Timing seems relevant….Do you honestly believe the medical staff at a SX could be held more accountable for an injury with zero evidence that it was made worse than a police officer waiting for several kids to be murdered while on video?

I agree with his basic point, that what was winning for Brian in this trail (and the same can be said about the Zing, and Rich Taylor lawsuits)
any 'winning' by the plaintiffs will involve either less service, or more cost for MX riders,
Can you clarify what you mean by point 3? Are you saying feld wanted to take this all the way and win to make a point, or something else?

This sport is scary enough as it is. Everyone is aware of the dangers.
However is it too much to expect proper care from highly trained medical staff, especially at a professional level? What those staff did to Moreau was flat out wrong, regardless of if the injury was purely from the crash or not.
The medical response to Barcia's crash (attended him after 3 business days) shows that there are still massive areas for improvement.
Riders can and should accept the dangers of the sport. But they shouldn't be required to accept sub par medical care (or lack of) in the event of a crash.
People don’t get what else is lost when someone is paralyzed. I always get asked what I think about the whole walking again thing. I just respond with if they had a choice I’d to walk or pee/poop regular again I’m taking the pee/poop option.
I was surprised with how they treated Brian afterwards. Total bs move. You’d also be surprised how many Drs and nurses have no idea about SCI injuries.
Life in a chair isn’t as bad as people think. 21 years as a quad for me. I’ve done more from a wheelchair than most able body people. I play wheelchair rugby, race cars, skydive, water ski and work 40+ hrs a week. It comes down to the specific person. You either sit around and bitch or you move on and deal with it.
Us quads have it harder than paras but the paras seem to bitch more hahaha
It would be cool for FELD/ama to put a rider on some sort of pension plan where a rider would get paid every month for X amount of time if they have a serious injury like getting paralyzed (something very serious) that ends their career. Take care of them and pay them a pension or something for the first 10 years to help them adjust. A lot of these guys get paralyzed and a year later are forgotten about. It’s sad. Hanny said he was struggling before he got his PC ride in 2011 cuz he was terrified of getting paralyzed. Scariest thing about our sport imo.
It's highly unlikely that Feld did not try to settle. . . . this is a normal thing to happen in most every Tort case.
It is more likely that there was an offer that WAS rejected, either it was to low or they felt they could possibly hit a huge payout from a sympathetic jury.
Texting a couple friends that may or may not know the whole truth themselves while saying everyone else reporting is lying doesn't add up.
If you know facts, say them...otherwise you are another keyboard warrior.
It's a sad case but shit happens sometimes. . . .
And if you're feld, of course you're going to deny ever offering a settlement after it's rejected and you then go on to win the case. What's the alternative? You admit that at one point you agreed he deserved to get paid? Not going to happen.

It's a reasonable argument, but I'm guessing plaintiff loses. Getting a new trial under these circumstances is a long shot.
Assuming the Plaintiff's attorneys participated in the preparation of the verdict form, reviewed the final version, and raised no objection at trial, they have an uphill battle.
Only on Vital can you post a legal document and get downvoted.
Best of luck to Brian. I hope it works out in his favor. More importantly, I hope that this eventually leads to better trackside care for all riders.
What this boils down to, if I'm understanding correctly, is that the original questions to the jury asked them to consider whether the defendants caused an aggravated injury before considering whether Brian had suffered an aggravated injury. The argument here is that the jury needs to be able to consider whether there was an aggravated injury and if there is, then consider whether the defendants caused it. As far as the logical order of the questions, it does make sense to consider whether something exists before considering what caused it. I'm not sure that makes it any easier on the plaintiff as he's still in the position of needing to prove that his injuries were worsened over and above what was suffered in the crash by the way he was handled after the crash, and that's going to be difficult.
