I´m sure they will. I have used countless tubs of Muscle Milk and various other protein powders out there for years. It doesn´t claim to be an energy drink, none of it´s contents are there to simulate an energy drink. It doesn´t matter what the lawyers think: you are comparing apples and oranges, and any good corporate lawyer would toss this away as a bogus claim.
You guys can copy/paste all you want, they are not, and do not claim to be the same or work the same.

You working for Monster? I know Business is Business and all but I'm a core mx fan and as far as I'm concerned anyone suing MX sports or any MX/SX promoter can SMD. At this point we all know KAWboy thinks muscle milk is a energy drink.. We can leave it at that..

Now that the Monster deal is public knowledge, I really hope that MX Sports didn't overcharge Rockstar this year. Now that Rockstar has access to last years Monster deal it could be bad for business.

People need to realize the bigger picture.
Love 'em or hate 'em both are integral parts of the puzzle.
Like water to the tree to make it grow, financial support in anything is key.
Also there's always 2 sides.
Theirs, and theirs!
Like in a divorce, there's claims & counter claims.
In business there's all the same too.
Here there seems to be obviously big money involved.
Here a major player seems wronged by the other major player.
The tale of the tape for me is not to blame.
No one but the real insiders here know what's what.
Even then, in these big money dealings most still don't know, they're simply along for the ride, or part of this or that fold.
It's all on paper to be proved or disproved, and it will.
To bash only shows ignorance.
If there's 1 thing I've learned from all my years in dealing with various contracts, it's not really the length, the amount of paper, the firm, etc., it's the people behind such that matters. Then you'll see the tale of the tape!

Monster on the other hand would want you to purchase thier product to drink before, during and after a work out and they would never want you to purchase muscle milk instead of theirs.

thats what the lawyers will decide......my guess, based on muscle milks own claims is that a judge will rule them an eneergy drink in direct competition with monster!
Unless it's defined in the contract pretty specifically, whether something is an energy drink in the same sense as Monster likely is a fact question that a jury would decide, maybe considering opinions from marketing experts, and not decided by a judge or the lawyers.

So where is DC on this one?? He is usually here to tell us how happy ALL the sponsors are with the new and improved nationals. Seems the biggest sponsor isn't so happy about right now...

I'm not a lawyer or pretend to be one, but like someone else said, when the biggest sponsor the outdoors has decides to sue them, well that don't look good.

I remember someone on here claiming DC kisses to much sponsor ass. You know like when the Monster sign at Glen Helen last year?? Guess that person was wrong in assuming he kisses Monsters ass.. Wink

Muscle milk isn´t an energy drink, it´s a recovery drink for better energy and recovery for your next worksout. Monster, Red Bull etc are for immediate energy when you are tired or need a quick fix, it has nothing to do with rebuilding the body like Mucle Milk.

Think of it as:
Monster = "coffee"
Muscle Milk = "food"
How does anybody view these the same?
The stuff (muscle milk) works well and when they get the lead out I'll start using it again.
Energy drinks are adult overpriced Mt Dew.

Not true. My sole source of energy, (carbs, and fats), comes from MM.

So while not something that will jack you up artificially like drugs, ie Caffeine, , from a nutritional standpoint, it could be considered an energy drink.

You can get carbs and fats from plain 'ol whole milk. That doesn't make milk an energy drink.



The central ingredient of energy drinks is caffeine. Milk doesn't contain caffeine.

Im so used to seeing monster stuff when it comes to moto that I dont even recodnize the shit anymore. Its like fat chicks in the mall, or mexicans in eastern washington.
Its cool that lucas is the main sponsor of the series. I would definatley think about putting that shit in my bike before riding than drinking a monster. Shit I dont even drink that stuff when its offered to me for free.

Trip: You are just taking cheap shots, shame on you, at someone who has done more for motocross than you ever will.
How can you expect DC to come on here and discuss this issue as you know full well his position at MX Sports.
Hope this can be settled out of court in a gentlemanly manner for all involved.

This sure seems like some good ol' bridge burning stuff to me.

I can't see this doing Monster any good even if they win or get a decent settlement - the pool of potential future contract partners for them has to be diminishing since their legal department has gone all trigger happy. That shit scares people away...

A COMPLETE HYPOTHETICAL FOR FTE OR ANY LAWYER

Could it be possible, keeping in mind the other suit with Pro Circuit v. AMG Crown (which involves Monster) and what I am getting the feeling is a tip of the iceberg with these suits, that this is all a set up to eventually pile everything onto AMG Crown?
For example, is it possible that AMG made other agreements, implied, verbal or written, that brought other issues into this, such as this suit and whether Muscle Milk is or isn't an energy drink and therefore a breach of contract?
Would someone like Monster need to bring suit on one issue/group in order to open the door to another plaintiff, for use as a matter of discovery, per se?

Wow- that seems questionable. I like beer as much as the next guy, but getting a bunch of kids hooked on a beverage and then introducing an alchoholic version seems a little odd.
That would be like Coca Cola coming out with Coke beer.
I occasionally drink that Sparks stuff, which has alcohol, but the government made them remove the caffeine because it was too much like an energy drink.
