Very good chance that when he set his up that it was not as easy as it is now.  I know that when I first looked into it myself in MA it was much more complicated than it is now.   Laws change and things have gotten easier. Doing it online wasn't a thing when I first looked into it.

Well there are the tax benefits from incorporating  and then there are the liability benefits. So could be either ,both or neither. But its a normal thing for racers to have an LLC.

 

   He is for sure spending a ton more than he is making.  Honda pays contingency, and there are a bunch of  brands that  have a contingency like program , or there were the last time I had looked into it.   

The team might require  him having an LLC to ride for them. He might have done it just because other riders did. Many legit reasons .  It might look or sound suspicious because You guys are looking for it to be.  

 

Some riders  buy their way onto team's. Not saying this is the case with Keefer. But there are riders who have somebody willing to pay to get them on the team. And in that case the person funding the ride may have legit reasons for wanting an LLC.

I went S Corp for payroll reasons, and I didn’t own any real estate at the time. If I had known real estate law back then, I’d of gone LLC.

It could be a requirement by the team he is on.  The team's insurance company may require it  . Employee's have to be covered by workers comp insurance.   Something that just may be impossible to do for a motocrosser, or could be insanely expensive. As the business owner he doesn't need workers comp. The team might get a better rate on their insurance if they only use subcontractors who are LLC's . So as a result they require riders to form one. 

 

Or he could just have thought it was the best way to go about doing things. There doesn't have to be a reason that makes sense to anybody but him. It doesn't have to be the only way of doing something to have done something that way.   

 

But I don't think that was the issue, they just hadn't gotten the proper forms in. It was speculation by many that he might have had something delay him like forming an LLC.  Or whatever. But in the end he didn't file the form. I didn't notice if  they said in the statement if he has  an LLC or is a sole proprietor. But he has to be one or the other to ride for a team.  I remember hearing something on a podcast talking about the insurance being a reason that no riders are team employee's . I'm sure there are many subcontractors on here who found out they couldn't perform work as a sub until they have a legal business setup.

All that happened is those brain surgeons, the Queefers were too dumb to fill out a couple of rudimentary forms, and then that old creep Qris Queefer went on a podcast and said riders weren't getting paid. No conspiracy. No dastedly behaviour from MX Sports or the AMA. Just pea-brained Queefers.

Correct tax deductions is why they do it and doing it correctly they can deduct every penny they spend and also deduct every mile they drive.

Oh yeah the  list is endless.  If they start making real good money . Buy land & say you  use for for training even if you don’t .  Certain amount of  money into 401k  & ira,s.  Your van & parts for it.  The object is to show very little profit .  Your health insurance is much cheaper then too.

It was a mistake and at the end of the day noone got hurt. Seems like we should tone down the insults a bit and go with something more lighthearted, how about PNK (Pro National Kris)?

MxSports pays the riders but it's the riders responsibility to supply the correct tax and banking information to MXSports...the change that has been made because of this is that they will now teach these kids how to submit the proper paper work during the combines.
