Interesting case. So many people have been so abused because of asset forfeiture. Law enforcement needs to be brought under control. Recent decisions have indicated that SCOTUS agrees.

Damn, we have some whacked out priorities in our legal system......
Eminent domain is a big problem with datacenters right now, taking people's homes and land for the greater good of raising their energy rates in order bring the world more reddit and wiki posts presented as factual scientific data. God bless you mister!
Here's one from the same site with an oil company...

We live in a “Police State”.
Why do they need a whole ranch for a pipeline?
They never mentioned it's size, but when the oil company came wanting to put a pipeline through the Mineral Wells ranch, everyone agreed to a lease price, and they rebuilt some erosion proof roads and some sweet new gates.
This story makes no sense to me.

AI told me they wanted full land value, not easement value. I'm not sure if that is true or not.
Maybe something by agreeing to enter a settlement. Sometimes just entering these agreements fucks people over through unforeseen limitations. That 8th circuit appeals court that overturned 40 years of settled law is curious. One could look into how those folks got into those positions and see if there's anything unusual.
It just makes no sense to me. I'd like to know how much they took, and they can't take minerals, right?
I mean I could sell you my ranch and keep minerals, how's that work for Domaine shit?
The fact that a private, for profit company has eminent domain powers is just phucking amazing. And not the good kind of amazing!
It's worse than that article describes. In that case at least someone was convicted of something, even though the punishment is obviously absurd. Civil asset forfeiture is far worse and you can't even convince most people it's a real thing that happens. Don't even have to be charged and they just take your things and dare you to fight to get them back. Absolutely insane. Hopefully this is what the supreme court addresses.
Old article but best I could find with quick search that explains the issue.

It looks like this is a somewhat common tactic where they offer you a well below market price because you'll have to spend hundreds of thousands of dollars to get more, but catch is that it's all high risk when you sue, because if you lose, you pay all the legal fees spent to fight corps with deep pockets, or you play it safe and take the low price. It's basically like our criminal justice system, the original offer is shit, but the risk to refusing it is high, so you take the shitty deal out of fear.
Couldn't say about mineral rights. They normally transfer with the lot and this pos court of appeals doesn't seem friendly. If the case gets enough attention, I suspect the ussc will adhere to traditional rulings. If it flies under the radar, the corps will win. The case is scheduled to be heard on Wednesday July 29th. I'll try to remember to give a listen.
Minerals don't automatically come with land unless you are not paying attention.
At least in Texas. I don't know if that's a state thing or what, but I can sell you my land and keep mineral rights to it.
I wonder if he had more than one plane….. If not , it’s even more outrageous ,that by taking the mans only plane, they took his livelihood along with it.
All part of the "just compensation" deal. If you have something profitable going on with minerals on your land, they gotta cough it up. Or.....not, because there's the slimy side of it like in this example where they undercut. But, I don't see anything weird at all. This all fits the stereotypes, a lazy govt selling its tools to the highest corp bidder, then a big corp using those tools in the shittiest ways possible, then the big shocker of judges siding with those deep pockets that definitely didn't influence them.....definitely not. There is nothing surprising or weird here, just money and power flexing as usual.
Asset forfeiture is bullshit. Eminent Domain is bullshit. Both are unconstitutional and should be outlawed.
I'm sure Profeshional has an opinion on asset forfeiture among truck drivers. Those guys get screwed all the time because they crossed a lane marker or something and then get their life's savings confiscated because the cop thinks cash means you are selling drugs.
Stay safe out there
Stay strapped! The “Police State” doesn’t like 2A.
