Unless I missed the specific details of the bike leaving the original dealer, it's absolutely crucial to how this got handled.

Was it straight theft? I don't think it was reported as such. It sounds to me like the original incident was probably attempted to be reported as theft, but ultimately changed to a civil matter. In that case, the titling process can get murky.

Did the OP get screwed? It sounds like it. But to me it also sounds like someone was trying to get out of a sketchy situation where they ended up with a bike that was part of a civil disagreement.

All that being said, it's absolutely possible LE just did what they had to do based on the information they were sold by whoever was trying to clean their hands of it.

That’s what confuses me. How did the bike roll off the showroom floor without any paperwork? Maybe I missed it but seems weird. Was it stolen from the dealership? Did this Shawn character break in and steal it?

If it’s stolen, it’s stolen and recorded as such on the police database. 

Whether an insurance claim is made, is irrelevant.

What if there is no insurance cover to claim from? It doesn’t mean it’s NOT stolen..

In California the VIN should show you any liens, past due registration, title status, and legal status.

Firstly, I hope I don’t come across as skirting around any questions. As I’m sure you can understand, I don’t know everything about the case, but I am slowly getting more and more information as I go along. 

Yes, to me also, it’s insane that somebody would try to steal a Stark being that it’s really the only dirt bike that can be traceable via its electronics. Unfortunately, as I only owned one for a couple of hours, I’m not at all familiar with how that system works and what would make it so it couldn’t be traced. Connected to Wi-Fi at his shop maybe allows it to be turned on without GPS tracking? I don’t know. 🤷 

So far I found out that it was an Asian guy (not Shawn) in his 20s that “purchased” the bike but had also hit five other dealerships during the same time so he was probably pretty well versed on how to get to walk out of the store with a brand new bike. Maybe someones “head rolled” for it, again, I don’t know.
 

And as for me handing the bike back without having every bit of information, once I have police standing in front of me ready to take a report along with the GM at a major dealership, I tend to believe that what they’re telling me is the truth. I guess I was just raised to respect and cooperate with that kind of stuff.  
Hopefully this clears some stuff up for you guys. I’m sure today will be another day filled with more information and wild stories… I will keep you posted!

Man I understand where you're coming from with what you're saying about standing in front of the cops and the GM, BUT it very well still could have been a civil matter and they could NOT force your to forfeit the bike.

I was in law enforcement for many many years, and I'll be the first to admit some cops just don't know the law and the civil side well enough to mediate that situation well. The GM is telling them one thing and they are trying to solve the problem.

From the outside looking in, this LOOKS civil to me between the original dealer and the "Asian guy" you talk about. If he walked in that dealer during normal business hours and then walked out with a bike, the chances of it being criminal and not civil are very very low. It MIGHT be able to be reported as embezzled (still low and there are specific things that need to be met for this one), but the chances of it being reported and entered into the system as STOLEN are super low.

I'm not saying you did anything wrong here, but man this is not a black and white stolen vehicle case at all. Not even close.

Thanks for the response, that’s definitely some interesting aspects for me have more knowledge of. Unfortunately, obviously the Asian guy is nowhere to be found and used fake everything to get the bike so yes, the easiest way was for me to return the bike to them, sadly then making me the only victim in this whole thing. 

I do hold out some hope that something good will come of all this and I will of course be moving forward with a lawsuit against Shawn and his business. There seems to be so much “gray area” in this that everyone seems a little confused as to how best to handle it. Hoping to have some good news at some point soon. 🤞🏻

I fell like this Shawn guy figured out he just got duped (or was in on it) and tried to pass it off onto some else before he had to eat it. The whole part about him not fully activating it tells me he knew something!!

That gray area you mention is this world between criminal and civil, and unfortunately it makes everything more complicated. 

Even someone with the knowledge I have would have a difficult time keeping possession of that bike once law enforcement is involved, because regardless of "right or wrong" you're going to get listed in a report somewhere and nobody wants that. 

It's a crappy situation all around and I hope you get some sort of positive resolution.

Just for the record I do appreciate your honesty about giving up the bike. I am sure not knowing the situation or the laws being told it was contraband could push a guy.

It's not OK. I'm just saying that even if he didn't know it was stolen, knowing that he may have to come up with money that he doesn't have can cause people to avoid the situation.

If I am understanding what happened- The bike wasn’t stolen per say, but the dealer was scammed into selling the bike to some Asian guy who paid with some sort of fake funds or fake financing. Sounds like fraud…

Then this guy sells the bike to some guy named Shawn, who may or may not have known what happened, but again the bike wasn’t stolen (in the traditional sense) and resold it. 

Confronted by police I am sure most all of us would give the bike, but looking back maybe you should have refused.
