So gut the camera of its camera stuff and have just the case, mount it on the helmet and call it a hood ornament.
Luv to see the authorities parse the rules in this case.
Then the following week make sure the companies logo is clearly visible.
Also, I have changed my position and think Reed should push for the right to use this product. He has pretty solid reasons why and it can only help himself and many others if its passed.
The default position should be no exclusives at all. at least for any product that can be worn, used, or fitted to the bike or the riders.
This reminds me of the decisons by marketing department for new advertizing programs. think Google ads, you must opt out to not be served up ads. You could make opt in the default or opt out the default. Which is most always done by money making enterprises? ... Opt out. Enlightened organizations choose to opt in to protect the little guy.
DC, please change your organizations default to make sponserships non exclusive. You have enough advantages in the marketplace that you dont need to take money out of the riders pockets, factory and privateer alike.
1. Spend a whole lot of money on traditional avenues to reach us (websites, TV where possible, events, magazines, etc.)
2. Sponsor a well known rider and figure out a way to get some media attention (good or bad). They just so happened to be given the perfect "gift" of GoPro's exclusive agreement to cause some controversy and get some attention.
Chad's not going anywhere this season, and now we are all aware that the 360 camera exists (I personally checked out their website after I found out about them). Mission accomplished. This would be a great case study to learn about in a college marketing class.
If it was the only product on the market then there was no need for an exclusive anyway....... They knew other products were on the market or would be coming on the market that would compete with them. The promoter should have said no exclusives, even "if" your the only the only viable product in the market place at this time.
Let him run his camera, its hard enough to fund a team without having to compete with the series promoters as well.
What will be hilarious is if we were to lose a live TV deal just because you don't like an exclusive contract.
Also, I'm pretty sure someone before has tried to use a "shell" instead of a working camera. I'm not positive if it was successful. I think it may have been in some pit-bits photos (or maybe that was another rider having to follow the same rules as Chad).

d. The use of a video recording device or its likeness is not
allowed at any time during on-track competition, including

e. If an approved helmet camera is used, it must be mounted
per the manufactures recommendation.
So I'm guessing this was the specific rule that prevented a rider from using a "shell" of a camera.
Let's say Chad and his team don't show up to the next round... what about Discount Tire, Fox/Shift, Oakley, Kawasaki, and the other brands supporting his team? Chad and Josh aren't injured. They are fully capable of racing. Do you guys really think Chad has a NFG clause in his contract that allows him to decide they aren't going to show up at the races because Chad doesn't want to? You can't make this stuff up
And FYI, companies are allowed to service their riders as an industry sponsor. That's how Thor/Parts Unlimited was able to have their semi in the pits at Hangtown and Glen Helen, to service their riders. They must have the exclusivity for the dealer hospitality, however. The hospitality for doing and creating business is the hot button topic there.
I understand that you feel it should work differently but that's not going to happen as the series' need this revenue. Being able to provide catered food, prime viewing areas and track walk access for qualified dealers is a big selling point for any distributor.
As I said, this works both ways for each series. If WPS tried to offer a hospitality for their customers at a Supercross, that would be shut down quicker than you can imagine. I hope this sheds some light on it for you.
