Some of you guy's have rode Grinding Stone in Arizona

Well turns out an under age kid signed the waiver and lied about his age then got hurt.

Now the Father who is a Fireman is suing the track.

Grinding Stone is Closed until further notice.

Let me tell you what is worse, this is on Indian land and I assume the Indians get hammered too trying to grab the Casino money.

Any bets on weather this place is ever allowed to reopen ?

[/quote]Are you saying that the fireman is also going to pursue the Indians for money? It isn't the SM group, is it?

Fireman didn't know where his kid was? No negligence on his part 'eh??
8/4/2011 12:04pm
Figures............ hope the waiver shows the age restrictions and if the boy is under age lets hope this get throw out. Dumb ass dads!
8/4/2011 12:08pm
Tell them to go over old waivers and try to find one with the dads signature. If this kid has been there before, he may have had his dad go with him at times.

Track is on Indian soveriegn land? Is he suing in tribal court? State civil courts generally (generall) don't have juridiction over what happens in Indian nations.

that really sucks. I was hoping we would have the ride day there again this year. That's why my track is members only. Even that feels a litlle risky.

Yep!

Good luck winning against the Indians. Practically never happens.

Are you sure, 100 percent, that the track closed because of this?? I bet there is more to the story.

It's like Barona Oaks, you can't sue the indians the track is on but you can sue the white guys who have the lease and run the races, I try to tell people...always always always have an insurance policy when you promote anything !!

He might be busy fighting fire... A kid could forge his signature....sure there's negligence on his part...... A track that is closing is a real bad news!

I'm no lawyer, but I'm pretty sure a Notice of Dismissal means that either the court threw out the case, or the plaintiff came to a settlement with the defense.

So what's the problem here?

Without Prejudice means the plaintiffs can re-file another suit. Must of been some problem with the initial filing.

Think I'm correct.

I spoke with Gary on the phone today and he said he received notice from the Tribe that they were to cease operation immediately, but that he had things in the works to be able to re-open. He said he didn't know why the notice originated, but that he was working with the Tribe to try and get back open asap. I really hope it is temporary, because my son is a lock to win the gp series in his class and it would really suck for him to not be able to finish.

Andy makes a good point, maybe they want to take it out of civil because the limit is $10K and move to superior. But of course civil doesn't require a lawyer, superior does. Maybe when the dad has to shell out coin to hire a lawyer, he might change his mind. How old was this kid, how did he get there and what is the extent of injury? Any info on that?

And FWIW Gary and Kyle are two of the nicest, honest, encouraging guys that I have met at the tracks around here.

Wonder what the details of the crash or injury are . . wonder if this kid is stoked on what his dad is doing? This sport is doomed! ha.

I hope everything works out for the promoters.
If it isn't obvious, that family should be blocked from every track in the four-state area!

(I have a bunch of cussing going on, but I can't type that fast)

ps- selfishly speaking, we have plans to attend the PHX ride-day.

years ago, one of the higher ups in a very well known helmet company got hurt riding over his head and tried to sue the track i'm a member of. i knew him well and it blew away that he would try to hurt the sport/track because of his own misjudgment.

people are sue happy

Half the fireman I know are on leave with a work related disability. They just don't build them like they used to.

I think the track is still liable. The track did not enforce the rule about no one under 18 without parents signature. You cannot "lie" about your age, just like a juvenile can't just lie about his age and buy tobacco or alcohol because you check their drivers license. Now if they did check his drivers license and have a photocopy of a forged document they might have a case there was no negligence on the tracks part.

Either way, if there is an insurance on the track (which there should be) the insurance will probably pay. If the track is on Indian land, I don't think they are under our laws but I don't know enough about how the laws on the reservation work in local state and federal levels.

I don't think it is right we slam all the firemen just because the actions of one. Like saying all motocross racers are stupid backwards hillbillies because one jumps over a house and kills himself doing it.

Most of the ones I know work for jurisdictions with slashed budgets, pay freezes, and worn out equipment.......

I brought up he is a fireman because he should know the risk and should have taught his kid better,

Most the Firemen I know are good Men, I'm sure there are good and bad just like any walk of life.
