Now, this is my experience in PA. I don’t know what the state laws are wherever this took place. Will Smith slapped Chris Rock. That would most likely entail harassment as opposed to simple assault. But regardless, without Chris Rock wishing to pursue appropriate charges I can guarantee you police won’t make an arrest. The only charge they could possibly go for without victim cooperation is disorderly conduct.
Some of you are putting way too much thought into this. Will Smith is a bonehead who did something really stupid. But let’s be real here… He slapped Chris Rock. He didn’t beat him to a pulp or even get a few good strikes in on him. He slapped him and walked away while cussing up a storm. That’s what it is and end of story. If Rock doesn’t wanna pursue charges then Smith will continue to be blasted in the media and on social media. Eventually it will all go away and it’ll be an afterthought.
A fight I got into years ago at a bar , where the state pressed charges against the guy when I refused too. He used what they called a " deadly weapon " ( brass knuckles ). They arrested him and he spent 6 months in jail. Long story , but even though I beat the shit out of the guy , it ruined his life , to the point where he took his own life. There are people on this board that can testify what I'm saying is true.
I'm trying to say , that sometimes it's out of the " victims " hands once the state gets involved. And Agn , I know your law enforcement background. Just telling you what happened in my experience.
But like I said, every state is different. I’m sure in Oregon the 3 levels aren’t even called harassment, simple and aggravated. I guess all I’m trying to say is a slap is literally the lowest level of “assault” you can get. There are people here acting like he damn near killed Rock.
Big Lenny, I have no doubt the DA can pick up charges in California. I can tell you right now it would be career suicide for him especially if he over charged Smith because of media attention. If he charged him with anything more than the lowest level of assault (whatever it may be called in CA) then he’s done. I would sincerely hope no DA is dumb enough to even go down that road unless Chris Rock changes his mind about wanting charges. Then all bets are off and he gets charged appropriately (which is the lowest level of assault).

What the Desk Officer wanted me to know was that he had the personal contacts of over 4000 Hollywood actors, producers, directors, financiers and he could contact them for anything they wanted. That was his take away.

We went to see Chris Rock and Dave Chappelle last night. 3rd row seats. Both were as great live as you’d expect them to be. Both had hilarious bits about the slap and Dave’s being attacked on stage.
He should be banned from all award shows for life.
