I do not disagree. Just posting the screenshot of the lights. I did not see either the cross flag or the flashing lights the first time I watched the video posted above. I had to slow it to .25x before I saw he really never got any red cross flag and that the red lights were flashing.
It's not hard to tell when he started waving it. It's clear as day on video that he puts the yellow down as Seth passes him, period. Go back and watch the broadcast. He was not waving both! And those lights are no where near as visible during a day race. This is exactly Dean's point. The lights do not stand out like in the stadiums. If it's that important for safety, then there should be flaggers as well. I think the rulebook needs to be scrapped and completely re-written. The thing is ambiguous at best.
I hadn't seen this video yet. Hard to argue they were on but when did they come on? That's the answer no one can definitively answer. I'm going by what the rider saw and what his side of the argument is. Had he seen the lights, he would've rolled. Just like at Budds when Deegan and Jo got docked. Seth saw that flag and rolled when the dude in front of him and behind him jumped.

OK here is an idea for a simple warning for the riders that they are about to enter a no jumping Red Cross flag area.
Not every flagger has a Red Cross flag only certain people do but the rest all have a yellow and blue flag.
Give them all a 3rd flag say with a different color to wave before the Red Cross flagger or ….
Now this one is really simple solution …… Take the 2 flags the flaggers already have and cross them for the riders to see earlier. Cross them like the finish line flagger does at the half way of the moto.
Im not saying it was right or wrong but just bad timing on the flaggers timing. I may be wrong but Im pretty sure the flaggers all have some kind of earbuds for listening for instructions? Who ever the official is that tells them waited to long for the flaggers to be ready. They literally had 2 minutes for the leaders to get back there.
You don't have much time to see it in the video but Watch it again. I could see it happening from the stands.
In my screen shot of the video the flagger clearly just dropped the yellow flag to the ground he did not set it down and was just about the start waving the Red Cross flag when Hammaker was next to him. You can barely see the white part of the flag.
This was all bad timing and the wrong call and should be challenged and overturned.
I don't understand the argument about the lights. Yes, Hammaker jumped on lights, but so did Deegan -- why was only the jump Hammaker jumped on enforced?

so my initial question was why are they,not penalized according to the rulebook which says 2 positions and 5 points ..thats not the penalty that was handed out.. why doesnt the ama go by what their own rulebook states

Red Cross violation during race is Position Gained + 5 Championship Points + Purse (2 Pos) is the word for word rule.
If a position was gained as a result of the violation, they take that position (Kitchen) AND they take 5 points (Kitchen and Hammaker). The (2 Pos) seems to refer to the 5 championship points or the purse but I’m not sure exactly what that means.
