attendance and viewership. do you really care that much? If so, prove it.

It's no wonder this whole process took 8 months if the parties involved were communicating via posted letters back and fourth across the Atlantic Grinning

Hey Dingman, you do what's right, correct the punishment and Stewart serves the appropriate amount of time for a suspension?

I'll renew my membership, otherwise, not happening..

So what if the AMA does a drug test on the FIM officials and if they test positive for anything they don't have a TUE for, the AMA can ban the FIM from 2015 SX and JS7 RIDES!!!

I agree with everyone else that the applied penalty was too harsh but I think the AMA are being a bit hopeful if they expect Stewart to get cleared to race from A1 onwards. He still needs a penalty. Maybe not an effective whole year, but if he is allowed to line up for A1 then there has really been no penalty apart from Monster Cup. Yes, I know he missed 4 rounds of the outdoors but according to what I read, there was no grounds to remove him from the motocross series.

Yeah, because taking all his wins from last season, along with 2nd all time on the wins list, is no penalty at all.

The AMA is only concerned with the loss in revenue over the decision. They dont seem to give a shit about anything else off-road related and have a pretty good track record of clusterfucking things themselves.

FTE should chime in and clarify in more eloquent terms, but those 2 words are classic lawyer speak for "you fucked this all up- on purpose, and we are going to turn around and shove it up your ass...".

Good for the AMA, stand up for your riders for a change. Stewart screwed up, but this should have been resolved 6 months ago. The FIM and WADA circle jerk for months and months was "arbitrary and capricious".

And GuyB gets the award for "Scoop story of the year"..... The TMZ of the moto world?

Do you think JS7 will be crying over last season if he was allowed to race at A1?

Great point, except that's not what happened! All races previous, where the wins were, to the failed test are untouched.

"... Mr Stewart is disqualified from all competitions in which he participated (including the four rounds of the 2014 national Lucas Oil AMA Pro Motocross Series) *subsequent* to the collection of the sample (12 April 2014) "

You are correct. Regardless, he has already been penalized for the paperwork infraction, and the delay of the FIM to resolve this matter is beyond unreasonable.

In fact, I think "arbitrary and capricious" describes it quite nicely.

I'd say they're wrong too. How can you complain something that took 8 months to deliberate over is anything like random or sudden.

I'm proud to be an AMA member right now, good on them for standing up for what's right. I have a feeling this ruling, as it is, won't stand for very long. . .

Red Bull... now is the time to step up and throw your considerable "weight" around. They owe James Stewart to step up and assist in fighting these arbitrary sanctions.

The only thing that the FIM has proven by these actions is that their entire organization is unprofessional, disorganized and a menace to the advancement of our sport.

The FIM's actions shouldn't surprise me based upon their history of influence peddling and underhanded business practices (e.g. Luongo continued stranglehold of MXGP and manipulation of it's governing body.)

Arbitrary and capricious, is acting in bad faith.

Arbitrary and Capricious means doing something according to one’s will or caprice and therefore conveying a notion of a tendency to abuse the possession of power.

In U.S this is one of the basic standards for review of appeals. Under the "arbitrary and capricious" standard, the finding of a lower court will not be disturbed unless it has no reasonable basis. When a judge makes a decision without reasonable grounds or adequate consideration of the circumstances, it is said to be arbitrary and capricious and can be invalidated by an appellate court on that ground. In other words there should be absence of a rational connection between the facts found and the choice made. There should be a clear error of judgment; an action not based upon consideration of relevant factors and so is arbitrary, capricious, an abuse of discretion or otherwise not in accordance with law or if it was taken without observance of procedure required by law. [Natural Resources Defense Council, Inc. v. United States EPA, 966 F.2d 1292, 1297 (9th Cir. 1992)] There is, however, no set standard for what constitutes an arbitrary and capricious decision.

Can someone remind me on why the FIM is tied to AMERICAN SUPERCROSS?

I know it's been that way for a few years, was it because of the Toronto Round?
I'm sure there is a signed contract but do they add to purse money? Yep I'm sure that will get a bunch of "LOL's...

If the AMA was smart they should dump them as all this is doing is hurting an American Sport created on a cocktail napkin and raced first in the Los Angeles Coliseum.

major props to Dingman, now he has to finish the business!

This is a prime example of why I haven't carried an AMA card in over 20 years.

MAN!!!....That fucking letter is awesome!!

Pretty proud of the AMA to write something up like that! I'm also glad to see that they think the `6 month suspension is pure bullshit!

I really hope something comes out of this mess.

WOW!! ( again )......impressive letter!

G-man....I would like to know this too. I do believe it was because we started doing the Toronto round. " Why " we actually needed it I'm not sure.

It is the by-product of the AMA/Jamsports vs. Clear Chanel fight years ago.
