You should have taken a picture of the picture and then drew the picture you took of the picture. Problem solved.
I live in Ireland, going to supercross n the USA is not an option for me . Even if it was I d never be allowed be in field to take a photo . Plus flying out to the US taking a photo and spending a week to draw it, all for 200$ , yea that make s sense.!! I should have looked up further who took the photo and asked , I ve apologised already a few time s. So stop being a dick about it , it was not your photo

To people asking about buying the drawing . I am after swoping the drawing for some goggles. As I stated in my first post , I do art of motocross out of the love of the sport , I make feck all money from motocross art ( I can do 6 portraits for one bike drawing) ,and any money I do make goes straight back into motocross company's. I ve deff learnt my lesson when it comes to what photos I will use in the future.

If anyone would like a commission I d be happy to do it for them , as it combines the two lives of my life mx and art . So just get in touch.

I apologise again to guy b for use of his photo, it's an epic photo,

Man I think he's on your side, joking that if you took a photo of the original picture then did your drawing based off your photo then you'd be free from any copyright cause it was your photo haha

Musicians and bands cover songs that are not their own durning live performances, without permission (which is not copyright infringement). I don't see this as being any different.

Kid feels horrible.

You're a good dude, I think most realize you never intended to "use" someone else for person gain. Don't have a guilty conscience over this and if anything just take it for a learning experience.

Hope GuyB get's back to you on your offer, think this could be very successful especially if he can get the rider to help with the signature.

I am after swoping the drawing for some air brakes. But if you wanted a drawing of yourself or a certain rider done and you have any spare parts gear goggles etc I'd do a swop with you no bother .give me a shout on brianandersonart@gmail.com

Cannot believe the flame posts on this thread, I get the butt hurt copyright infringement thoughts but holy shit the level some posters take it is just crazy. The poor guy (kid?) apologized many times and kept getting shit.

Very selfless offer of your obvious talent to create something good from something that turned into an odd thread with no bad intentions on your part.

Awesome piece of real art! The whole photographer getting butthurt about something like this ended when digital cameras that can shoot of hundreds of images in a minute became the go to. Anyone posting here could go point a digital camera at something while firing off hundreds of shots a minute and find a bunch of good pics. The in famous Rc whip pic was a one in a life grab from someone who couldn't shoot hundreds of photos a minute with a digital camera. Shit I have a friend up here that has been selling ocean and sunset pics he took off of his outdated iphone on ebay for ridiculous amonts of money.

Well, if steps aren't taken to really protect your work, it seems it's fair game.

Look at Getty. Everything they have has their logo watermarked all over it.
YouTube has artists pulling videos off it all the time, usually when under threat from some lawyer.
Seems there is recourse to recover monies or profit when a guy has his stuff ripped off.
If he thinks it's worth it.

A kid looking for a set of goggles, eh.

But I know if I were GuyB, I'd be looking for a lawyer to accept 33% of all proceeds he could prove the T-shirt guy
made off his images.

Then again, does GuyB actually own those pics? If he's an employee, and those pics were taken when he was working for someone else, who actually owns those pics?

In future I will do as u say dig into who took it and is it copywrited. And ask. Thanks for the tip for finding out.
No worries dude – just trying to look out for my fellow art minded folks.

As one last bit of advice, always assume the the reference is copyrighted and always assume the person who created the reference is going to find it. You never know what the guy you sold the drawing to may do with it / where it will end up and if anyone comes knocking at his door you can be sure he'll point them in your direction.

Other than that, keep it up. It's got potential for sure.
