In his mind it might have been a life or death situation, quite a few death by police incidents happen after someone is arrested. I've seen how aggressive some cops get after a suspect is handcuffed, even experienced it myself in college. I had 2 officers pull another cop away from me while I was hancuffed and being compliant. This whole don't play stupid games bullshit is easy for someone who isn't afraid of getting arrested and possibly killed because of something dumb like jaywalking. It happens in this country, and yes even unarmed white people like myself are abused by the police, but minorities don't seem to get the 2 rational cops to pull the sadistic cop off of them.

If he was so scared of cops makes you wonder why he would participate in illegal activities that would greatly increase the chances of an interaction with the police.

I’d hate to be a cop. Every decision you make gonna be scrutinized.

Hell, it’s just like...let em run away anymore. Let them go. Not worth all the crap that goes along with this.

Lethal/non-lethal. Force with equivalent force. Fist with fist. Gun with gun. Knife with knife. More and more I see if I wanna be a criminal, and drive drunk or make stupid decisions I’d have the upper hand on both sides.

With all the scrutiny the police are under, will many not be more likely to hesitate putting their lives at risk?

Tying their hands and giving the criminal an advantage.
Seems it isn’t even worth being a cop anymore.

Would never be a LEO now days in any fashion. The risk assessment is way to high. Criminals now have more power than the law enforcement does, and when you have media companies pushing a political narrative too it becomes about impossible. Not to mention municipalities hire their police chiefs, where as Sheriffs are at least elected every so many years. Who’s hiring all these racist cops anyways. They must be racist too. Plus I alway heard it was guns that kill people, so blame them, or the Chinese being they invented gun powder. I guess it’s always the blame game. It’s a great game to play, blaming others for self preservation seems to be a noble cause these days. Like when riding and you weed yourself all the hell, I always blame gravity or the spare tire around my waist. I know I didn’t put it there, it just showed up one day.

Brooks' killer charged with felony murder.

From an article about it: "The Atlanta Police officer who shot and killed Rayshard Brooks at a Wendy's parking lot last week was charged with felony murder, and the other officer on scene was charged with aggravated assault, Fulton County District Attorney Paul Howard announced Wednesday.
The decision comes just five days after Brooks was shot twice in the back in Atlanta during an attempted arrest. Officer Garrett Rolfe, who shot at Brooks three times, has already been fired, and officer Devin Brosnan, who was also on scene, has been put on administrative duty.
After shooting Brooks, Rolfe said "I got him" and kicked him, and Brosnan then stood on Brooks' shoulder, Howard said. The officers did not provide medical aid to Brooks for over two minutes after shooting him, Howard said.
Their demeanor after the shooting "did not reflect any fear or danger of Mr. Brooks, but reflected other kinds of emotions," Howard said."

Were they convicted? As I previously said, if hes charged it's a political grab. This DA is dirty as they come, hes already being investigated for stealing 100k. He filed the charges even though the investigation through the GBI has not been completed. He lied at the press conference and said the officer which did not fire his gun is willing to testify against the officer who did fire his gun.

Also, you and your family may want to read this supreme court ruling. You know, the supreme court which actually makes rulings on these sorts of things. The people who actually know the law and dont convict based off of political nonsense.

In the 1994 Supreme Court case Scott v. Henrich, 39 F.3d 912 (9th Cir. 1994) the Plaintiff argued that an officer should have used “alternate measures” prior to deadly force, basically asserting that deadly force wasn’t necessary. The Court stated:

“… as the text of the Fourth Amendment indicates, the appropriate inquiry is whether the officers acted reasonably, not whether they had less intrusive alternatives available to them. Requiring officers to find and choose the least intrusive alternative would require them to exercise superhuman judgment…Imposing such a requirement would inevitably induce tentativeness by officers, and thus deter police from protecting the public and themselves. It would also entangle the courts in endless second-guessing of police decisions made under stress and subject to the exigencies of the moment.”


Oh, and in case you didn't know, this same DA that's charging these officers had charged officers a few weeks prior for tasing protesters. He was quoted as saying "A taser is considered a deadly weapon under Georgia law" as grounds to charge the officers for aggravated assault. How well do you think that's gonna play out for him in court? The defense is going to absolutely shred him over that quote alone.

"Excuse me Mr. DA but did you not say a taser is a deadly weapon under GA law just a few weeks prior to this incident which was the basis for you charging those officers with aggravated assault? Hmm that's interesting, so a taser is only a deadly weapon when it's used against protestors but not when used against police? Deadly weapon today, but not a deadly weapon tomorrow?

You cant make this stuff up Laughing I cant wait to see this DA get torn apart. He has dug himself in such a deep hole and he will never be able to get himself out of it.

There’s charges already in place......

The PD will do an internal investigation (or should) but the Georgia Bureau of Investigations (GBI) is conducting an investigation into the shooting.

It’s an election year for the DA. Also, the Police Chief stepped down as soon as the mayor fired the police officers before the GBI investigation was completed. The police officers were forced out barely after the GBI even began their investigation. Felony Murder seems like a huge overreach by the DA and mayor that may ultimately result in a court ruling that could cause more rioting in Atlanta.

D.A. issues aside, I could prosecute this and get a conviction. There is zero doubt as to what the chain of events were since it is all on video. A Grand Jury is convened in cases where a conviction is based on eyewitness testimony, and circumstantial evidence. Also, are you skipping over the part where Rolfe said "I got him" and then kicked him while he lay dying on the ground, and the other dude was standing on his shoulder, all while not rendering any type of aid for two minutes and 12 seconds?

Come on Man, after everything that's happened in the last month, he was either too stupid to realize what had just happened and how it looked, or he didn't give a shit and it was exactly the outcome he was looking for.

If you take emotion out of this and look at the case objectively from a D.A./G.J. perspective, this is a slam dunk case. Do I think felony murder will stick? No, but just like any criminal assault case you charge higher and at worst it gets pled down. Being LEO you should know this better than anyone. Although in this case it might stick. Brooks wasn't shot in the side as he was discharging the taser, he wasn't shot in the front as if he was charging the Officers either. He was shot dead nuts in the back as he was running away. At that point he was absolutely no longer a threat that warranted an O.I.S. They knew who he was and where to find him if he got away. They had his fucking car and license, he wasn't getting too far.

I honestly dont even know how to respond to such stupidity. You should have bowed out a few pages ago like you said you were gonna. All I'll say is wait til you see the video of the "kick" and the "kneeling on the shoulder." And no, you're wrong. You do NOT charge what's higher in a criminal assault case. You charge what's appropriate in a criminal assault case then the DA will plead it down if the victim is okay with it and doesnt want to be put through a trial.

Unfortunately given the racial charge of this case it will be difficult to reach a plea agreement, unless the officer pleads guilty as charged and hopes for a lighter sentence. If the DA accepts a plea for a lesser included charge and gives a lighter sentence, there will still be civil unrest and the DA will be the target. If the jury acquits after trial, there will be civil unrest but the jury made the call so the DA's office is off the hook. A guilty verdict, even if for a lesser included charge, is the only hope to avoid civil unrest.

By the way, this isn't how this is supposed to work. If the racial makeup of this situation were different there would most likely be a plea deal. This is not a good case for either side, it could possibly be won or lost in jury selection.

Perspective can change a lot. My buddy got assaulting a police officer charges because his foot kicked the officers shin as the officer was tackling him from the back.
I know people are probably ready to type a response "why was your friend doing something stupid?". Sure, we should all be model citizens but it doesn't really matter and I still think you're a hypocrite unless you are ok with being shot and killed if you get pulled over for speeding in your car (since that is also breaking the law).

For those of you who have never been in a foot chase with an armed suspect this is how the suspect gets shot in the back. Can you tell if this is a real gun, toy gun or a BB gun no you cannot. This is even with the added daylight. Police officers have every right to defend themselves period. Don't resist and don't run. I copied this, feel free to share.

I’m soooo tired of hearing about getting shot for speeding or shot for drunk driving or sleeping in a Wendy’s drive thru. He got shot for assaulting an officer stealing his weapon. Fleeing the scene and shooting that weapon at an officer. The officer had know way of knowing yet if he had a gun on him or not since he resisted.
