Seth let the rider get in front of him in the whoops, which was correct, then passed him back. Whether he did it consciously or not it was the right move at the time. No penalty in my non-ama referee mind.

Technically if there was a way to "chose" which lap you wanted as the "last lap" then yes. However, in order for this paradox to exist you would have to get full cooperation from all other competitiors, which seems doubtful.
