for producing aluminum bats that project balls too fast? (And yes, that’s an actual case)

A freak chain of events.

No one in that stadium had the background or knowledge to say the standing water might be acidic, we need to test.

Feld is the promoter, Dirt Wurx is the contractor. Guarantee the contract between the two has some sort of clause that safeguards Feld from anything dirt related.

Hopefully they find a better way or move SX to covered stadiums exclusively. Many things worked well at one point but things progress and it’s time. Lime is old school

Was not a freak chain of events. The storms were broadcast for a week and they had it almost to the minute when it was going to pour. Everyone knew it but they still put down a shit ton of lime.

I agree that there was no one there to know the potential of the amount of lime and its affects when mixed with that much water. However, with the known amount of rain headed that way. Adding lime was a piss in the win move at that point.

Can’t wait to see the first step tomorrow

You are correct, intent is meaningless in situations like this. I work in the chemical industry. Our company was a very minor part of a large chemical release situation in the last year in which there was a very big lawsuit. We made 1 very slight mistake in our job of which didn't directly impact anyone. One person in our company didn't follow 1 SOP correctly. We had all other cards in order, SOPs, documentation, etc. Yet we were still involved and named. Over +$50K in legal fees, +$30K in OSHA fines later for us over one slight mistake, I can't imagine how much the big players (who were mainly responsible) got dinged for. Intent has nothing to do with it other than minimizing the damages.

The only thing that would need to proven is that the crew/individual had no proper training in the use of the chemicals ordered and applied. Saftey sheets would also need to be on hand and readily available to personnel for all chemicals used during the course of duties. Without files showing these personnel were trained and signed off by a safety lead to use such chemicals, this is a slam dunk corporate negligence case for all parties involved.

Don’t need to prove intent when there is negligence.
How were they negligent? By spreading a drying agent they have used successfully for the last 10 years? Once again, no one knows if the batch they received was bad. No one knows if it reacted the way it did because of the elements or something else? I don’t know, no one dose, and the major glaring fact that everyone is missing is the track had already been torn down and whatever evidence was left, has already been tainted because the track has been torn down. If it were to go to trial, (which it won’t), whatever samples they collect would be thrown out.

The product and Quality control is all traceable based on CofA's, packages shipped, and sample retains. Getting a sample of the batch of lime used is 100% readily available in the event of a lawsuit. Retain samples are required for all batches. All chemicals are currently required to have labels that meet GHS requirements which includes 6 primary components of which will include the manufacturer or provider of the material along with hazards, warning statements, lot numbers, etc. If they shipped product that didn't meet GHS standards, they are double fucked.
