When your riding on state owned property they can make whatever laws/regulations they want. Not sure anyone here has the money to fight the state of CA with a personal lawyer lol.
People who bought 22+ knew there was a risk with registration. This subject has been talked about and plastered on many forums.
Fact is 2021's are gold in CA due to the new law.
I am thinking of the Chevron doctrine and the fact that nobody in CARB is an elected official. Saying they do not have legal standing is somewhat inacccurate, I suppose.
It is my opinion that CARB should not have the regulatory authority to provide standards which become de-facto laws.

I imagine those rules will get enforced about as much as the “No 2 stroke leaf blowers” rule. Which is absolutely zero. I don’t know about other areas but out in Octotillo Wells there’s enough SxS idiots to keep the rangers more than busy
I believe the Chevron deference only related to federal agencies. States can still defer to state agencies for setting rules and regulations.

CARB was handed authority by the US Congress, through the air quality act of 1967, and the clean air act of 1970. Thus, they may not be able to say they were given authority for race only vehicles. Like an argument of what authority were they able to hand over in the first place. Since congress specifically excluded regulations for race only vehicles.

In the Air Quality Act of 1967, it basically states in section 303, they can not supercede the Federal Authority of what they were given to monitor. Thus, I'd still recommend speaking with a lawyer or someone within the AMA lawyers regarding this.

I received all my registration materials back from the DMV with a handwritten note that reads: "Hem [sic] was voided dg [sic] returning originals back to you. Must contact C.A.R.B. 1 800 242-4450 or arb.ca.gov for certification before registration."
OF COURSE, the CARB website is 100% completely worthless. OF COURSE it is filled with tons of useless drivel about keeping California's air clean and healthy by eliminating those pesky weedwackers and diesel construction machines. OF COURSE there is a link to register to vote (with no ID required.) OF COURSE when I call the phone number, I get a recording which tells me nothing at all, except if I am a manufacturer looking to certify a zero-emissions vehicle to press 1, or to go to arb.ca.gov for all other subjects.
These effing guys don't know my YZ125 from an electric toothbrush, nor can they even instruct another state entity in their own requirements, yet they are trying to regulate everything in the state.
Fuck 'em. If they don't want me to register my bike, so much the better. I'll save some $ and operate it anyway. Their loss.

Well, I didn't actually expect to hear back from CARB, but they answered my email today.
"There is no letter or certificate that CARB provides for closed course motorcycles."
Yeah, I know. Let's forget the fact that motocross bikes from 2021 and older are now supposedly grandfathered in for green stickers. I really don't even care; just give me a title. I don't even want or need a sticker, red or green.
