What is the rule for foreigners coming to the states to qualify for LL's in 2009?

If a "foreigner" kid is 16 on the 1st January, but turning 17 soon afterward and considering they have had a successful amateur career in their home country. Would it be wise for said kid to ride "C" class and schoolboy 2 ?

Depends on how successful. If this person can qualify in Schoolboy 2 then they belong in B.

You'll get busted. It's happened before.
Kid from Costa Rica was busted for riding C after racing B and something called "Semi-Pro" at home.

What your age is on January 1st is what your age is for that year.

Technically Malcom's AMA age is 15, there for AMA can not make him race A class. Even with the advancement. They can just not allow him to race B. He can ride schoolboy still though.

If Malcolm is AMA 15, the AMA can't keep him out of B class

I add a couple things . There has and always will be legal sandbagging going on in MX. Also most if not all contingency programs have a clause that if you get even the smallest amount of factory support. The factory doesn't pay you contingency. So it saves them some money to keep them down a class.

The rules appear cut and dry to me. These are straight out of the AMA rulebook:

"Riders will be advanced at the end of each year effective December 31st. Advancement points will be calculated from November 1 to November 1 each year."

"In series’ that roll over into a new year, riders’ must begin the series in the class they will compete in during the new year. A rider cannot continue racing their class from the previous year if they are no longer eligible as of December 31st."

"*No rider, youth or amateur, can be forced to compete in the A class until January 1 following their 16th birthday. Riders under 16 years old may advance on their own
ability/competence."

So basically if he turns 16 AFTER 1/1/09, he can race B class no matter what. If he's already 16 and the series started prior to 1/1/09, he should have started the series as an A rider.

Malcom is 16. It's funny how this thread keeps going round and round. At the beginning of that series no one knew if they were even being advanced at all let alone at the first of the year based on the AMA's past history. Once the list was out what do you do? Move up or finish a series that you already started it appears the promoter made a ruling not a bad one IMO.

Oh and while I don't like sandbagging I can understand it. Riders have been staying in the B classes for years until they reach the top of the class and win a few championships thus getting some support that is crucial to turning pro. I complained to Ryan Holiday a few years ago about a 19 year old B rider that was in the class for 5 years and his response was so what.

There are some riders that will be on the line at the next SX that won B class championships when they were 18 or 19 years old. They got great support and went on to be successful pro's.

Dave gave me a good lesson a few years ago when he said riders that may have winning "potential" will get more support than a top ten A riders (or something along those lines) and he was right.

You can't blame the affected riders that are mostly young for being salty they most likely got 1 year in the B class lost their schoolboy eligibility and had to race against A riders that should have been moved out of that class last year and didn't.

Youngsters have a very small window to prove themselves and if they have Pro aspirations support is critical. You cannot get that support unless your at the front and not all 16 years are ready for the A class.

But people also have to realize, Malcolm was at mino`s given his interview on the podium. He stated himself as I was only maybe 5 ft from him, "this will be my last race in B" . so, my take is he knew he was being advanced. You dont start a series in B for a week knowing that you will ride in A for the rest of the year. They were his own words.That is what has alot of people angry. Not at Malcolm(I think he is a good kid & and an excellent rider). But all riders advanced. The only thing I think people are angry about is the fact that all kids race for the cont. $$$. And if a advanced rider does not move up that is money out of the riders who belong in B being taken away.

Ummmmm, I doubt he makes the decision which class he is going to ride. Everyone knows that Big James runs the show.

Either way, the big question is if he was 15 when the series started. That overrides his LL's finishe or any Advancement, right, since he can't be forced to run A at 15. Also, since the people running the series said that everyone stays in the class that they started in I don't think the AMA should try to move him up.

If he was 16 when the series started though he should have started in A and should be moved up. That's just MHO.
