The bar for prosecuting a former president should be very high. While no one should be âabove the lawâ, this action could set an unnecessary precedent. The act itself is a misdemeanor, unless campaign funds were used. It does smell like partisan politics, as a convicted felon could not run for office. However, it also keeps Trumpâs name in circulation, which plays into his overall strategy.

Basically it is falsifying business records, which is a misdemeanor. If it is shown the fraud was committed knowingly and intentionally to commit or conceal "another crime" it becomes a felony. The misdemeanor charge will be easily proved, but I don't know what the "other crime" would be that would make it a felony. Won't know for sure until the indictment is returned, if an indictment is returned.
That's what I understand but we won't know for sure until there is an indictment. It also has something to do with tax avoidance I think.

The dangerous precedent I believe is that there is nothing stopping politically motivated district attorneys throughout the Country from bringing nuisance cases against their political opposition. The "No One is Above the Law", slogan seems to be designed to justify very weak nuisance cases attacking political opponents these days.
