This may or may not apply to Dungey, if this rumor has any truth ... but the absolute first thing you have to have in order to SUE is MONEY, forget the evidence!! The Chino Fairgrounds is next door to Suzuki and Roger DeCoster's motocross and Yoshimura road racing teams. The motocross track that had started and WAS UNDER CONSTRUCTION at Chino Fair is not there because of MONEY. The promoter and developer, that has a contract with the Chino Fair for a motocross track, but amazingly enough has never received SUPPORT from the MX INDUSTRY and very little from the MX COMMUNITY and NONE from SUZUKI !!! Suzuki said they had NO MONEY available to sponsor a track that would literally be 50 yards away! The developers lawsuit against the Chino Fair is still in progress, unfortunately, financially breaking the developer suing the giant (Chino Fair) with the money to just stall, play games, etc., until the money RUNS OUT... not because Chino is in the right what-so-ever!!! The CHINO track might become known as "THE MX TRACK CLOSEST TO HOME (Orange County and surrounding areas) THAT WASN'T!!! We all hear the WHINING about tracks being closed down and pushed further and further out... but when somebody decides to do something about it and takes the initiative themselves, by themselves all the way thru the planning, approval and negotiating process, now apparently all the way thru the LAWSUIT... one might say to the WHINERS, "STOP your fucking whining!"

Suzuki isn't stupid, when any corporation with half a brain cell hires a championship caliber rider you can be dammed sure they calculated how much they would potentially have to pay him in the "worst case" scenario he wins everything and gets maximum bonuses for the year. Suzuki may even be insured on this. Whatever you may think, the actuarial and accounting folks there aren't stupid and they surely had this situation in mind when his contract was laid out.

Unless American Suzuki goes BK Ryan will get his money eventually I hope.

Question is if the team is still around next year, would YOU ride for them?

If they stiffed their superstar imagine what they must do to the lower level team guys like Stroupe and Moss.

I hope this isn't true, but I don't think bauer would post it just based on rumours.

If you are suing some broke asshole, yeah good luck getting your money(judgements aren't worth the paper they are printed on), but suing a major corporation that has assets and cash flow that you entered into a binding contract with and they didn't perform, call any attorney in the phone book and I can guarantee that they would take the case in a nano second.

However I doubt Dungey will not get paid, maybe a slow pay but he will get paid. If the rumor is true.

akin to writing checks your ass can't cash. Suzuki has THE weakest balance sheet of the Japanese big 4 four,-by far. This is not good for Roger D & our sport.
Btw, Kawa and Honda have the deepest pockets, and will probably showcase that next season.

Corporations frequently renegotiate contractual terms & conditions. It would pose a serious breach if Suzuki simply stopped paying bonuses. A novice legal team would recommend that Suzuki begin good faith negotiations prior to delaying payment (if terms were not already outlined in the agreement).

Question: Does American Suzuki "own" the Dungey agreement? If so, it may be American Suzuki, and not the corporate offices in Japan, that are facing a cash flow crisis. American Suzuki may exist as a subsidiary, liable for its own debts, including contractual obligations. Not sure if they could file Chpt 11 independently, unless Suzuki Motor Corp does not have ultimate financial responsibility for the entire corporation.

My understanding was that the outside sponsors pay most of the and costs of running the team (i.e. Makita) and that the manufacturers for budgetary reasons always take out a Lloyds's Of London insurance policy to pay the win bonuses.

It's not like large companies just stick millions of extra dollars in their budgets IN CASE their rider wins the championship. They have a budget and they use all of that but just that.
