Just saw a twitter from Reed as well, seems they not only tried to fine him individually, but all tried to levy a fine against his company that the land is registered under.

The gopher tortoise (gopherus polyphemus) belongs to a group of land tortoises that originated in North America 60 million years ago, thus making it one of the oldest living species.

In Florida gopher tortoises are on the Endangered Species List, categorized as a Threatened Species. This means that their current numbers are dropping but we are not sure exactly how much, several studies presently being conducted on the tortoises are tiring to more accurately answer this question. Their primary reason for being endangered is a loss of habitat. In the past many tortoises were killed either for food, or by people who were trying to kill the rattlesnakes that often share their burrows.

Rule 68A-27.004: The gopher tortoise (Gopherus polyphemus) is hereby declared to be threatened, and shall be afforded the protective provisions specified in this paragraph. No person shall take, attempt to take, pursue, hunt, harass, capture, possess, sell or transport any gopher tortoise or parts thereof or their eggs, or molest, damage, or destroy gopher tortoise burrows, except as authorized by Commission permit or when complying with Commission approved guidelines for specific actions which may impact gopher tortoises and their burrows. A gopher tortoise burrow is a tunnel with a cross-section that closely approximates the shape of a gopher tortoise. Permits will be issued based upon whether issuance would further management plan goals and objectives.

Wildlife Alert Reward program
It is against the law to kill, harass or destroy gopher tortoises, their eggs or burrows. If you suspect a wildlife law violation, report it to the FWC's Wildlife Alert Reward Program at 888-404-FWCC, 24-hours a day or online. You could be eligible for a reward if your information leads to an arrest.

I know we can all make fun of some of these environmental rules and laws. Bottom line is that each case needs to be evaluated on it's own merit/circumstances. None of you guys would be laughing if yer neighbor let a giant septic sewer service company dump a few million metric tons of crap next to your house...think about it. (I have seen this exact thing).

Maybe he thought enforcement of enviro regs was on hold, as long as it's BP it doesn't matter I guess. He just needs a really big mess so the Obama admin wouldn't want anyone to hear about it.

We're still seeing reporters threatened with jail for trying dig on the beach and show oil, selective enforcement is great.

I wasn't for one second trying to imply that the EPA on any level is doing their job correctly...it's a govt agency...what do you expect?

Because of the govt, we still have jobs, and free health care. I wish they could have saved Reed's job at Suzuki though.
