Color me not shocked.
I hope the attorney route rectifies the fraudulent actions.
Man there's some animosity in this thread or what LOL. For the record OldPro ran a carfax for me on his day off and was completely cool on the phone. Thanks again and don't let this place get under your skin. Pool guys don't exactly have a great rep either.
Seth the down votes are just reminders that there's 6th graders in here too. Let em have their giggle lol
What was the takeaway from the carfax report, legit fraud or anomaly?
Owner # 2 had the truck for 2 plus years without putting 1 mile on it. And no record of any mileage reported to the dmv during the transfer of registration either. Sounds like somethings fishy with owner # 2. Why didn't the dealer catch it is the question.

Dood,
I'm confused. You're one of the more patient guys on the board. I remember a thread when PHD guy was taking over management. You waited that one out. You've waited a week for today to come and now you're losing patience? If the general manager has been gone for a while he's for sure got other fires to put out besides your's. Why not wait it out another day before you go down a road of no return. Or have they offered you nothing? Seems a bit out of character for you to switch like that.
TM
Ouch, that hurt. Why the case of hard feelers? Did one of those identities kill your dog? Burn a cross on your lawn?
I kinda like you, Sally.
See, if I stay away from the personal attacks, I can stay. Guess that rule only applies to me.
Go ahead, hit the “report” button.
Hahaha yeah it's been a long week for a Tuesday
. When he talked to the dealer last week they were going to have an answer today. Today he was told they haven't heard from the dmv yet so they don't have an answer for him. The thing is the DMV told him last week the dealer has been notified, so were getting conflicting stories. We're going to give them till the end of the day and probably tomorrow. But I started researching auto fraud attorneys today just in case. I paid a nominal fee and now I have 3 attorneys I can ask questions to for a week. It was $1.90. For 2 bucks fuck it lets see what they have to say. Hopefully I won't have to call them, but wanted to research it just in case. I thought it was odd they wanted a dollar ninety. That was for a 7 day trial. Then after that it's 20 a month to answer however many questions we have. The LAST thing I want to deal with is attorneys but come on man quit fucking around it's been 8 months. Aaaannnd if the truck goes back and he has to search around for another one he'll be using my truck in the meantime. The whole things starting to irritate me, in the beginning they were going to handle it all friendly and so sorry we'll make it right, call next Tuesday. Now it's next Tuesday and instead of a solution we have more excuses why they can't do anything. Who said 3rd gear pinned through the window ?
I'm going for a bike ride at 2:30. That'll fix a lot of anger issues lol
One suggestion is to see if you can find someone else at the dealer to speak with. I had some annoying warranty situation getting the run around until I crossed paths with the right person at that dealer, once he got the run down it was handled immediately and he seemed genuinely surprised I was getting the treatment I was, given the situation.
once he got involved it was immediately handled how I would have hoped.
maybe something like that is out there for you.
Glad you went this route. I respect your patience in giving them the opportunity to make good.
I'd ask around to anyone you trust for a good reference to an attorney. With what you've presented here, you should have no trouble finding a good attorney and could probably work out a contingency fee so you're not out of pocket.
We really just want it resolved one way or another, it's gone from the registration sure is taking a long time, to hey there's some paperwork issue, we'll get it sorted out, to the carfax making no sense and the dmv being involved and physically inspecting the truck, and then all the going back and forth. In the beginning he thought it was just a slow process for some reason, to now it being in limbo. Are you keeping the truck ? are they buying the truck back ? could it all be computer and or human error like they're hinting ? The DMV says no it's tampered with so who knows. Then the subject of "What if it gets totaled and the insurance won't even pay what he owes on it because of the title ? Then what ? He has a step for the rear he hasn't put on because he doesn't know if he's keeping it or not, does he pay to get it detailed ? does he make any modifications he wants ? None of the above if the trucks going back, are they going to ding him for tire wear ? Are they going to bring up the 1 small dent and couple scratches that were there when he bought it ? Does he get the surf rack he wants ? Just all the little fun things you can do to your truck that he wants to do, but can't because he doesn't know if he's keeping it. He's not thinking about how fun it is to have a nice truck and concentrating on a road trip or desert trip in his bitchin new truck, he's in total limbo, and then meanwhile paying full boat for a clean titled truck every month. Part of the reason he went to a dealer was to not have to deal with private party bullshit etc. He went to a Toyota dealer to buy a truck with his hard earned cheese and has spent more time wondering wtf to do with it than thinking about enjoying it. That's why he decided if it does indeed go back (which seems likely), he wants every nickel he's put into it back. Period. Again, he went to a dealer to avoid dealing with bullshit from some private party sale, he wanted it to be all legit, and he paid for it to be all legit. And 8 months later he's in limbo and thinking about a bunch of bullshit that should've been a non issue. I'm super patient until I'm not, then I turn into a loud foul mouthed angry pissed off confrontational asshole. I'll call it like it is at full volume and tell any other customers in the store the reason why they should go somewhere else. You guys who've read some of my rant posts before know I can go on a roll. He's got a business to run, a wife and 9 month old son to think about, a mortgage and all the day to day problems associated with life in general to think about, and now he's gotta deal with this horseshit too? Aaaaannd pay full price. A thing that should've been a positive feel good experience has now turn into one more stressful problem to deal with. That's what pisses me off the most I think. He's got enough to deal with. Not even mentioning he needs it to make money too. I'm sorry not sorry but they need to figure this shit out now. Maybe calculate the bluebook value of the truck with a clean title vs the bluebook value of the same truck with a branded title and unknown mileage, pay him the difference and he keeps the truck. Plus whatever the dollar difference in insurance he's paid. He's been paying to insure a clean titled truck, not some salvaged title truck with unknown mileage. Anyway safe to say I'm pissed he's had to spend energy and get stressed over something that should have been a non issue. I get it shit happens and mistakes get made and yada yada but it's there job to make it right so fucking make it right. And if I'm being perfectly honest I got hot about the whole thing when I heard the condescending bothered sounding guy he was talking with on the phone earlier. There should be no attitude from the dealer, if anything they should be giving him the rimjob of the century to make him happy. It's all good it'll work out one way or another but wtf, all these computers and high tech horseshit nowadays and he's dealing with that ? Realy ? come on...
I feel for your son and you as this situation is not ya'lls fault. Please find the nastiest, meanest, angriest attorney in your area and sue the ever living shit out of them. If a business can not be managed any better than this, they deserve it. Good luck and keep us posted.
Where does the contingent fee come from in this case, other than taking 35% of the buyback money which would be a terrible deal for sumdood's kid?
Latest update. The dealer is actively trying to get to the bottom of the strange mileage readings on the car fax. And he has an e-mail stating if they can't get a non-branded title he'll get his full down payment, plus all payments made refunded. Just not the insurance. That's in writing. We're going to call that a win. It sounds like owner number 2 was shady, or there sure were some strange coincidences and discrepancies from more than one place, including whatever info the DMV found in the onboard computer(s) ? on the truck. Kind of curious to see where it goes now but at least in the meantime he's driving around in a nice truck and only paying for gas and insurance. So yeah.... call it a win. The bottom line is the dealer should have caught it, they know it and are prepared to eat a substantial chunk of cheese to make it right. Can't ask for more than that I guess. Everyone fucks up once in awhile, how a fuck up is handled speaks volumes. God knows I've eaten my share profit over dumb mistakes, nowhere near the tune of 15 grand though
. I'd imagine if the truck truly was tampered with beyond any doubt, the dealer will go after owner # 2. But it's been 8 months so who knows how that'll go. Going to file that under NMP. Not My Problem
That seems very fair and hard to ask for more than that. Sounds like the dealership is trying to do the right thing. Not all dealers are crooks, Hope it all work out for your son.
Magoober is gonna blow his top when he reads this.
I think that's more than good service. I wouldn't expect insurance back as he'd have needed insurance for any vehicle he drove. Also, drove the truck for free for 8 months. Now, probably has a nice down payment for another vehicle. Maybe the dealer will go out of their way to find him a replacement vehicle for a really good price. All without attorneys.
Has the truck given him any problems? If not, maybe after he gets his check, ask if they would sell him the same truck at 40% discount? He'd have to pay cash as he wouldn't be able to finance, but maybe you could help him out? They might just go for it to be done with it.
Good to hear.... ....but as you are no doubt aware....never count your chickens.
It's amazing how quickly they can correct course when they know they been caught or are on the hook.

Let me know when we need to find the kid one of those New Tacos.
He’s looking at every truck made right now 😂.
Ranger Raptor…?
Bill , do what you can to have him stick with a Toyota—- 100% the correct choice, and I’m pretty sure DCH is going to hook him up . Whatever he decides, text/email me the numbers and I’ll make sure it’s a screaming deal and I’ll also run multiple history reports for you before finalizing. I know it’s almost impossible to fathom for “some”, but there’s a bunch of good people running/owning Dealerships these days, it’s not the 70’s anymore
Chapter 327 of the U.S Code (§ 32710 specifically).
He lied to obtain FDIC credit, finance fraud as viewed by the Federal Government. Owner number two should be hiring an attorney, pronto.
Damn, I have to a agree…well…for the most part. While I’m not as excited about Toyota…this isn’t your fathers HiLux anymore…
You can’t argue with the value retention of a Toy-Truck.
If you have a problem finding a non-bullshit deal out here in the west, let me know. The so-called “hard to find” or “limited availability” vehicles all seem to be “quite available” nowadays. Even Ford’s Bronco, Ranger Raptor, F150 Raptor…etc.
Just put a friend in a Bronco for $1K back of the invoice (‘23 Badlands with incentives). However, finding a decent loan seems to be the challenge at the moment and that’s where the OEM 0-2.9% deals really shine.
DCH is so big, they will not go after anyone, they just want to bury, write it off, and move on to making money again. They give a rats ass about it. Of course, they can't say this up front as it would set an example for others to come in and want money back for the silliest of reasons so they have to create a resistance.
Toyota going to turbo motors in their trucks is a deal killer for me. Hard pass.
Why are used ‘previous model’ (‘14-‘21?) Tundras so enormously expensive?
They're V8 and time tested.
The new turbo motors suck.
Well, how did this end?
