Look - I agree quieter bikes will help our cause - but I am a realist....

The idea that if bikes were just a little bit quieter or even a whole lot quieter, we would cure the problem of losing our riding areas is just plain not dealing with reality.

Bikes will NEVER be quiet enough.

It only takes one person to complain and there will ALWAYS be that one person.

So how do we think ahead a little? Why are motorcyclists so willing to lay down and not fight for their rights?

Collectively, as a whole, outside of the Blue ribbon coalition who do we as off-roaders turn to to protect our rights?

NO ONE!!!!

Off- roading is a multi-billion dollar industry and the best we can come up with is "If our bikes were just quieter" or the lame arguing amongst ourselves that four strokes are louder than two strokes? Why don't we organize and create a legal group to protect our rights like just about every other special interest group trying to get their piece of the pie?

It's obvious that four strokes are here to stay. Arguing about how the sound travels or how much louder they are vs two strokes won't help a bit. \we have just as much right to enjoy our recreation as all the other forms of recreation that make noise - attending a concert, drag race, road race, rally race, boat race, jet skiing, snow mobiling, air show, swamp race, tractor pull, monster truck event and on and on and on...

If we don't get serious about protecting our rights and use the judicial process to create/protect existing laws and ordinances that allow us as motorcycle riders to enjoy our sport, all the quiet bikes in the world won't help...

Quieter bikes is just a band aid fix to a much bigger and complex issue, that for whatever reason, people are ignoring...

Sound is almost always the excuse they use, but you, like a lot of people have focused so much on that as a single issue that you have bought into the lie that if we just had quieter bikes people wouldn't complain.

Sound is just an excuse used, it is not the issue in and of itself that if 'Cured" will stop the attack on our rights to ride.and use our property as we wish.

My point is that given someone will always complain, regardless of how quiet our bikes are - how will making quieter bikes solve the issue?

It won't. We are chasing the dragon with that one. It will only satisfy some of the cases. We need to think much bigger than that and work on the fix that is more effective than just quieter bikes.

That fix can be found by us protecting our rights to make sound.

I do not see our rights to make sound being exclusive to having quieter bikes, but if I were to chose the one that would give us the greatest success in keeping our riding areas open, it would, by far be our rights to make sound, not the need to have quieter bikes.

I'd like to mention that things I have posted about sound have nothing to do with the owners of the track or the track itself. They are awesome people and the track is badazz as they come. I may have came across that I am bashing the owners or the track. I am not. I am bashing our whole industry, because it keeps walking into the wall, over and over. How many tracks does it take to screw in a light bulb, oh wait, that was something else... Seriously, just waiting for responses on what case does that 1 person have, who doesn't like us that lives a mile away from a track, when he goes into court? What is the case? How does he win it?

Complaints and winning a court case are so different. Umm, and you don't have a right to make sound. Why do you think loud stereos get in trouble with the law? I got the cops called on my TV being too loud in my apartment once. Loud wins court cases, complaining because we are on our own land and that person doesn't like it, doesn't.

that was the local news on the lift filming for their story. I'm sure it wasn't the track owner that called them out there. They set up on the lady's land

Good question. But it probably doesn't matter. If he's a litigator, then this guy knows how to manipulate the rules of civil procedure such that the track owners simply won't be able stay in the game because it will demand far too much money and time. Interrogatories, depositions, hearings, resets, and so on. It doesn't take much to be completely overwhelmed.

Now, on the other hand, if the Texas track owners (Miller, Clingfost, etc) would band together along with the riding community to help these folks fund their defense, they *could* win out. But I'm not sure everyone gets along so well to unify in such a manner. The AMA is also a resource. And, despite popular notions about them, they can be a big help with this kind of thing..

thats all true. I just wonder if hes trying to get a temporary injunction or what. threatening patrons to "include them in the lawsuit" is shady.



I just wonder if the lawyer is really willing to post a bond to gamble on shutting down a viable business (assuming thats what it is)

120db drops down to 80db in 1000 ft. Their are 5280 feet in a mile at every 1000 ft the db level would drop another 40db (not taking into account anything that would block sound ie trees) so at 80db to the edge of the property the sound would drop to 40db or less in 1000 ft. or 4280 ft (est) away from this lawyers property. I would argue that on a clear day this guy is lucky at best to hear the track.

Sorry, but sounds are not all equal. Compare a 1000hz at 120db and then compare a 100hz at 120db and I guarantee the 100hz to the "EAR" traveled 10 times as far. db wise "measured" may be the same, but the sound in your ears is not.

I say the track needs to tell all riders that they require offroad silencers, that meet the same standards as the GNCC. See how that goes, I'd bet then you could say the guy will no longer hear any sound at all from his house. Machine sound level cannot exceed 99 dbs, I'd say at full throttle. I think the mx pipes out there now are somewhere around 120db full throttle? Someone can correct that number. There will be some that say, but no one will come and the track will have to close. Umm, well if changes are made riders may adapt, riders usually will change anything if they are given the choice to ride or not ride. This track is nice enough that riders will still come in my opinion. Best sand track around. As it stands the way it is, most likely if left alone with loudness, it will as a guarantee beclosed down for them eventually.

Which way does the wind blow? The wind has a lot to do with sound travel. If he shut it down I would leave the track and buy some pigs. Do it legal(pig farm)so he cant shut it down and let him get a smell of his own $%#@. When he is gone open the track back up and keep the pigs.

I can't find any specific information on steps the neighbor has taken to this point, but in Texas there is a cause of action for private nuisance. The neighbor has to show:



1. that he has a private interest in land,

2. that the track owner interfered with or invaded the neighbor's interest by conduct that was either negligent, intentional and unreasonable, or abnormal and out of place in its surroundings.

3. the track owner's conduct resulted in a condition that substantially interfered with the neighbor's private use and enjoyment of the land, and

4. The nuisance caused injury to the neighbor (in this case, an assault on his senses due to offense or a loss of peace of mind).



I'm sure he is seeking injuctive relief to shut the track down as well, not just damages.








Edit: I just read that the neighbors were apparently refused a TRO and failed in their attempt to get a temporary injunction. That's good news for the track, as it could give an idea of the Judge's attitude toward the case.

I live in Palestine, 15 miles away, and grew up here. Doni and Danielle are great people, have made many friends here, and are very active in the Montalba community. The track is located in the county, there is no zoning. The attorney (Robert Thackston) filed a nuisance lawsuit against the track. He tried to get an injunction to stop operations until the civil trial, but the judge ruled in Doni's favor. We can discuss decibel readings 'till the cows come home, but in this case, because of the distance of the attorney's property, I believe that will be a somewhat mute point, although noise is what started this action. I also believe that it will come down to property owners rights and how long the track has been in business (4+ yrs). Remember, it is in rural east Texas and there will be some proud property owners on the jury.

In 2010 I owned a DRZ, XR and currently own a CRF, so who cares. I also said, "2 strokes aren't immuned to it. Sure 4 strokes carry further. tell me a 4 stroke mx bike isn't louder than my 2 strokes? Which I rode at that track we speak of with. Mine all are within the offroad style racing limits. Which is currently which type of riding I've started going towards.

If you are trying to prove your point in court, which I was referring to in that quote you posted, you use the loudest bike you can find and go rev it in court. The 250F is the loudest by far. It revs further than the 450F's and more people open their exhausts because of lack of power. I have seen many 450F's with stock exhaust. Not so much with 250F's.

Does the case have a single Plaintiff (the attorney/neighbor), or did the other neighbors join in the suit?



Nevermind, just found it. Over 15 plaintiffs/landowners, including the next door neighbor. This isn't just one rogue lawyer trying to shut down a track, it's the surrounding community.

Thackston has gotten some nearby landowners to join in the suit but many are just land owners and don't even live in Texas. He (Thackston) will have a very difficult time out here being he has the "Rich Boy" attitude and the track was there before atty. There are also some issues with NO ONE complaining until atty got involved. Judge already has him pegged, and folks in and around town like Doni and family. Atty wanted a jury trial ASAP but when the judge denied the TRO atty said he needed until june to prepare.
Most folks out here leave well enough alone, so chances are atty is going to lose this one.
There are some other track owners involved. Again, when down at Pure MX hit a local store or the catfish place and tell them you were out riding at the track.
Just another point, this is not his primary residence. this atty lives in Dallas with his wife in a 3 mil home.

Sure we have to do what we can regarding the sound issue, but a failure to understand guys like this all but ensures we will never win the battle. The only way to beat down assholes like this guy is with the very system he is trying to use to defeat us - the judicial system.



The simpleton approach of just making quieter bikes will doom us against guys like this. We have to assert our rights in the judicial system, loudly let our elected officials know what we want and expect from them with regards to our right to ride and make noise on our own private land and that those very same elected officials will be held accountable come election time. We not only have to defend our rights, we should be proactive in creating legislation and city ordinances that protect our rights.



Or I guess we could just make quieter bikes and hope for the best...

X2. There are free legal services, depending on where the track is. If it does end up costing more to keep it open, or even closes, then it may be time to sue for fraud based on the permits that were approved by the county, as well as the cost of the permits. There may also be damages in lost of income if the park closes, since the owners complied with all permits and known requirements at the time. This may entice a legal service that only requires payment if the case is won.

What about the other 15 Plaintiffs? The news article cited has an interview with the immediate neighbor, and she is praying that the track gets closed down because of the noise. Don't let the fact that one of the over 15 Plaintiffs is a lawyer by profession cloud the fact that this is an issue with the entire surrounding community, not one rogue individual.

Obviously more needs to be done than just quiet down the bikes, but lobbying elected officials and bringing about change on the highest levels takes years. What do we do in the meantime?

Sure we have to do what we can regarding the sound issue, but a failure to understand guys like this all but ensures we will never win the battle. The only way to beat down assholes like this guy is with the very system he is trying to use to defeat us - the judicial system.



The simpleton approach of just making quieter bikes will doom us against guys like this. We have to assert our rights in the judicial system, loudly let our elected officials know what we want and expect from them with regards to our right to ride and make noise on our own private land and that those very same elected officials will be held accountable come election time. We not only have to defend our rights, we should be proactive in creating legislation and city ordinances that protect our rights.



Or I guess we could just make quieter bikes and hope for the best...

Don't let the fact that one of the over 15 Plaintiffs is a lawyer by profession cloud the fact that this is an issue with the entire surrounding community, not one rogue individual.

Obviously more needs to be done than just quiet down the bikes, but lobbying elected officials and bringing about change on the highest levels takes years. What do we do in the meantime?

The thing is, while the lawyer is the one who filed this petition, because he knows the ins and outs of doing it. Most likely those other 14 people had just not made a point to file a complaint. But since it was being done, they jumped on board. Doesn't mean they wanted the track there. Anyone can say noise now is a mute point. But I'm still waiting from ANYONE here to tell the answers to my questions. If bikes were made quiet like I am proposing. I say give out fliers to riders and post signs, that they will start conducting sound tests. They have 3 months to comply etc. Give them all kinds of options, new tail pipes, db dawg, packing if they are close etc. Then, take that to court and show the new fence sound ratings. Show the court, they were truely active in quieting down the sound. After that, "when he goes into court what more can the lawyer who now can't hear a noise have for a case? What is the case? How does he win it? " Please, someone answer that. Because like I said, you guys can say city and town folks support these people. I personally like them and their two boys are very nice kids. I just wanna have an answer, to what the lawsuit would say if there is no noise at the lawyers house at all?
