Just heard a nightmare tale from a friend about a lawsuit at one of the local tracks I-5 MX ... aka Gorman ( in Calif. ).
Apparently a young kid ( but an experienced racer hoping to go the whole route ) crashed off of a small jump and had a catastrophic injury. From what I heard the parents retained a shark that has sued practically everyone and their 3rd cousin over this.
Didn't sound like there was any neglect whatsoever on the track's part. A lot of it sounded familiar from the Rich Cain affair ( trying to deny signing the waiver, unsafe jump design, etc. ).
Anyone know more about it or the future of the track? I'd hate to see that track go away.

No one has heard about this? Apparently the list of people/companies being sued is quite extensive.

A couple months ago I got hurt bad REAL BAD out at Perris spent the weekend in the hospital with a list of injuries that would take forever to list ...today I still havent ridden and keep getting more and more problems as a result ...hopefully one day I will be able to ride again but im not sure. My point is that the jump I crashed on was far from safe and pretty beat up from all the pro's riding that day ....there is no one to blame for my accident, I rode ther and got hurt doing a dangerous sport and not one time to this day have I considered suing the track over this....it's just sad to hear people can find lawyers and judges that will rule in their favor thus closing down our already scarce riding areas
Sue yourself for participating in a dangerous activity and leave the tracks to the people that assume the risk...
This shit drives me crazy..

Rider Error.
Operator trouble.
The eubanks family are the last people to ever sue anyone over anything, theyre hardcore moto people (dad has been into mx all his life, mom was a scorekeeper and promoter) justin was an upcoming pro (just turned intermediate and on team green kawasaki) and is now vegtablized.. cant talk/walk and is in a wheelchair..
I don't claim to have all the facts on this ... but from what I was told they hired an extremely aggressive attorney ... who basically sued everyone in sight ... and then some. People that had nothing whatsoever to do with it.
Do you know more about it? It's terrible that he had such a bad crash but it sounds like he was a very experienced rider. Short of some glaring neglect by the track owner, what is there to sue over?
But, we choose to ride.

"Some of the rumors are true and there is a very good chance the track will be closed starting Thursday May 28, 2009
Daphne Greene is someone who can influence this decision.
Her email is dgreene@parks.ca.gov
Please take a minute out of your busy day to write to her and encourage her to keep the track open."
I suppose the Reynard crash when the equipment operate entered the track (I believe that's the story) was one of the few times I think someone was negligent.
Why am I emailing her? What are the issues?
What actually happened?
Who is she?
What is her role? Etc, etc.
If I had to guess I imagine she is with the State Parks Dept and is looking to pull the permit of the track operator? But I'd rather not guess at all this if I am going to write her. It's always more effective when one has the basic facts straight.
Link didn't work for me.
The toughest part of the sport is hearing news like this.
achilles tendon. i built my track i ride my track and i am gonna sue my ass off i
am negligent i didnot twist my right hand hard enough bastard where is my lawyer.
oh and the throttel stuck half wide open and i wanted one more ride on a worn tire
and i have a scratch on my fender damn i am gonna get rich if i get a good lawyer.
Today is the last day that the I-5 MX track is scheduled to be open. From what I understand, they finally secure insurance to keep it open and now the State of California is not willing to renew the lease. This delay could mean two or more years of the track being closed.

Everyone I am e-mailing is involved the MC industry and I don’t have to tell how hard it is to get new areas to ride. Let’s try to keep the ones we have active.
"Shit happens."
A few years ago I5MX was amazing, more recently the best description I can give it is "Shitbox." No flaggers, little to no track prep or maintenance. Nice fancy garage and toilets though, they even have gatorade/soda machines that steal your money.
I live 30minutes up the road and don't care either way, Id rather drive past it and ride somewhere else, but for the bigger picture I hope the track stays in place. Any track closure isn't good for the sport in general.
